Additionally, when we send out to the forms to upgrade the terminal based on the prospect changing their credit card processing to us, the forms all have our name and logo on them. To further disclose in the first paragraph of the free placement form we clearly tell the merchant that we are not their current credit card processing company.
I'm sorry the merchant felt misled and had a poor experience. Based on the nature of the complaint, I am willing to WAIVE the contractual obligation of the $395 early termination fee upon receipt of our terminal and a letter of cancellation.

I am rejecting this response because:  This is not true because the equipment and letter were sent in December.  I am not going to go back and forth when I can't seem to get a phone call from the company to rectify when I call in a timely manner.  I returned the equipment and cancellation letter in December and I am taking the proper steps to get this resolved. I have tried the last four months and I now have turned this over to proper authorities for both accounts that this has happened to.

We do not have a record of receiving the terminal until March. However, we will refund January-March, the full three months to satisfy the complaint if that will make her happy.

Additionally, when we send out to the forms to upgrade the terminal based on the prospect changing their credit card processing to us, the forms all have our name and logo on them. To further disclose in the first paragraph of the free placement form we clearly tell the merchant that we are not their current credit card processing company. I’m attaching the standard forms that were sent to [redacted] via fax. It’s very clear who we are so we are unsure of why she felt we were representing any company other than our own.
However, because of the merchants confusion, we are willing to waive the contractually agreed upon early terminal fee of $495 upon receipt of our terminal being returned to us. Please mail the machine back to;

Include a cancellation letter and note that we agreed to waive the termination fee. I'm also adding this information to the file to avoid any confusion.
