Review: My name is [redacted] - I’m a New Yorker (describe yourself with a few words).

I’m kindly requesting your assistance with the following consumer protection matter.

On September **, 2013 I purchased online fitness equipment from the company ZKJ Fitness, via their website [redacted].

I paid a total of $7,250.72 for an item called Technology Kinesis Personal Heritage. The transaction was registered under ID#: [redacted].

The item in question was never delivered.

My numerous emails, phone calls and inquiries regarding my order, remained unanswered.

I didn’t hear anything from ZKJ Fitness until last January, when I hired an attorney in an attempt to recover the above-mentioned amount. To my surprise, the ZKJ Fitness flatly refused any refund. A company manager stated that refund is impossible since they “are no longer with the credit card processor … used when we charged the credit”. [redacted], the ZKJ Fitness’ [redacted] urged me instead to “dispute the charges” with my credit card company.

To recap: ZKJ Fitness never delivered a purchased item tried and kept my payment of $7,250.72.

I would appreciate your help to recover my payment.

Here is the company’s information:

Review: On 2/**/2013 I purchased a used treadmill for $1000 plus $400.00 in shipping. When the treadmill arrived it was severly damaged. We had a repair estimate at $1,500. When I called Fitness Equipment, I was told that it was not their responsibility and to contact the shipping company. The shipping company said they would give us $43.00. When I told Fitness Equipment about this, I was told that was all that could be done.Desired Settlement: I would like a full refund of $1,400.

Response:

I have attached the signed sales documents stating our Policies on Shipping Damage as well as signed invoice #[redacted] which does not include additional freight insurance as it was not requested by the customer. We will be happy to provide pricing to [redacted] for any replacement parts that may be required to bring the unit back to its condition before shipping but require a parts list to do so.

Thank you,

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Fitness Equipment Depot did not package and ship the treadmill correctly. It

was placed on a pallet and then wrapped with saran wrap. When it arrived at our facility, there was

over $1,500 of damage. At first I asked

for my money back and was told no refunds and that I had signed a waiver form

for shipping. When [redacted] said I could get

a refund, I was told by [redacted] that if I received a refund from [redacted], Fitness

Equipment would sue me. I have several emails

from [redacted] at Fitness Equipment. I did

contact another dissatisfied customer that is currently in a lawsuit with them,

but was hoping to avoid getting in a lawsuit.

When I decided to place a negative review on [redacted], I was asked not to do

it and reassured that they would be able to work with the shipping company and

make it right because of their good relationship with the shipping company. As it is now well past the 60 day review policy

on [redacted], the only place to file a complaint is with the Revdex.com. While I do not expect anything to be done by

Fitness Equipment, I would like it to be of record that they are not a

reputable business and buyer beware when it come to their shipping policy.

Please be advised that payment was received from [redacted]' Mastercard on 3/*/2013 (a Paypal transaction was not received by ZKJ Fitness. ) Unfortunately since his purchase our credit card processor has changed . Our current processor cannot locate or verify the original charge and advised to suggest to the customer that he "dispute" the charge and once we are contacted by MasterCard of the initiation of dispute we will confirm that with [redacted].

Please note that we do not recognize [redacted] as this name is not in our database, I do show reference of an email address "[redacted], please confirm that we are referring to the correct customer; [redacted]

Response:

Please be advised that after further review of this transaction, [redacted]'s MasterCard was charged on 3/*/2013. The credit card receipt is attached for reference. Please also be advised that as per the PayPal, those transactions did not generate as they were a temporary hold and an expired hold. We have had another instance like this since our Processor changed and by disputing the charge, the bank will in turn give customer back the charged amount.

Thank you.

Review: Hi,

On July [redacted] 2013, I paid the company $ 2245.00 for the purchase of a piece of exercise equipment that was supposed to be shipped to Miami.

Initially they told me that the item was to be shipped on July [redacted] 2013. It was not shipped on that day. I contacted them and they told me that the new shipping date was to be August [redacted] 2013. Again the item was not shipped as promised.

For days I tried to email the person who I was dealing with but all my emails went unanswered. I was finally contacted by someone else who claims to be the [redacted] and he informed that the item will be shipped on August ** and that someone will contact me regarding the shipment. Again, no one contacted me and the item was not shipped.

All attempts to contact this company by phone fails, as no one answers the lines and they go straight to voice mail, when I leave a message no one returns the calls. They don't answer the cell phone either. I provided my number to them and never called.

It has been almost 2 months since I paid this company and they have failed to provide me with the item, and fails miserably in keeping customers informed about orders.

Based on my experience I fear that this is a fraudulent company.

