September 29, 2017To Whom It May Concern,Thank you for the opportunity to respond to this matter.In December 2016, *** *** requested to finance the premium for her *** *** *** (“***”) professional liability policy scheduled to renew on January 15, She signed and returned
the financing agreement, but we are unable to locate the check for the down payment and we have been unsuccessful in receiving a copy of the cancelled check from *** ***We did receive installment payments in February and March, but in April we determined that the two installments received were not sufficient to cover the down paymentThese were returned to her and the policy was placed in lapsed status*** *** continued to send installments each month; however, when we applied these to her policy, because we had no record of receiving the down payment, the policy continuously lapsed and these installments were refunded*** *** told us that she shredded all of our refund checks.After review of our records and the emails between Affinity and *** *** it was determined that there were miscommunications concerning her down paymentWe regret the confusionThe following are the options we will be providing to *** *** via a direct communication with her: (i) refund *** *** for the amount she requested of $2,944.13; or (ii) provide her coverage retroactive to January 15, 2017.We trust this resolves this matterShould you require further information, please contact the undersigned directly.Respectfully,Stephanie O

I am rejecting this response because:I was told by Ed O** that I would be receiving a refundI have yet to receive anythingWhen I called recently, I was told by Brittany, that as of 12/the company had yet to receive funds from *** ***According to the letter, *** approved the refund, so waht does *** *** have to do with the matterThat is in conflict with what this letter statesI feel that I am being given the run aroundMeanwhile, this unethical matter has cost me thousands of dollars, and an emotional and financial hardship that I will never likely recover fromI have been able to write insurance since 12-1-18, because I had no active E&O.It doesn't take this long to issue a refund, and they debited my card almost immediatelyI want a quick resolve to this situation, and my money (check) mailed to me, as promised, or I will be looking at some other alternatives.

needed for review of the claim being receivedUpon review of *** ***’s claim form, it was determined that additional medical documentation was required to enable us to make a claim determination and therefore, we requested such additional documentation from her physiciansWe have now received such information and have sent *** *** notice of the determination made on her claim.As per the information originally provided, *** *** cancelled her and her companion’s trip due to her pregnancyThe Plan *** *** and her companion purchased provides a reimbursement as a result of a trip cancellation in the event of certain risks, both non-medical and medicalOne such specified medical reason is a cancellation due to a SicknessSickness is defined in the Plan as follows:Sickness means an illness or disease of the body which: 1) requires examination and treatment by a Physician, and 2) commences while the plan is in effectAn illness or disease of the body which first manifests itself and then worsens or becomes acute prior to the effective date of this plan is not a Sickness as defined herein and is not covered by the plan.The Plan also contains specific exclusions to the eligibility for coverageOne such exclusion states the following:General Plan Exclusions In Parts A & B: We will not pay for any loss under the plan, caused by or incurred resulting from: pregnancy, except if hospitalized; or elective abortion;In order to determine that *** ***’s reason for cancellation fell under the plan’s terms and conditions, and was not restricted due to the plan exclusion noted above, we obtained additional medical records from *** ***’s physicians.From the information received from *** ***’s physicians, there was no indication that *** *** was suffering from a Sickness, as defined under the Plan, at the time of her cancellationFurther, there is no indication in the records that *** *** was experiencing any type of complication related to her pregnancyRather, we understand that the reason for *** ***’s decision to cancel her travel plans was due to her physician’s recommendation against travel to Cozumel based on the concerns for the potential of an illness occurring in relation to the Zika virusWhile we certainly can appreciate and empathize with *** ***’s decision to cancel the trip, unfortunately, as the reason for such cancellation, namely the concerns for the potential of contracting an illness, is not a specified reason under the Plan, we were unable to consider her request for reimbursement.Please note that the Plan in its entirety, including all specified reasons for cancellation, as well as all specific exclusions to the eligibility for coverage, are provided to the participant prior to and concurrent with their purchase of the planIn addition, our contact information is provided should a potential plan participant have any questions regarding the plan.We trust we have provided sufficient information regarding the claims process and the claim determinationShould you have any additional questions, please feel free to contact our office.Respectfully,Stephanie O*** AVP, Compliance
