Zoom Motors has been in business for over years now and in that time period, we have sold over cars each yearSome of the cars are bought in cash and some get purchased in financeWhen it comes to financing, some
deals get to be categorized as prime financing and some get categorized as subprimeSubprime loans are for those with higher risk creditthose who have had repossessions, bankruptcies or foreclosures in the past, are the kind of buyers whom fall under subprime lendingWe also have A,B,C or D tiers that are the subcategories under subprime lendingWhen it comes to banks, each one has its own policySome who won't even deal with those who have repossession in the past, some which will still accept the person with challenged credit and repossession A few are taking the last portion of the buyers who are declined by every other place, burned all the bridges behind them in the past and have nowhere else to go and help them to get a loanOf course, when it comes down to the last category of customers, the banks who are willing to grant any loan, aren't just going to hand the loan to the client hoping that it is going to get paid offWhat if the customer takes the car and never pays it as agreed? In fact what if they take the car and end up paying no payments at all?
The answer is very simpleBanks don't care about the risk, as long as someone is willing to guarantee the first payment in some cases up to first payments or stand behind the payment default
As a selling dealer of a car or a truck, each dealer is responsible to guarantee the first payments to the bank, up to a certain number of paymentsIf customer didn't pay then the buyback law applies to the dealThe selling dealer of the vehicle is then responsible to buy back the sales contract from the finance company, repo the vehicle, and pay off the loanAs a result, the vehicle is repossessed
In this case, since us, Zoom Motors is backing up the contract, we have no choice but to announce that the finance company have made us to buy the loan back otherwise we would have to end up with them in the court of law which will end up losing doing business with this bank in the futureNot to mention paying fines and ending up eventually in buying this vehicle backSince we are not the finance company and we are the selling dealer of the vehicle only, we have no choice but to repossess the vehicle
We have given the customer enough time to come up with the balance due on the loan plus whatever the additional repossession fee areWe are still waiting for the customer to respond to our request and we have no intention of keeping the vehicle as long as the balance is being delivered by a certain date
We are unhappy to announce that if the vehicle is not paid off by a certain date, it will end up being sold to a third partyPlease advise the client about all her rights as we did the same
The vehicle will stay at a storage facility and every day that passes by, fees will go higher and higherPlease have your customer to bring her balance due and pick her vehicle upOur intention is to keep everyone happy but unfortunately, that's hard
We tried helping the customer by offering her vehicle back, her paying the balance due but she didn't not want to co-operatePlease tell her (*** * ***) that it is still not too late if she really wants to pay it off
Just mail a check to Zoom Motors for the balance due and we will release the vehicle
Attached, there is a copy of the original notice of Westlake financial Corp as the lending institution on this purchasePlease review for further investigationWe are happy to announce that Zoom Motors has a zero tolerance policy on late payments

Zoom Motors denies any wrongdoing in the sale of the 2005 [redacted] F 250 Super Duty pickup truck (“Vehicle”) to Mr. [redacted].
Your clients allege that; 1) the vehicle was misrepresented as having been mechanically inspected and that it was not, 2) the vehicle had a blown cylinder head 3) the vehicle had an oil leak.
The Buyer’s Guide also advised your clients that they were entitled to conduct a pre-sale inspection of the Vehicle either on the lot or off but they chose not to.
Pursuant to California Civil Code Section 1792 et. seq., a vehicle may be sold without warranty if the consumer is notified that no warranty is available.
We have purchased a [redacted] report of the vehicle.   The report shows that the Vehicle was a one-owner truck and that on December 18th, 2015, it was inspected and serviced at [redacted], CA.  The service record indicates that the cooling system was checked, the fuel injection system was serviced, and at the end, dealer suggested the power steering hoses to be checked.  I personally confirmed this information with Future [redacted].  Total miles on the Vehicle at the time of service was 146,945. at this time vehicle was taken in to a local shop for further repair at the dealerships desire. no one can tell anyone where to repair their own vehicle and at this point, dealer "Zoom Motors" chose to have [redacted] look in to the power steering issue. at this point vehicle got checked, inspected, issue was taken care of and at the end vehicle passed smog and safety with the flying color.
There was no breach of contract.  ZOOM sold the [redacted]s a 2005 F250 6.0L diesel truck.  The price and terms were freely negotiated and agreed to by the parties.
There was No Blown Engine at the time of the purchase since Zoom Had the vehicle inspected by Future [redacted] of Sacramento, CA prior to selling of 2005 [redacted] F-250.
The Existence of the Sign in the office of Zoom Motors Saying "everything sold as is [redacted] sold Extremely as is" is a fact and pictures been taken by previous customers as well. we do have live cameras to prove that the sign existed at the time of the purchase.
The suspected damage to the Vehicle is unfortunate.  However, a buyer is charged with properly inspecting a vehicle prior to purchasing a motor vehicle, especially one driven more than 146,000 miles.  Buyers are also charged with reading their contracts and Buyers guide.
Zoom at this point is not trying to blame the customer for the bad condition of the trade but instead strongly believes that it was a fair deal overall for Mr. [redacted] since customer definitely knew the existing condition of his daily driver. At Zoom motors vehicles get inspected by a third party mechanic such as Cooks auto repair, then they get to be taken to franchise dealers for any specialty diagnoses. in this case this was one of the vehicles that was taken to [redacted] dealership for work and there was no sign of a blown engine prior to the sale of the vehicle.
Summary:
Buyers are also charged with reading their contracts and buyers guide, both of which in this case are As Is.
Your client have been highly advised to have the vehicle brought in so that we can have [redacted] inspect it and for one reason or another Mr [redacted] have denied our request.
Zoom Motors can only do so much as to in order for providing a better customer service and the rest depends on the client itself. in this case Zoom Motors believes that our employees have done what they could in order to help out this client and the client just refused to co-operate at the point of the first complaint.

