Review: In late July 2014, I took four shirts to ZIPS Dry Cleaners to be laundered and pressed with light starch. On or about August 2, 2014, I picked up the shirts and found that one of the four was returned to me with a dingy collar and cuffs. I brought the issue to ZIPS' attention and ZIPS re-cleaned the shirt (a redo) in an effort to resolve the problem. ZIPS could not clean the dingy collar and cuffs and placed a tag on the shirt that reads: "Sorry... Speical attention was given to the spot(s) on this garment. However, ZIPS was unable to remove the spot(s) due to the risk of causing damage to the fabric or color in your garment."

On or about August 9, 2014, I returned to ZIPS and requested the replacement cost for the damaged shirt. However, ZIPS management argued that my remedy was with the shirt manufacturer. Nevertheless, ZIPS management offered to provide $20 in cleaning discounts for "my inconvenience." I disagreed with ZIPS management's explanation for the shirt damage and rejected the offer for cleaning discounts.

I contacted Paul F[redacted] via e-mail on August 9 inquiring whether there were any problems with manufacturing defects with my 2-Ply Cotton Pinpoint Solid Tab Collar French Cuff (Blue french cuff shirt), which I purchased from Paul F[redacted] in January 2014. A Paul F[redacted] customer service official responded to my August 9 e-mail inquiry via e-mail on August 10 and informed me that there were no manufacturing defects related to my Blue french cuff shirt. Against this factual predicate, I am filing this complaint.

As noted, each of the four shirts I took to ZIPS have white collars and french cuffs. Prior to the August problem with by Blue french cuff shirt, I had taken shirts to ZIPS once a week for a few months without incident. In fact, I had taken the Blue french cuff shirt to ZIPS on a number of occasions prior to the problem in August. The body of the shirts are striped and or a solid color. The shirts were manufacturered and sold by Paul F[redacted] Shirt Company (www.paulfredrick.com).Desired Settlement: I note that the warranty language listed on the back of the ZIPS customer receipt reads as follows: "The company's liability with respect to any lost or damaged article shall not exceed 30 times the charge for processing it . . . ." When I met with ZIPS management on or about August 9, 2014, and suggested that the ZIPS warranty language be used to establish the remedy for replacing my damaged shirt, ZIPS managment argued a narrow reading of the word "damaged" asserting that a shirt that ZIPS ripped would be covered by the warranty language but not a shirt that was discolored, which the shirt manufacturer would cover.

Because there is no manufacturing defect with my Blue french cuff shirt and there is no plausible explanation for the discolored collar and shirts other than ZIPS cleaning process, I hereby request replacement cost of the shirt from ZIPS as a remedy for the damaged shirt. The cost of the dry cleaning service for the shirt was $1.39. In accordance with the ZIPS warranty language the damages remedy is $41.70 (i.e., $1.39 x 30).
