I am rejecting this response because:It is very clear that I never attended this University and the fact that could not get a copy of the cancelled check should be more then reason to clear my nameAlso there telling me to go after *** *** University to collect money that they claim was deposited to them for cl;as that I never attendedTo force me to pay for a loan I never took out nor attended that school is unfair to me too be subjected to being forced to pay for this loanUnder the fair credit act I,m sure they have to be 100% sure the loan is mine and I owe itOnce again Ive got a letter from the University that makes it very clear Ive never went to there School nor taken any classes at anytime in there UniversityAlso if they are claiming that *** *** received this money then they should be going after the University not meAlso there has to be a statue of limitation on this as well, where talking about plus years ago. *** ***

a student loan If they say that *** *** has signed a loan with my social security I want to see evidence of this before I proceed with an identlty theft complaint and costly procedure when I don't even have evidence of it I want to see a written contract where the supposed *** *** signed a student loan with my social security so that I can proceed accordingly. Thank you so much for your valuable assistance

I am rejecting this response because:

Response to consumers rejection of initial response is attached

On September 4, 2016, Educational Credit Management Corporation (ECMC) responded timely to your complaint filed with the Revdex.com on August 25, 2016. You indicated you did not accept the response and your new inquiry was forwarded to ECMC September 6, You again expressed the same concerns and continue to claim you are not responsible for this debtPlease refer to ECMC September 4, responseECMC maintains its position that you are responsible for this debt and must address the issue with *** University due to the following: *** University certified your attendance on the loan documentsStudent loan funds were disbursed to pay education expenses while attending *** UniversityECMC has no control over another agency’s record retention policiesThis includes banks and colleges. Until ECMC receives documentation you are not responsible for this debt, ECMC’s position is you are liable for repayment*** University’s letter dated August 1, contradicts their certification on student loan documents, and therefore does not provide proof the funds were not disbursed to either *** University or yourselfRegarding your concerns about the statute of limitations, there is no statute of limitations for collections on a defaulted student loan debtFor information on the statute of limitations for student loan collections you may refer to the Higher Education Technical Amendment of 1991, HR(Public Law 102-26) signed on April 9,

I am rejecting this response because: it does not state that they will remove the inaccurate item from my credit file with the major credit bureaus. The loan service provider prior to ECMC failed to process my request for forbearance which resulted in a credit default. I was in good faith and since I was unemployed, I repeatedly asked for ways to defer my student loans. ECMC is required by law to furnish proof and report with 100% accuracy. If they cannot, then they must remove the item from my credit file. Looking forward to a fair resolution in this matter.

This is in response to your complaint filed with the Revdex.com on April 4, 2016, concerning your student loans guaranteed by Educational Credit Management Corporation (ECMC). As a result of the complaint, Laurie [redacted], ECMC Research Resolution Specialist, contacted you on April 6, 2016...

to discuss your concerns.  ECMC records reflect you successfully completed a rehabilitation on January 29, 2016. As a result on February 7, 2016, ECMC submitted a request to the national credit bureaus to delete our tradeline.  ECMC has no control over and is not responsible for how long it takes the consumer reporting agencies to update the account.  At your request, Laurie mailed and emailed you a copy of the Rehabilitation completion letter originally mailed to you February 8, 2016.  In order to assist you, ECMC has again submitted a request to the national credit bureaus to delete the ECMC tradeline.  We did this using their on-line eOscar system.  Should you require additional assistance or have further questions, please do not hesitate to contact Laurie at ###-###-####.

Initial Business Response /* (1000, 5, 2015/06/18) */
On May 13, 2015 you filed a complaint with the Revdex.com (Revdex.com) regarding your federal loans guaranteed by Educational Credit Management Corporation (ECMC). ECMC does not believe this complaint pertains to any loans previously held...

by ECMC as our records indicate [redacted] is the current holder of your loans. For information regarding your account please contact [redacted] at X-XXX-XXX-XXXX.
Based on your complaint, you stated ECMC has refused to look into your claim of falsified Ability to Benefit (ATB) scores. On April 4, 2012, ECMC received your loan discharge application based on False Certification due to ATB. ECMC sent a response dated May 8, 2012, which stated your application was denied based on information provided by the school. Attached is a copy of the letter and a CPAT Student Score Report reflecting you took and passed the required ATB test at Everest College.
You exercised your right to appeal ECMC's decision with the Department of Education (ED). Attached is a copy of ED's response dated December 26, 2012 which upheld ECMC's determination to deny your application. On April 4, 2015, ECMC received an email from you requesting a loan discharge based on False Certification due to ATB. ECMC responded to your inquiry on June 2, 2015 which explained your loans did not meet ED's criteria for discharge based on False Certification due to ATB. For your convenience a copy of the letter is attached.
Please feel free to contact [redacted] ECMC Research Resolution Specialist at XXX-XXX-XXXX if you have questions regarding the information provided.

The school falcified everything I did not take any test to enter the program the school has been accused of a lot of fraudulent acitivities but ECMC refuses to look into it and just denied me because they submitted a dsocument that doesnt have my signature or can they prove I took this test. ECMC is there protect us the victums but they refuse too they are doing everything the opposite. I am a victum and ECMC refuses to look into it I want copies showing that it was me so signed everything and that it was me taking those test. At the time spanish was my first language so they took advantage of my situation