Thanks.

I am rejecting this response because: First of all, the trade in I brought had the spark plugs replaced at a [redacted] dealership one week prior to trade in. At this time I was advised of a knocking sound and informed by [redacted] that it is possibly the cam phasers. The truck ran with no problems for a week with "a blown engine" as Zoom states. I do not claim to be an expert in autos and simply relayed information I was given. Zoom states "knowing it had a blown engine" and I "swear to God" that it was a timing issue. I don't swear to anyone and never did. Again, I'm not a mechanic and was only relaying information. Zoom claims "failed inspection" with a "blown motor" prior to the trade in offer. The truck never left the parking space I parked in on arrival at Zoom. The alleged inspection consisted of running the engine and listening for approx. 5 minutes. Never driven and no hands on the motor. The trade in is not my issue with Zoom however.
Zoom also stats the price of the purchased truck was marked down to meet my satisfaction. The list price was $17,900 and they sold it for just over $19,000. Not sure how that is a significant mark down. Additionally, Zoom should re-read the complaint before making completely unproffessional and insulting statements such as "the power steering repair does not cost 4-5 thousand dollars in repairs even a 5 year old kid will know that…" I calculate life saving medication doses in split seconds for a living and am confident in my math skills thank you. I was referring to the oil leak you sold me the truck with coming from between the engine block and oil pan. Again, re-read the complaint. I have the estimate of four to five thousand dollars, JUST IN LABOR, to repair this. I also have the invoice from Folsom [redacted] where you declined repair of the power steering leak. As for warranty, I asked for one and [redacted] stated "we don't offer ANY warranties, but you can pay to bring it back in two days." Yes, you offered to "look at the truck" with no guarentee to fix anything and no, that was not a satisfactory offer.
Lastly, when dealing with [redacted] and asking questions about the truck he was stating "it's a solid great truck with only one owner. You will not have problems after our inspection. It is diesel and wil last a long time." Now you just gave evidence of your dishonesty by contradicting yourself in your Revdex.com response when you stated "one must know not to buy a [redacted]" and "Fords are sold super as is." I don't recall seeing a "super as is" sign. Your unproffessionalism is demonstrated even further when you state "this customer did not pass the attitude test." Why? Because I am standing up for my consumer rights? Since the purchase I have found numerous sites full of complaints against Zoom and I am not the first one with the Revdex.com in the short time Zoom has been in business. My regret is not researching them prior to my purchase. I am left with a $19,000+ truck in need of $5,000 in repair. I will continue to pursue Zoom Motors with legal representation. The diagnosis of a blown engine by listening and dishonesty during the sale of the F250 leaves me no reason to trust them.

We really don't understand what this customer is trying to establish here although the vehicle was sold to him as Is and he had signed additional forms and statement of facts regarding the condition of the truck...

and the way it was sold to him at the time of purchase however there are always two side to every story and it is good to hear both side.

this customer brought in a trade on the day of purchase in it's most poor condition knowing it has a blown engine and it also failed our inspection at the time however we agreed to take his word for it and take the vehicle in and paid him above and beyond of what the vehicle was worth with blown engine not to mention that he swears to god that there is only a 500.00 dollars repair issue with the timing system on the vehicle that causes the knocking noise turned out it had blown lower unit of the engine later on that week. this is the condition of his trade in. at this point zoom motors offered him 2 more thousands of dollars on the trade above what we usually offer for any other car within that condition at the time of trade just to keep him happy.

