Hi [redacted] ,We have received your complaint and have reviewed your accountThis account was sent to us for collection by the creditor in August and has been due since December Three payments have been made to the account since the balance was incurred over four years ago, through a payment plan you set up with us in October The collection supervisor contacted you to inform you that the payments had been declined for the past several monthsYou advised him that your bank account information had changedHe asked you to reset your payment plan with new payment information but you told him that you could not.Our representatives are trained to ask questions regarding income and expenses to try to figure out the consumer's ability and willingness to resolve the balance owed so that we may determine how to proceed, as well as provide assistance in budgeting and planning when requestedOur records indicate that you told the supervisor you couldn't make any more payments to the balance you owed because you sold your business and you were currently spending all of your money to start a new businessHe did question this, as only payments had been made in over years and the remaining balance owed is substantialHe pointed out that as a business owner you might not be happy if someone didn't pay a bill that was owed to you in favor of spending the money elsewhere, and it would be best to try to set up a minimal payment plan rather than no payment planOur records indicate that you became very upset and told him he was rude and his comments were inappropriateWe do understand that asking questions about someone's financial situation is a very personal matter and can often cause strong emotionsWe train our representatives to discuss income and expenses because it often results in our being able to better assist both the creditor and the consumerFor example, if a consumer were going through a temporary hardship and the creditor asked us to pursue litigation we would be able to counsel the creditor against it if we knew the situation was temporary and the balance would be resolved after the hardship passedWe have been able to assist many consumers in working out a long term plan and help both consumers and creditors avoid the unnecessary expense and stress of legal action with our policy of questions and discussion.Please be advised that our office will not contact you again regarding this accountYou may contact our office to discuss this account at any timeOur business hours are 8am-9pm Monday through Thursday and 8am-5pm on Friday and Saturday.Best regards,Absolute Credit LLC

Hi ***,We understand this is a difficult situation for you as it involved an accident and you have had to deal with hospitals, attorneys and a collection agencyWe did receive a voicemail message from you yesterday in which you stated you needed a call back or you would file a complaint, we tried to call back and then we received this complaint through the Revdex.com so we are responding through this methodOur records reflect that we communicated with you regarding this matter in March 2013, and we were directed to your attorneyWe contacted their office to discuss the matter and they advised this was an accident claim and they would send a check when the settlement came throughWe put your account on hold and were subsequently contacted by the hospital in June The hospital told us they were going waive this balance as charity careThe hospital then contacted us again a couple weeks later and advised that as it was an accident claim they could not waive the balance, and that we should keep the account in collectionsWe kept the account on hold (no contact) from June through this week.We have not received any further communication from you or your attorney in the past two years, and the hospital has not notified us of any payment received on this accountWe were given authority to offer 50% settlements on older balances for this hospital last week and we identified your account as one that might be interested in this offerWe placed one phone call to you yesterday morning to give you the good news about the settlement the hospital is offeringThe call was made by our collection manager on an open floor with his collection staff in close proximityOur records reflect that the call lasted less than two minutes and that you told him the balance was covered by free careHe tried to tell you what the hospital told us in 2013, and was going to tell you about the settlement offer which was the reason for our first call to you in almost years but you hung up on him too quicklyHe was genuinely surprised that a complaint was lodged against us based on this communicationIf you feel that this was handled by your attorney as you state in your complaint above, please contact their office to see what happenedWe will contact the hospital to ensure that they did not receive a payment that was not reported to our officeAt this point in time, based on the contact history and your complaint, we will not contact you again but you may feel free to contact our office to resolve this account.Best Regards,Absolute Credit LLC

Then was the discussion of that it wasn't covered by freecare cuz it was an accident! Then I said, in that case that he needed to talk to my fn lawyerHe proceeded with "Then pay your fn bills!" Then I told him to ""Fk off!" and THEN hung up on this ignorant bill collector! The phone call should have NEVER been made to me, but you should have contacted my lawyer as you were advised before! Hi [redacted],We have received your complaint and reviewed your file. Our records show that the account was sent to us by the creditor in both names; the phone number provided by their office was your cell phone number. We mailed letters to you when the account was sent to us and the letters were not...

returned to our office as undeliverable. We tried contacting you by phone numerous times throughout 2011 but we never received a response from you. The account was flagged for credit reporting in May 2012. In January 2015 you disputed the account through the EOSCAR dispute system and stated the account did not belong to you. We verified the information sent to us by the creditor and responded that all information was accurate. You disputed the account again in February 2015, so we reached out to the creditor for any additional information they had regarding this account. They sent us the statements along with copies of their system notes showing conversations they had with you in August 2010, September 2010 and January 2011. Their notes reflected in August 2010 that [redacted] was no longer living there but that you were responsible for the household bills. We mailed copies of the supporting documentation and system notes to your new address on 2/10/15. Our records do reflect that you mailed us a copy of your divorce decree in March 2015, but that document did not speak to the party that was responsible for the household bills or the timeframe for which the party would be responsible. We show that you did call our office on 6/9/15 and told our representative that the account was still on your credit even though you sent proof that it should not be on your credit. Our representative advised you of the records we had on your account and that the paperwork you sent to us did not prove that you were not responsible for this account. Please be advised that we do not own this account. We are not able to simply remove a name from an account unless the creditor tells us that there was an error and you are not responsible. Please contact the original creditor to discuss this matter. In the event they find that you are not the responsible party, they will contact our office and we would be able to remove the account from your credit file at that time.