Your assistance will be greatly appreciated as this is a lot of money for me.

Sincerley,

[redacted]Desired Settlement: I am fed up and will like to get a refund.

Response:

Review: Ordered a specific product from these ss. they sat on the order for a couple weeks with no communication. finally I called to ask what was happenning with my order and they arrogantly told me; "Sorry, we dont have that product after all, but here's your two options: you can purchase an alternate product that WE HAVE IN STOCK, OR YOU CAN WAIT (WHO KNOWS HOW LONG) UNTIL WE GET ANOTHER ONE IN STOCK".

to which I replied: "just cancel my order and refund immediately".

they replied that they MUST charge a restocking fee of 25% or about $300.00.

these mns tell me that they MUST charge a 25% restocking fee on a product they don't even have????? so, they have to charge me to RE STOCK and the product I ordered, but that product is not now or has never been IN STOCK????

even presented with the obvious insanity of this ludicrous position - they REFUSED TO REFUND MY MONEY.

I'm looking to be refunded now- nothing else will suffice. these people should lose their business and be in jail. THIS IS FRAUD!Desired Settlement: I WANT MY MONEY BACK.

Response:

[redacted] finalized his order with ZKJ Fitness on 9/**/2013 when his

payment and signed paperwork was received; starting the 2 - 6 week lead time as stated on signed invoice #[redacted].

I have

attached several correspondences between the customer and our CSR at the

time, for your review as to the options and chain of events that took

place regarding this sale. Please take particular note to

the email from [redacted] to [redacted] on Sep ** @ 4:57PM and his

reply to send additional info at 5:12PM

I have also attached the original sales documents [redacted] mentions in her emails regarding, lead time and re-stock fees.

The statements in [redacted]'s complaint are inaccurate and inappropriate, thank you for your time and consideration in resolving this matter promptly.

Review: Placed an order (Treadmill, Elliptical, ABS Bench and Calf Machine) with them back in October of 2013. Received wrong elliptical, BROKEN treadmill and calf machine in December of 2013 (contract says “all equipment will be delivered within 4-6 weeks” but it took them over 8 weeks) Company refused to replace wrong elliptical and fix broken treadmill! Also, they refused us return/refund! We had to spend over $500 to repair the treadmill we got from Fitness Equipment Depot Worldwide! From December of 2013 to April of 2014 we were calling them every other week to get ABS bench we paid for back in October of 2013 and still didn’t get it!! On April **, 2014 we were promised by [redacted] to get our refund for ABS bench and later on the same day we received an email from [redacted] of Fitness Equipment Depot Worldwide stating that we are getting our refund within 10-14 days! Today is May **, 2014 and still no refund received from Fitness Equipment Depot Worldwide! Made multiple attempts to resolve this issue but all unsuccessful!Desired Settlement: Want to get reimbursed for the repair of treadmill, get elliptical replaced with the one I ordered and finally get refund for undelivered ABS bench

Review: On March/*/2013 I made a full credit card payment of $4350.00 to Fitness Equipment Depot Worldwide ( ZKJ Fitness inc) for a New Hammer strength Plate loaded Chest/Back combo machine , Triple tier Dumbbell rack ( Re manufactured ) delivered to the port of [redacted] Japan . This company estimated a delivery date of April/**/2013 but until now I have received no refund or no equipment that I specifically ordered . Fitness Equipment Depot (ZKJ fitness Inc) also has mentioned countless times that their sales rep at Hammer Strength (Life Fitness ) is not responding to their inquiries regarding my order status and that is the reason for the delay of my order . This situation was starting to frustrate me so I decided to contact Life Fitness and to my surprise Fitness Equipment Depot (ZKJ fitness Inc) has never put in my order nor have they heard of Fitness Equipment Depot (ZKJ fitness Inc) . Soon after I email Fitness Equipment Depot (ZKJ fitness Inc) and informed them and asked the status of my order and they then tired selling other equipment in their current inventory . Fitness Equipment Depot (ZKJ fitness Inc) then said they don't actually have a rep at Life Fitness and to obtain the equipment I order they must use unethical was to obtain my order . Fitness Equipment Depot (ZKJ fitness Inc) they tried to ship the Triple tier Dumbbell rack to Kobe port , which is about 600 miles away from the port that I specified ( [redacted] ) . On July/**/2013 an employee at Fitness Equipment Depot (ZKJ fitness Inc) emailed me and stated that Fitness Equipment Depot (ZKJ fitness Inc) had made a full refund of $4350.00 and I would receive my money within 10-14 business days . It is now August/*/2013 (Japan time ) and still noting has happened .Desired Settlement: $4350.00 credited to my credit card without service charges or restocking fees .

