The tow bill was paid directly by the insurance company. The $200 Admin fee was charged to [redacted] and they paid us directly.  I do not have any documents at this time due to we changed management systems and so of it did not merge correctly.

After reviewing what the customer replied with this is our response to the situation. When a vehicle is towed to our shop we do have the right to charge storage at $45 per day plus any other fee's that may occur. [redacted] did not try to back date the storage when talking to the adjustor he was the one that said we were shorting ourselves. The adjustor did pay for the storage which is normal and they would have paid the admin fee if at the time if  the adjustor knew she was going to go to another shop.  So I feel that as per our general procedures that the $200 admin fee as justified. We are though willing to do something since we want good customer relationships and feel that there was a miss understanding so what we propose is that when she want to she can drop off her vehicle and we will do a outer complete wash and then an interior detail complete vacuum and shampoo carpets for her for FREE this is usually a $200 -$250 cost just give us a few day heads up and we can schedule that and do it for her..

As per Mr. [redacted] saying he was not aware it seems really not true.  His vehicle was fixed prior to this recent accident by us and [redacted] was his insurance company at that time and they were aware of our posted rates and rates on our estimates. [redacted] did pay the $120 per hr and $150 for structural rates and the car was delivered by us to the customer house which is approx. 2 1/2 hrs. away we do this as a customer service.  This accident that Mr. [redacted] is now talking about is the same vehicle same type of damage just a little more involved. We picked up his vehicle from his home and repaired it and then returned it to his home.  He knew our rates and when I told his wife which I have a time dated and stamped for our records she replied don't worry about the rates my husband will take care of it with [redacted]. So we finished repairs and then delivered vehicle but the [redacted] did not pay our rates which is not our problem since the insurance is Mr. [redacted] and he is the only one that can give permission to work on his vehicle and he is responsible for all payments of repairs. We have a signed authorization form from him and I have attached a sample of the form and it states clearly that if the insurance does not pay that the customer pays and that they pay our rates look at form attached. I feel that Mr. [redacted] is playing the sympathy card and I am not pleased with that. We all have problems and struggles in life  and he just needs to pay his bill and he refuses to pay as agreed in the form he signed. I am tired of the rhetoric and putting he blame on us.  He has left us know choice that we may have to file legal action to get paid our monies that our owed to us. In closing we do an excellent job in repairs and we are certified by the manufacture and that is why our prices our different. For example there is Walmart prices and then there is Nordstrom's prices we are in the Nordstrom category Mr. [redacted] knew our prices before the second accident and he knew he was responsible for the bill.  We gave him over 200 days to get the bill resolved he choose not to go to court against his insurance company that his choice but the paper he signed says if he does not do that then he will pay the outstanding amount of he bill to us which he has not done at this time. We run a very ethical business and we try to take care of our customers needs. In this case we feel we have been more than fair and patient with Mr. [redacted] we know he has had some hardships but we gave him plenty of time to pay us or to take his insurance to court. I am disappointed that he thinks we have not treated him rightly we feel we have and I hope he will pay us in the future we also have bills, wages etc. that we are responsible for and families that work for us.  I hope he does the right thing and pay us soon.

I have reviewed this with the owner [redacted] and the situation is that when a vehicle gets towed in to our shop we charge for storage and admin fees if the vehicle is not repaired at our facility.  We charge this to the insurance company that is paying for the repairs.  The customer has the...

right to have there vehicle repaired at any [redacted] center they would want there vehicle fixed at.  In this case the insurance company was steering the customer from our shop to there so called preferred shop implying to the customer that the repairs would not be guaranteed unless they go there.  This is steering and against the law.  So when a vehicle gets steered or the customer has another shop to have repairs done we do charge a admn fee and storage and tow bill if not paid by the insurance company directly. Refer to house bill Colorado bill 1253 an insurer cannot intimidate or coerce an insured to use a certain shop.  The estimator/adjustor from the insurance company came to our facility to write the estimate and discuss repairs procedures with [redacted] this is part of the admin fee that we charge when a vehicle does not get repaired at our facility that has been towed to our shop. [redacted] also asked the customer if the other shop was going to save part of her deductible and she said none of his business.  There are shops that do that and it is insurance fraud by both the shop and customer. In conclusion we feel we correctly charged for our services and that the owner should take it up with her insurance company.