the vehicle he purchased was discounted significantly to gain his satisfaction although it could potentially sell at a lot higher price on a different day with more profit. at the time of the sale, he asked for any work that may have been done while the vehicle is in dealers hand prior to the sale of the selling vehicle which in this case we are referring to the 2005 ford f250. on our wall we have a sign saying, "Everything is sold As Is and fords are sold super As Is." one must know not to buy ford after this must negative talk about the brand. we offered him warranty and he had declined the warranty at the time of the sale signed by him at the bottom of California legal form of " California vehicle product sales disclosure" . the vehicle had no issue with any leak because during the process of the sale, we clearly as we have it on the wall of our office, also state that customers more than welcome to have the vehicle inspected by the third party company as they wish for. obviously he bought the vehicle because he felt that the vehicle passed his inspection otherwise why would you buy it. we sale everything "AS IS." even our [redacted] is being sold AS IS. not because there is anything wrong with them, only simply because we want our customers to have the choice of making their own decision by really getting the vehicle checked out.

his trade was a ford which was problematic, he bought a ford that he thinks might have problems.

with all of that being said, soon as we heard the complaint all all the criticism of how wrong of a practice we do and how much of a fraud business we do, we still offered him help. we even said to take the vehicle to Cooks Auto Repair and have them check it in under his name because after the sale, legally we cannot touch customers vehicle as the BAR recommends.

the last email that was sent to this client clearly indicate how much effort we were willing to put in it in order to make this good. we have clearly offered to help but customers response was " No I Don't Trust You Guys"

also, we have noticed in pictures that were taken by the customer, those electrical tapes refereed to as are for a different component on the vehicle.

we have clearly indicated in our email to our client that it is not to late still. please let us know if you want us to have cooks auto repair to schedule a time for you to stop by. we did not refuse giving our client service after the sale however, in fact he simply  denied to accept our service and jumped the gun instead and filed a complaint with Revdex.com.

-this customer did not pass the attitude test to begin with therefore one would say not to offer him any service since the vehicle was sold AS IS.

-the was no power steering issue with the vehicle at the time of the purchase otherwise he wouldn't be able to get out of the lot or even test drive it.

-no power steering pump high pressure line can be fixed by electrical tape which customer have mentioned in his emails demonstrated with pictures. we have explained to the client that hole in power steering pump or line, due to the high pressure will not be cured with an electrical tape therefore it would have leaked all over.

-the power steering repair does not cost 4-5 thousand dollars in repair even a 5 year old kid will know that so lets not make a bid deal out of it.

-we don't belong to Revdex.com however we are making any effort to respond to you guises request.

-in the future we will make sure this whole as is process explained to customers in more advanced way to help customers better understand what AS IS means.

- we also have copies of all emails and offers submitted to this customer for review.

please fell free to email anytime.

Thanks,

Review: I purchased a 2005 F250 pick up truck from Zoom Motors Feb. 24, 2016 for just over $19,000 after tax & fees. I traded in a 2007 F150 as down payment that was just serviced at a Ford dealership. Zoom provided a car fax report, but stated they ([redacted]) would mail additional maintenance records. They stated the truck had no issues and had passed their inspection. Two days after the purchase, I noticed oil dripping from the bell housing. I contacted Folsom Ford after my own investigation as they were the last documented service. They provided an invoice that shows informed Zoom of a power steering leak that they did not have repaired. Zoom stated I bought "as is" and they would "look at it, but does not mean we will pay for repairs." I had the oil leak evaluated today, 3/09, and was informed it "has old oil all over the engine that has been leaking from the engine block for some time." I was told it will cost 4-5 thousand dollars "just for the labor" to repair. I believe Zoom was aware of this if they did a "safety inspection" as they said they did and willfully and knowingly sold the truck in poor condition. I also believe a leaking power steering hose is a safety issue that should have been addressed in Zoom's "safety inspection." My documentation from [redacted] states on it that the technician would not "test drive" due to the safety risk.Desired Settlement: I will provide a written estimate for repairs and would like Zoom to either A) pay for the repair from the shop of my choice as I do not believe Zoom Motors to be a credible repair or sales facility, or B) credit the cost of repairs to my auto loan. I have obtained legal representation as well and will pursue Zoom Motors in accordance to the consumer protection laws of California if no satisfactory resolution is reached.

Review: I took the truck back on 2/27/15 at 9:30 am to be worked on by 10:30 am no one was here by 11:00 am the sales man [redacted] showed up. I then stated to him I did not want the truck he asked me for my paper work at that time I told him where was his by then I was so upset I gave him mine. He pulled out a pink one and stated that this paper I signed says I could not return it.

