Review: Dear somebody whom may it concern, I planed to renovate for my current apartment. I had looking for someone who wanna took this job professionaly. I got recommendation for Zium Arch Corp, and I believed that they would be done my place renovated professionaly. 1) Therefore, I made contract with Sang W[redacted] who is a senior architect at Zium Arch Corp on Febuary ** 2015. Total amount is $2,800 with initial payment upon contract $1,800 & interim payment upon DOB Approval(Department of building in NYC) $1,000 2) I filled the contract with him, and I paid for $1,800 right away. 3) Suddenly, he asked me more money for DOB APPROVAL even though we made the contract about DOB APPROVAL & payment agreement from both parties on Febuary **, 2015. He sent me **d amended proposal with $5,000 on April **, 2015. 4) I disagreed with his amended proposal enforcely. 5) He sent me 3rd amended proposal with $4,700 on April **, 2015. 6) Also, I disagreed with him, again. 7) He sent me the fourth proposal with $3,500 on May **, 2015. 8) Definately, I rejected his amended offer. His manner was so bad that there is no space to solve this problem via conversation rationally. 9) I have kept contacting him many times via email & mail because I wanted him to come back this job done professionaly. He never answer, and ignore me. 10) After that, he did not move any inch so far. He just dissapeared.Desired Settlement: I have wasted my time a lot countlessly because [redacted], Sang W**, who is a senior architect, has been doing his business unprofessionaly. I know I can not get back compensation about my time. However, I want him to refund my money, $1,800 as soon as possible. I hope Zium Arch Corp never make another victim.

The Proposal we made, does not include [redacted] Process. Contract were termed by ** as per his request 5/* and now ** is changing his words to claim money back. There is no reason to return back initial payment $1,800 nor any for compensation. Also we had worked hard to process this work for during 2-3 months. $1,800 is less value than we actually worked. Therefore I ask to close this complaint promptly. Thanks for your best concerns. From. Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]To whom it may concerns, Please accept this letter as a response about recent reply made by Sang W[redacted], case # ID [redacted]. 1. We, Zium Arch Corp (now referred as Zium) and Mr. Jae H[redacted] (now referred as **) made a fee proposal agreement on 02/**/2015 to file a renovation plan to Condo management, The Olmsted Condominium for his apartment unit **, which located on [redacted]. At the time of meeting on 2/* which same on proposal signed, there were 3 parties including **, his Constructor and myself for site visit and design concept discussion, etc. I was told by ** and contractor that "this condo does not require to file a [redacted] and never have been done with any other apartment for such renovation works." Thus we, Zium released our fee proposal to comply only Plan approval process with Condo Management, not included [redacted] process. Additionally, I strongly explained to Mr. ** that in case management would ask for [redacted] Approval later, there will be subject to charge additional fee.Answer>> Sang W[redacted], who is one of Zium Arch Corp`s Architect, never seen my contractor before, and never talk to on the phone & email. Nobody around me told him that we did not need to file [redacted] Approval, even our management. Additionally, Sang W[redacted] never discuss with me about design concept for [redacted]. He talked with an unauthorzide person like his friend, not me & my contrator. Please show me the evidence.2. We, Zium never made a contract for [redacted] Process and ** already acknowledged about it. A Scope of Work on the Fee Proposal did not include any process with NYC Dept of Building. On Payment Schedule, initial payment upon contract $1800 and interim payment upon DOB approval $1000 were indicated. However to clarify meaning on fee schedule of proposal, we explained that the DOB here is regarded as Condo Management. There were no [redacted] process indicated scope of work on proposal, this to be referred as condo management. And also we explained this earlier to client at beginning point. Now ** is changing point and insist saying that DOB approval were included in proposal, is not right.Answer>> "DOB" stands for "NYC Department of Building", Sang W[redacted] knows it, and other Achitects knows. Even I know. Sang W[redacted] is a construction expert as a Architect. He knows how to start renovation for condo unit. Anyone who wants to do apartment renovation as owner will be required [redacted] Approval. Therefore, he known that [redacted] Management would ask for [redacted] Approval later. That is reason why Zium Arch Corp made the contract with me for renovation located on [redacted] including DOB Approval. 3. What issue came were after 4/** which review report was received from management. Management recently hired 3rd party engineer to review the renovation file and their evaluation report stated that this such renovation is required to provide "Approved document for work permit approval from would ask for [redacted] Approval later" with all other items. Answer>> It takes almost 3months(from Feb * to Apr **) for me to hear "we need [redacted] Approval" from Sang W[redacted]. 4. According to the report, We, Zium, explained about the review report to ** and mentioned if the [redacted] item can't be waived by management, amended proposal should be issued with additional services fee for us to process [redacted] work. and he understood this circumstance and requested us to issue a revised proposal in case we needed. Thus what he stated on Revdex.com, "suddenly he asked me more money for DOB APPROVAL..." is not correct.Answer>> Sang W[redacted] made our first contract, NOT ME. He brought it by himself in front of me. I signed. He signed. Both parties agreed, and exchange money. Therefore, our first contract is legally binding. contract is contract. To protect this kind of argument, every business tracsaction shall be needed THE CONTRACT. In my position, suddenly he asked me more money for DOB APPROVAL becuase our first contract is $2800 including DOB Approval. 5. 4/** we, Zium, called and asked Condo Management to waive [redacted] and few other items. they rejected with saying "all should be done as it written on report" and I also told that ** already visited the date early morning to management office and made a bigargument complaining why [redacted] process should be processed only for **'s apt, which never been filed with any other apts in this condo before. Answer>> According to DOB website, all Unit Owner who did renovation their apartment filed [redacted] Approval. They did it. My current Architect showed me all list who has DOB Approvals. I do not know why Sang W[redacted] said to me " [redacted] process should be processed only for **'s apt, which never been filed with any other apts in this condo before".6. 4/** after spoke with **, amended proposal were given with service fee $5,000, 4/** $4,700, and he hesitated the offer and requested again all other filing fees to include in our service fee, so we, Zium would rather give reduced fee 5/* $3,500 at goodwill which we never done with any other customer before.Answer>> I should have accepted his redueced proposal if he was at goodwill. Truly, he was not. He made a lot of additional charges behind $3500. 7. After all negotiation, 5/[redacted] wished to clarify all comments on last fee proposal and we answered it via phone. ** also commented to add some detail on design plan before filing to [redacted]. Answer>> It was the first time for him to listen to me about design. 8. 5/* ~ 5/* we waited for signed proposal from ** to process [redacted] work.5/* we received forwarded email from 3rd Party, asbestos engineer who also involved this job, that we have been fired by **. So ** can't work with this asbestos engineer. 5/* we later received email from ** that he no longer wish to work with us and term the service contract with us as date of 5/*/15. besides, he asked the initial payment of $1800 return and compensation $7000 due to delay of renovation work. Thus, what he stated #8,#9 "kept contacting him to come back this job done...he just disappear" is totally not true. Answer>> He made the breach of contract. Never do due diligent as a Architect. I could not work & stick with Sang W[redacted], so I tried to contact him via mail & email to solve this problem gently via normal conversation. He never answer me. This message is the first time reply from Sang W[redacted]. He made me dissapointed from A to Z. **conclusionI will not complain about this matter if Sang W[redacted] will return my check, $1800.Also, I will not ask any punitive damage & monetary compensation for renovation delay. Hopefully, I do not want Sang W[redacted] to take emotionally this issue. As he is the business owner, do not make me against Zium Arch Corp in the future. Nobody knows in the future what happens. Please pay back me and move on. Thanks for your best concerns.
