I am rejecting this response because: I am rejecting this response because: I am providing documentation of the 24-month warranty provided to me by Asphalt The owner sent you an incorrect invoice with incorrect warranty information on it After I received the initial bid from Asphalt, I only agreed to the repair if it came with a 2-year warranty The owner agreed and provided me the documentation of said warranty (attached) In addition, I am providing to photos of the driveway The first photo (3724) is a photo that depicts the asphalt to concrete transition located by my barn The owner assured me prior to construction that the transition would be smooth enough to allow for sufficient drainage As clearly shown in the photo, the asphalt is too high and does not allow for the drainage This area now collects water and such to the point that during heavy rains, the water now backs up into the barn The owner came out and agreed that the area was too high and committed to installing a drain to allow for the water flow He has failed to do so even after repeated promises to come out and do the installation The second photo (3743) is the gravel collection from the raveling that is occurring While the owner maintains this is light and normal, I continue to have excessive gravel due to the raveling According the professional engineer who came out to evaluate the driveway, the raveling is in fact excessive and is due to the improper sealing of the asphalt After speaking with the engineer, himself, the owner agreed to come out and seal coat the driveway This action was promised to be completed no later than June, It still has not happened Incidentally, I find the accusation that the engineer and I are “drinking buddies” to be, not only ridiculous, but absolutely false The engineer is a licensed professional engineer in the State of Texas who has many years of experience in infrastructure construction and maintenance In addition, I do not consume any type of alcohol at all in my own personal life, so to infer that I do is ludicrous The owner’s accusation in the statement, “a beer drinking buddy of his” was said or implied by me is untrue and derogatory in nature Addressing the comments that the owner provided that he had been out there to rectify the issue “several times” is also false While I fully understand that the warranty does not cover vegetation growth, the issue of the vegetation is not the growth but rather the failing to properly prep the road base prior to the pour Protocol would call for a ground clear chemical to be spread prior to new asphalt being laid In our case, the company knew that they would be laying new areas of asphalt that already had some grass growing through the road base The owner came out and agreed that the area should have been treated first, then treated the growth himself The substance that he spread did not alleviate the problem, in fact, more vegetation began to make its way through the asphalt It was then that I made the decision to treat it myself I clearly waited ample time for his treatment to work, it just simply did not The owner also came out to look at the drainage issues that I had and actually marked an area of the driveway that needed to be addressed(see picture 3744) As you can see by the faded orange paint, the marking has been there for several months now but yet the area has not been repaired He has told me time and time again that he runs a reputable company and would take care of it This has been ongoing since July of well over a year Finally, the owner argues that he was treated rudely by my wife I do not believe he was and will defend her However, even if she had, again which I do not believe, it does not negate the 24-month warranty that was provided by Asphalt or release them from their obligation, nor does it negate the need for the company to stand behind their work and resolve the issues at hand immediately Again, I am simply asking Asphalt to return and complete the drain work and seal coating that has already been committed and promised by the owner of the company Regards,*** ***

I am rejecting this response because:I do not feel that I have been unreasonable in any wayI have been trying to get this resolved since last July, on SeptMr*** said he would have this done by SeptIt is now Octand still nothing is done.Mr*** contacted me on Monday Oct to schedule the work for Friday OctMr*** stated that he will start the process of repairing the driveway "yet again" so far all he has done is paint lines and boxes on the driveway where he thinks repairs are requiredMr*** also stated that if I respond to this e mail he is "not going to respond back"I don't expect a response , in fact I don't expect much of anything from him. If he shows up and the driveway is done to my satisfaction I will be very surprised

We have already went above and beyond to rectify the situation There is nothing that we can do or are willing to do, that is going to make the customer happy This customer is on satisfiableWe have already been out there four or five times- m

The customer was given a month warrantyNot yearsAnd One that clearly states we do not cover vegetation growth or drainage less than 1.5% we went above and beyond the warranty and Applied vegetation killer but the customer did not give the vegetation control time to work Instead he
used something of his own then claimed it down the jobWe came out several times to try to make the customer 100% satisfied with the work But every time we came out we were met with very rude peopleOne time we came to place a drain in the driveway but had to leave because of the harsh treatment of Mrs***As far as the raveling it is very light and wear for an asphalt drivewayThe engineer he claims to have hired is "a beer drinking buddy of his" his words and not mineJudging by his statement I believe his engineer is biasAt this time we feel we have done all we can and are prepared to do