Business

Response:

Please be aware that on August [redacted] after many attempts to refund [redacted]'s credit card, an email was sent to him explaining that we were not able to do so since our credit card processor has changed since the sale was processed. Our current processor cannot locate or verify the original charge and we were advised to suggest to our customer to "dispute" his charge which will result in the credit back to his account. [redacted] does not feel this is truthful as he explained via emails but these are the facts in this unfortunate and unforeseen circumstance; ZKJ Fitness is unable to process a credit to his credit card but is willing to confirm the crediting back of his monies when contacted by MasterCard of his initiation of dispute.

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Hi , Since March this company has been giving me the runaround with this order . They first mentioned that my order would be delivered to on April/**/2013 . Second runaround was regarding the manufacturer and lack of communication . I then contacted the manufacturer and the manufacturer mentioned to have never heard of Fitness Equipment Depot Worldwide or recall an order being placed by ZKJ Fitness inc( Fitness Equipment Depot Worldwide) . Third runaround was the shipping port . I specifically mentioned "Koyagi port" was the closes to my studio . After continuous emails they finally confessed that they would not be able to obtain the "Hammer strength chest/back combo machine". They then mentioned sending a portion of my order to "Kobe port" , this port is more than 600 miles away from my studio . Fourth runaround is refunding my $4350.00 . I understand this company changed their card processor but for the past few months they have not been honest with my order so this new excuse regarding difficulties crediting my money because of a new processor seems to be another malice act . The most productive solution would be a direst deposit to my account of $4350.00 , I'm tired with these games being played and dealing with ZKJ Fitness inc( Fitness Equipment Depot Worldwide)

Sincerely,

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Fitness Equipment Depot Worldwide (ZKJ Fitness) informed me to contact master card . They mentioned not having my record because of changing their processing system and I suggested to deposit my money in my bank account to speed up the process , I'm tired with dealing with such a malice and unreliable firm . Since day one with dealing with

Fitness Equipment Depot Worldwide I have been told lies upon lies . I was told by an employee that I would be recieve my $4350.00 10-14 days after July-**-2013 and its now October *-2013 and I have still have not received one penny . This company is a fraud .

Sincerely,

Business

Response:

Please be advised that we were notified of the credit card dispute by [redacted]. The refund will come through the customers credit card.

Thank you.

Review: This business failed to fulfill the legal and binding contract created in an [redacted] auction. Company failed to honor it's own terms and conditions. Company lied about reputation to close deal. Company attempted to pull off a "bait and switch" for other product. Company failed to refurbish a very simple machine that indicates they are not a reputable business in their field.Desired Settlement: I want 100% refund of all fees paid to this company. I have paid interest on non existent product for 2.5 months.

Review: This company charged me full price for 2 items that I purchased. After 6 weeks of not receiving the items and being given the runaround, I requested a full refund multiple times. They then began to give me a series of lies, all of which I have in writing, about the reasons for non shipment. I was lied to on 3 different occasions, stating there was a part that needed replacing (even though it was advertised in full working condition) and that the part had been picked up and was en route for delivery. Only to be told a week later the same exact story, then once more. I was belittled with multiple insults, all of which I have on email. This company FINALLY gave me a partial refund, after involving a 3rd party, but refused to refund all of my money, claiming a "restock fee". I have never had such a bad customer experience in my life. They scam people!Desired Settlement: I would like the $354 I am still owed from my refund.

Business

Response:

Please be advised that we were within our standard 2-6 week lead time

Review: I ordered the Life Fitness 95 Te Treadmill on 12/*/13, at which time I paid the full price of $2,570.00 via credit card. The initial delivery was scheduled for 12/**/13, yet, on that date, no information was given regarding the status of the machine or its delivery. I emailed the salesperson with whom I had been working to inquire and was told to call to discuss the status of the machine. On 1/*/14, I was informed by said salesperson that he was no longer working for the company. I made numerous subsequent calls to the company and, through those contacts, learned of the logic board issues with the treadmill. On 1/**/14, I was informed via email that the company was changing the plug on the machine. I again asked for updates on 2/*/14 and received no concrete information. Having failed to receive any information by 2/**/14, I emailed to request a status update and was told that the company was waiting on the logic board. When I inquired as to why it had taken 6 weeks for the board to be repaired, I received a series of dismissive emails from company [redacted], who ultimately stated that he lives in CA and is not involved in the "day to day". [redacted] directed me to contact an individual named [redacted] from that point forward (the third contact, following the initial salesperson who left the company and a second salesperson who was fired). On 2/**/14, I wrote again to [redacted] and [redacted], asking for the work order number to enable me to directly contact Glide, the company repairing the logic board. The work order was never provided and I was forced to contact Glide without it, resulting in a failure to obtain any specific information about the logic board for the machine I had purchased. I was subsequently asked by [redacted] not to contact Fitness Equipment Depot's vendors. On 2/**/14, having still not received any response from [redacted], with whom I was asked repeatedly to communicate, I emailed again to ask Fitness Equipment Depot to call Glide to obtain status information regarding the logic board. Although [redacted] apologized for her lack of communication in an email sent on 3/*/14, she continued to provide no information and simply reiterated that the logic board was the problem. She stated that she expected it to be shipped by the end of the week. I inquired about the status again on 3/* and 3/**/14. Treadmill delivery was ultimately set up for 3/**/14 between the hours of 9 and 11 am. I was forced to email again when I had received no word about the delivery by 2:30 pm. The treadmill was eventually delivered after 8 pm.