I left leaving the truck which he had never returned my paper work. On 2/28/15 my friend drove me back, when I got home he said I had to take the truck and that I had to bring it back for the repairs & I could not return it, by then I was very upset, I went back 4 more times putting gas and traveling back fourth he started to order the parts & to this day I still have not received the lock to bed where the spare is & again he stated I could not return the vehicle "truck". On 3/10/15 it lost power the engine light came on the a reading that said engine power reduced.

I called him again he stated I could not return it This was the sales man [redacted] that sold me the truck. He said it was warranted in which I had payed for on 2/26/15 $2000.00 from [redacted], at this time I was again put off as I feel they should of fixed it. he told me to take it to the nearest chevy dealer which was shellworth in Vacaville.

He did the diagnostic and said it was the throttle body & water pump, So I told them to fix it as I had full coverage with [redacted] Warranty Services. When he called [redacted] they said it was cancelled So I drove up to the dealer in Sacramento, CA again as they would not return my calls. They [redacted] & the owner said they would fix the paper work which had still not been sent into [redacted].

I had the truck fixed the next day 3/11/15. I called [redacted] they said they called the dealer for the paper work which they had not received yet. I had to pay out of pocket $1571.03.

2 days later I got a call from [redacted] saying they got the paper work & that they were only gonna pay for part of the water pump & send me a check for that part after they went over the bill. I told [redacted] he said that I the owner was responsible for the rest and I drove to Sacramento again.

When I got there I was hot, but kept my cool I told him he kept my paper work. When he gave them back is when I read the "Contract Cancellation Opting Agreement." At the time of the signing he was just telling me sign not a problem. I am a 67 year old man vietnam vet have had tia which are small heart attacks, I don't need this stress & and anybody that was in there right mind would not decline the cancellation option & today 3-16-15 had to buy a batter $107.00

Thank you Rueben WerickDesired Settlement: RESOLUTION: I feel they should take the truck back and pay me all monies I have put out. I took it back within 12 hours & I would of been in my right mind, there is no way I would have signed decline option that was dumb on my part.

Review: On January 20,2014 I called the dealership Zoom Motors in which a dealer by the name of [redacted] answered the call. I inquired about the car, stated he had it on the lot and would help me get financed. This day being a monday I was able to keep open communication with him through out the week. During this time we discussed my credit and my deposit come friday we were set to pick up the vehicle ( 2hrs away for me). I arrived in sacramento on saturday January 25, 2014 In which I met with [redacted] and another man called [redacted], after a few hrs of negotiating the price, we came with an agreement we all liked and signed the contract. I gave them $5000.00 cash down payment and walked out keys in hand with a $5000.00 loan. Fast Forward to March 13th 2014, 48 days later a repo man shows up in my front door demanding I turn in the keys to car because the dealership has put out a repossession and I had no owner ship of it. Mind you not even 16 days before I had made a payment for this same car to WestLake Financial Bank where I was financed. Of course this being after hours no one was opened, not the dealership nor the bank so like anyone I turned over the keys and waited til the morning to call the bank that had me financed. When morning arrived, I called the bank and after I verified that everything was still standing, I called the dealership. I called [redacted] which he was out of the office, but [redacted] was there, but to no use he had no answers for me and ask me to call back that [redacted] would be in at 4:30pm. I waited til around 3:30, when I decided to call the bank again. This time my conversation went a little different, the agent on the line informed me that I no longer had a loan with them because as of 1:30pm that day the dealership had payed off my loan. I called the zoom motors back spoke with [redacted] and after being rude he said I had to come up with 5000.00 balance or lose out on the car and my deposit.Desired Settlement: I would like my deposit back he failed to provided me with financing. The bank rejected my loan with out my knowledge, per contract that we both signed he has to refund my deposit.

Zoom Motors has been in business for over 3 years now and in that time period, we have sold over 500 cars each year. Some of the cars are bought in cash and some get purchased in finance. When it comes to financing, some deals get to be categorized as prime financing and some get categorized as subprime. Subprime loans are for those with higher risk credit. those who have had repossessions, bankruptcies or foreclosures in the past, are the kind of buyers whom fall under subprime lending. We also have A,B,C or D tiers that are the subcategories under subprime lending. When it comes to banks, each one has its own policy. Some who won't even deal with those who have repossession in the past, some which will still accept the person with challenged credit and repossession. A few are taking the last portion of the buyers who are declined by every other place, burned all the bridges behind them in the past and have nowhere else to go and help them to get a loan. Of course, when it comes down to the last category of customers, the banks who are willing to grant any loan, aren't just going to hand the loan to the client hoping that it is going to get paid off. What if the customer takes the car and never pays it as agreed? In fact what if they take the car and end up paying no payments at all?