Mr. [redacted] is being very unreasonable.  He called me a couple of weeks ago to tell me not to come out, that he was going to be out of town and he had to cancel.  I told him that the day he was coming back from his trip I was leaving on mine,  I'm currently on a large project in San Angelo.  I explained to him then that my crew was going to be out of town for approximately two weeks,  but he still needed to cancel. because Mr. [redacted] is terrified that you're going to close the case file he wants to keep responding or posting to this file.  Under the false assumption that, that is going to get me out there quicker. We've been over this many times.  So like I told him and like he and I agreed two weeks ago. when I get back into town I'm going to start the process of repairing his driveway yet again. I would like Mr. [redacted] to publicly know that he does not have me over a barrel and stop pretending that he does. And I did call Mr. [redacted] on the telephone he did not answer,  I did receive a call back from Mr. [redacted] but I missed his call. We already agreed that when I got back to Fort Worth I would call him.  So if Mr. [redacted] responds to this, which I'm sure he will, I'm not going to respond back.  my next response will be once I have made contact and rescheduled with Mr. [redacted] and outlined the repairs to be made. [redacted]

we came out on 9-14-16 and what we found, was not what we discussed on the phone. There for the repairs or more  extensive than previously thought.  Putting the completion date past 9-15-16  like I said previously we painted around the areas to be replaced with hot asphalt and sprayed for vegetation Growth. While we were there we knocked on the door and call your phone but no one answered either so I assumed that you were not home. But when I came by this morning 9-28-16 I noticed the vegetation growth is still present. The reason for this I can only speculate, must've been rain before the chemical had a chance to do its job. Therefore I have my crew coming out tomorrow 9-29-16  to spray again. There will be another waiting period, because if we try to repair the asphalt without killing the vegetation we will be defeating the purpose of repair. Please be patient we are doing everything in our power to rectify the situation.

I will call you to reschedule.

On 9/14/16 we came to assess the damage, mr [redacted] was not home. I marked off the areas to be repaired with a line marker, and we sprayed to eliminate the vegetation Growth, then I called mr [redacted] and left a message explaining how we were going to fix the driveway. He called me back and we went over it again. His driveway has vegetation growth that will first need to be addressed before we can do the repairs. As much as I would like to just get it done, I also want to do it right. so that we have no more issues down the road. I have my crew scheduled to go back on the 28th of September to burn off the dead vegetation. Then we will proceed with the repairs. It is our #1 priority to achieve customer satisfaction with all our customers but sometimes it takes a little time. All I can do is ask for mr [redacted] to be patient, we are doing all we can.  At this time.  [redacted] 817-asphalt

Number one they spent a whole year giving me excuses why they could not come repair or replace the lousy job they did. They put the asphalt down 7/27/16 and I contacted them approximately one month later letting them know that it was falling apart. I contacted them at least 4 more time and they never sent anyone out to look or repair. So, it was not out of warranty til the 27th. and he refused to do anything, this is when I contacted the Revdex.com to try and get some satisfaction.

I am rejecting this response because:  The company continues to state that there is nothing more that they can do, however, they have committed in writing to rectify the issue at hand.  I am extremely disappointed in the response of the company's owner.  Without question, they have purposefully deceived me and are quite possibly in violation of the deceptive business practices statutes for the State of Texas.  The issue is that they have come out on a couple of occasions, promising a repair, and then standing around for 8 hours rather than performing any work.  During this time, the foreman for the job described how they were going to repair the driveway and then proceeded to take equipment off of their truck.  Then, they did absolutely nothing at all.  The solution is simple.  I want the company to stand by their word and their warranty and come out to finish the repairs as promised.  This matter is not resolved regardless of the stance the owner of the company may choose to take.  I will follow up with the engineer report within the next few days and will continue to pursue this matter until it is satisfactorily resolved.