On 4/*/14, after 4 runs totaling a mere 12 miles, the treadmill stopped working. A technician came to the house on 4/*/14 and determined that the problem was with the logic board. On 4/*/14, I emailed to ask what the issue was specifically and received the following response from [redacted], "I have explained in the past to [redacted] that I am not involved in the day to day and don't live in NY and it is inefficient for him to send emails to me that I need to forward to the appropriate parties". I emailed again on 4/**/14 asking for a status update and was told that the company would know about the return date of the board later in the week. I again expressed concern about the delay on 4/**/14 via email, and asked for copy of my warranty in writing. Additionally, I stated my expectation that the warranty term be reset to the point at which the boards were reinstalled. I was told that the [redacted] would speak to the warranty department and let them know I was awaiting a copy. A copy of the warranty has still not been received as of 6/**/14. Additional email inquiries about the logic board repair status were made on 4/** and 4/**/14. I was promised a service date on 5/*/15. On 5/*/14 I was told that the logic board would be arriving at the company and a service date of 5/**/14 was planned. Despite my email confirming that this date was acceptable, the [redacted] said she did not receive this confirmation and had consequently put my delivery on the schedule for 5/**/14 instead. In the middle of the delivery window on 5/**/14, I received an email from Fitness Equipment Depot stating that they would not be coming to service my treadmill that day, as the logic board had stopped working again. I responded via email expressing my continued concerns. As of 5/**/14, I was put on the schedule for servicing on 5/**/14. I emailed on 5/**/14 to see if they had called my wife to set the delivery window and was informed that the logic board was still not ready. Service was tentatively scheduled by the [redacted] with my wife for 6/*/14 but no update was ever received. The service was again scheduled for 6/*/14 between 12 and 2 pm. My wife called at 1:30 pm to check on the status of the delivery and was told that the technician was running approximately 1 hour behind. She received a call from the technician at 3:45 pm stating that his truck had broken down and that he would not be coming that day. My wife spoke to [redacted]) and was told that she would receive a return call that day to address the continued issues, but no such call was received. Although the [redacted] also informed me via email that day that she would be calling me to discuss the situation, she did not do so either. On 6/*/14, I emailed again to find out the service status. As the technician's vehicle was still not fixed that day, delivery could not take place but was scheduled for 6/**/14. The technician worked on the treadmill for 2 hours on 6/**/14 (reinstallation of the logic board that was reportedly at 100%, according to a company email, was all that was needed) and reported that he could not get the machine to work, even after time on the phone with tech support. He expressed embarrassment and recommended in his paperwork that Fitness Equipment Depot send us an entirely new machine.Desired Settlement: I wish to have the treadmill with the continually defective logic board removed from my home and my money refunded.

Review: FITNESS EQUIPMENT DEPOT WORLDWIDE AT [redacted] ADVERTISED A PRECOR EFX 546i EXPERIENCE ELIPTICLE ON [redacted] AT A NO RESERVE AUCTION STARTING AT .99 CENTS FOR A 7 DAY AUCTION. I WAS THE 40TH BID THAT WON THE AUCTION FOR $640.00. WHEN I CONTACTED THE COMPANY TO SET UP DELIVERY THEY INFORMED ME THAT THE AUCTION WAS A MISTAKE AND THAT IF I STILL WANTED THE ELIPTICLE I COULD HAVE IT FOR $2000.00. THEY ARE NOT WILLING TO EAT THE COST ON THERE MISTAKE EVEN THOUGH I KEPT MY END OF THE BARGAIN. I AM IN THE PROCESS OF TRYING TO GET A REFUND.
