I am very disappointed to see the complaint filed by Mr*** as if he wanted us to stop contacting him, per debt collection law all he had to do is simply tell us this and not file a complaint. No more communication will be initiated by this office to Mr***.That being said there are a
couple points that need to be addressed regarding his complaint which show more the fact that he doesn’t like that he was turned over to collection as opposed to us doing anything to violate any of his rightsFirst of all, the statement made that we have made numerous phone calls to him is 100% falseWe were never given a phone number by the Gilbert Municipal Court for him and do not have a phone number on recordHe has only received two mailings from us in the last yearI think Mr*** would be hard pressed to find anybody that would claim two letters in a year to be of a harassing natureWe have spoken to him twice on the phone, both were phone calls he initiated with us on 1/24/and 5/8/In both situations we told him if he wanted to dispute the validity of the debt, he would need to file a motion with the courtHe stated that he would in and in he stated that it was a nightmare and that he had a life and a job and that he could not goA collection agency does not have the ability to make a decision on a ticket, only the Court doesAs Mr*** has been told on multiple occasions, he will need to address this matter with the Court and they will then instruct us on whether to keep the account activeAnother assertion Mr*** makes in this complaint is in regard to the fact that he has filed for bankruptcyWe have let him know that debt owed to a Court is not dischargeable through a Chapter bankruptcyNone of our collection attempts are in any way acting (as Mr*** states) “above the law.” Again, if he wants to contest the validity of the debt and attempt to have it dismissed, we have zero authority to do so, only the Court does

In regard to the settlement offer that was made, we are still willing to agree to the original termsBased on past experience and issues we had about putting the settlement offer to paper before payment was made, I am unable to provide this information in writing prior to payment The full
terms of the settlement was specifically to allow the lower payment but that I was unable to provide the paperwork prior to the agreementI don't see that an agreement was ever in place as Ms*** only agreed to the part that benefited her (saving over $400) but not the other term of the agreement (receiving a paid in full letter with the settled upon amount after payment was received)To try and resolve the issue amicably, I had even offered the option of having a paid in full receipt ready at our office and would have exchanged the paid in full receipt at the settled amount at the exact same time that payment was madeBecause no payment has been made, the debt is still considered as derogatory until payment is received. The remaining details of the complaint relates to a disagreement between Ms*** and the original creditor and not our companyIt is not my place to provide any explanation regarding the matter our company was not part of that contract

The information presented in this complaint are 100% false. We have never spoken to this individual. The only communications have been in response to complaints that he has made about us. The main point that he argues in this complaint is that we are required to provide a signed contract for this...

debt. This is an oral contract that was made by him and our client, (a local municipality). His utility account was set up based on a phone call on July 26, 2010 where a positive ID using his full social security number was used for set-up.  As a governmental agency they are not required to have written contracts. Statute of Limitation law allows for both written and oral debts and in this case it is a legal and binding oral contract. Proper validation was immediately sent after we received a prior complaint from this individual regarding this account. Lastly, multiple attempts were made to send notification of the account when we were first assigned the account in 2013 with our attempts to send to a last known address and a skip traced address returned. Only after making a good faith effort to contact this individual, did we place this on his credit. Certified mail is not required, we are only required to send as a first class letter.This account has been validated as a debt, it will remain on his credit as a disputed but owing debt and will be that way until it is paid in full. We are extremely disappointed that the assertions have been made that we have been breaking federal collection law, as we are 100% compliant in all of our collection activities. Thank you.
