to call back and then we received this complaint through the Revdex.com so we are responding through this method. Our records reflect that we communicated with you regarding this matter in March 2013, and we were directed to your attorney. We contacted their office to discuss the matter and they advised this was an accident claim and they would send a check when the settlement came through. We put your account on hold and were subsequently contacted by the hospital in June 2013. The hospital told us they were going waive this balance as charity care. The hospital then contacted us again a couple weeks later and advised that as it was an accident claim they could not waive the balance, and that we should keep the account in collections. We kept the account on hold (no contact) from June 2013 through this week.We have not received any further communication from you or your attorney in the past two years, and the hospital has not notified us of any payment received on this account. We were given authority to offer 50% settlements on older balances for this hospital last week and we identified your account as one that might be interested in this offer. We placed one phone call to you yesterday morning to give you the good news about the settlement the hospital is offering. The call was made by our collection manager on an open floor with his collection staff in close proximity. Our records reflect that the call lasted less than two minutes and that you told him the balance was covered by free care. He tried to tell you what the hospital told us in 2013, and was going to tell you about the settlement offer which was the reason for our first call to you in almost 2 years but you hung up on him too quickly. He was genuinely surprised that a complaint was lodged against us based on this communication. If you feel that this was handled by your attorney as you state in your complaint above, please contact their office to see what happened. We will contact the hospital to ensure that they did not receive a payment that was not reported to our office. At this point in time, based on the contact history and your complaint, we will not contact you again but you may feel free to contact our office to resolve this account.Best Regards,Absolute Credit LLC

Hi [redacted],We have received your complaint and have reviewed your account. This account was sent to us in February 2015 and the initial letter was mailed to you on 2/25/15. The letter was not returned to our office as undeliverable. We left three messages for you in March, and spoke with you for the...

first time on 4/15/15. We did not receive a request to validate this account until 5/20/15, at which time you spoke with [redacted] and provided an alternate mailing address to which we could mail documents. You quoted the FDCPA section 809 in your complaint; please note that section 809 clearly states that the request for validation must occur within 30 days of the receipt of the initial letter and must be in a written form. We do try our best to work with everyone in a reasonable fashion, it is our policy to honor most verbal requests for validation received after the 30 day period has expired. We contacted our client within 10 days to ask them for supporting documentation on this account as per your verbal request. The paperwork was mailed to you on Monday of this week (6/1/15); based on your above complaint it is apparent that you had not yet received that paperwork. You should receive it within a few days if it has not already arrived. Please be advised that we will not contact you again regarding this account. yet been paid for the services they rendered to you. In situations such as this one the medical provider will often bill the patient for the higher uninsured rate. This provider does accept settlements on their accounts. A settlement in this situation would be approved for an amount closer to the amount of the insurance check than to the uninsured rate; in the event the balance remains unpaid they are within their rights to pursue the full uninsured rate on this account.Please contact our office to discuss this matter further. The balance was placed with us for collection on 12/23/14 (date opened with our company) and we mailed the initial letter to you on 12/24/14. The initial letter served as notification that your account had been...

sent to us for collection and contained information regarding the balance that had been placed with us. The letter also included the required mini-miranda and dispute/validation clauses as required by law. The initial letter was not returned to our office as undeliverable. We mailed the initial letter in 2014 to the same address that you have listed on this complaint. Our office also tried to reach you via telephone for almost a full year but our messages were never returned. We reported this account to [redacted] in March 2015, 3 months after the account had been placed with us and notification had been sent to you.We also received your dispute through the EOSCAR system on 9/13/16. We contacted the creditor immediately and requested full validation for this account. The documentation was provided to us on 9/21/16 and we mailed it to you the same day, at the same address listed in this complaint. As per my above-listed comments, our records support that your account was handled in accordance with all federal collection laws. As you have disputed the account, it will be reported as a disputed account to [redacted] with our next monthly data upload. Hi [redacted],You must have had a miscommunication with the FTC, as the allotted time for a business to respond to a dispute is definitely not 5 days. The credit bureaus must notify the CRA within 5 days that the account has been disputed, and then the CRA usually has 30 days to verify the information after receiving that notification. You must have also had a miscommunication with our front desk when you spoke with us in October; we did state that we would respond to you but did not specify that we would respond via telephone. Our normal procedure is to mail the supporting documentation after receiving the request or dispute, which we did on 11/10/16. We do not have a tracking number but we do have timestamped and tamper-proof internal records to support all actions taken by our office. Due to your assertion that you have not received this document from our office we have attached it to this response for your convenience, marked as "confidential," for the Revdex.com to forward to you with our response. If you have a recording of any employee of ours using vulgarity please send us a copy that we may take appropriate action. The owner of the company left you a voicemail message yesterday afternoon and did not receive a response from you. So here's the truth to the lies after that!  I did NOT hang up on him until AFTER he mentioned the 50% reduction in the bill! Then was the discussion of that it wasn't covered by freecare cuz it was an accident! Then I said, in that case that he needed to talk to my fn lawyer. He proceeded with "Then pay your fn bills!" Then I told him to ""Fk off!" and THEN hung up on this ignorant bill collector! The phone call should have NEVER been made to me, but you should have contacted my lawyer as you were advised before! Furthermore, I can not answer my phone EVERY aching second and there was NOOOOO voicemail left at all!Frustrating is saying it mildly, when to comes to Absolute Collections! You all were ignorant as hell to me before as well and I complained then to your company, with ZERO resolution NOR response! Then, even tho I cussed, he cusses back at me?? NOT ACCEPTABLE!!! Our records reflect that the first time we spoke with anyone concerning this account was in July 2016, we left a message on your voicemail and your wife returned our call. She told us that you were filing bankruptcy so we asked for...

your attorney's name and/or phone number in order to verify this information. We were not provided with the attorney’s information and we do not have your SSN on file therefore we were unable to verify that a bankruptcy had been filed. We have never been able to have a conversation with you regarding this matter and our messages have not been returned. We have never received any bankruptcy documentation that would verify a bankruptcy was filed or any indication that this account was included in a filed bankruptcy. In addition, our client [redacted] has not reported any receipt of bankruptcy paperwork in their office. It is possible that they received the paperwork recently and have not yet contacted us. We will reach out to them right away to see if they have recently received notification of your filing in the mail. We have definitely not called daily regarding this matter; our records reflect that we have made 8 phone calls to you since 6/21/16. We do not have any record of receiving a written cease & desist request on this account. In summation, we are unable to remove accounts from an active calling queue unless we have received verification that the account has been included in a filed bankruptcy or we have received a written cease & desist letter.
