Please, that is pennies compared to the hotel stays and food I've had to purchase because my place was uninhabitableHow about the constant trash in the halls? Or the fact that the doors aren't secured? All you have to do is give them a tug and they openWhy even use keys? Oh, and the fecal covered walls, poor lighting in the parking lots? Oh, how about the laundry machines that are stilen? And then you have the brilliant idea to put an ATM machine in the building?? Incompetent!! I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.I have reviewed the responseI don't agreeI received one balance letter via regular mail in AprilEach month following there has been an eviction notice taped to the doorI received an eviction notice for April, May and JuneThese were all taped to the door for all to seeThis was well after the rent was paidI've called the property manager each time and all she would do is apologize with promises that there wouldn't be anymore notices sentWhen we met in April there wasn't any urgency in reference to the remaining balanceShe simply stated that AIY wouldn't have assessed a feeIt was agreed that I would continu to pay on the balance until paid offThere weren't any set termsThis is why I couldn't understand the posting of eviction notices for all to see when the rent was paid well in advanceIf there was a balance notice left, that I could understandTo place an eviction notice when the rent has been paid, that I don't agree withEviction means that I have failed to pay my rent as it statesThis would appear that she placed the notices trying to be funnyI don't appreciate the unprofessional manner in which this situation has been handledShe would say one thing only to do the opposite Regards, [redacted] ***

Revdex.com Case # [redacted] Submitted by: [redacted] AIY Response:In her complaint, the resident makes note of pest issues in her unitIn reviewing our records for thisyear, there are multiple instances where the resident contacted us regarding pest issuesOn 2/29/16,her unit was partially treatedIt could not be fully treated due to clutter in the unitOn 3/18/16, weconducted a building inspection and treated all unitsOn 4/4/16, we re-visited her unit, saw no activity,and noted the monitors were in place, but also noted the unit remained clutteredThe following week,on 4/11/16, we noted no activity during our visitThe tenant reached out to us at the end of June, andon 6/27/we saw no activity, but we treated her apartmentThe next time we heard from theresident was the date she filed the complaint with the Revdex.com (7/28/16)As a result, we decided to do afull building inspection, which would be conducted by the manager of our third party pest controlserviceWe provided all residents with a hour notice letter stating we would be conducting a pestinspection and extermination in all unitsThis notice listed the steps each resident would need toperform to ensure the pest service could fully perform their duties (i.eremove items from cabinets, pickup personal items from the floor, etc.)Most tenants complied with these instructions, however, thisresident did notIn talking with the property manager, the resident stated that she was not informed ofthese instructionsWe apologize for the inconvenience this has caused the residentWe take pestcontrol very seriously and we have attempted to treat her unit every time she has contacted usThatsaid, to effectively treat the unit, the pest control service needs to be able to treat the unit every twoweeks (treatment schedule)Further, we also need the cooperation of residents with respect toassistance with clutter, preparing the unit for treatment, etc., otherwise, protocols cannot be followedand these issues can persistWe will continue working with the resident to treat the unit until the pestissues are goneThe next scheduled treatment will be in two weeksIf she has any further questions orconcerns, we encourage her to contact the property office for assistance

Mr [redacted] continues to dispute the issue of his security deposit The lease agreement states the following: “Said deposit will not be applied to any month's rent during the tenants’ occupancy, but shall be held by the Landlord as a guarantee for the faithful performance of the terms of this agreement until the date of vacating Said deposit shall be refunded to the Tenant upon faithful performance of the agreement as referred to herein within days after vacating the premises and returning the keys to the Landlord” We understand the legal language of the lease can be confusing and we apologize for any misunderstanding The lease states that the tenant cannot apply the security deposit to unpaid rent at any time during their tenancy, however, the landlord is able to apply the security deposit to any open balances, including rent, if the tenant does not faithfully fulfill the rental obligations of this lease

Revdex.com Case # 11177612Submitted by: [redacted] ***AIY Response: In her complaint, Ms [redacted] notes a discrepancy with her final balance Ms [redacted] has not been a resident with us since August When she vacated her unit, she had an outstanding balance due Her account has been turned over to collections to attempt to recover the outstanding money due Per review of her account activity, the assessed charges that make up her outstanding balance appear accurate With respect to the balance adjustment, in reviewing her account, there were no work orders listed in our system regarding an issue with her toilet Typically, in a situation like this one where a potential rent concession was discussed (i.ereduction of rent), an agreement would be written up and signed by both parties Unfortunately, we do not have any such documentation in her file Further, we reached out to the individual that was the property manager at that time, but she does not recall any agreement That said, if Ms [redacted] has something in writing regarding this situation, we would be happy to review it and then respond accordingly

Revdex.com Case # [redacted] Submitted by: [redacted] AIY Response: In her complaint, Ms [redacted] notes an issue she had with attempting to move into a smaller unit In February, Ms [redacted] did complete a transfer application (which was approved) to move from a three bedroom townhome into a two bedroom apartment Prior to the scheduled modate, Ms [redacted] requested to see the unit she would be moving into We agreed, however the unit was still in the process of being prepared for her She became upset over the condition of the unit and stated she was no longer interested in that two bedroom unit We assured her that it would be ready by the scheduled modate, but she wanted to see a different unit that was complete Therefore, we showed Ms [redacted] a one bedroom unit was that ready for move-in She stated that she would accept this one bedroom unit The following day, Ms [redacted] contacted the property office and stated she wanted a two bedroom unit Unfortunately, the two bedroom unit we were preparing for her had now been rented to another prospect She was upset, however, she had previously told us she was no longer interested in that two bedroom unit She then asked about moving into one of our other nearby properties After some internal discussions, ownership waived the need for a second security deposit at the nearby property and we would transfer her current deposit over Per discussions with the property office, Ms [redacted] has now moved into an apartment at one of our nearby properties We appreciate having Ms [redacted] as a resident with us If she has any further questions or concerns, she should reach out to the property office for assistance

In the complaint, Ms [redacted] notes various issues since she first moved into her apartment Regarding her move in, she is correct that a delay was necessary She was initially scheduled to move in on 10/6/17, however, due to a leak, we needed to reschedule her to a week later Ms [redacted] moved into her apartment on 10/13/ The property office has no notations, nor do they recall, any request for reimbursement for a hotel stay during the extra week Further, there are no notations of Ms [redacted] being unhappy with the apartment itself Next, regarding the heating system, our system shows a work order on 12/28/for “no heat” It was noted during this visit that she had windows open No work orders or system notes exist for loud vents There was no intent on our part to deceive Ms [redacted] by showing her one unit and issuing her a different “problem” unit Regarding security in the building, we have no record of Ms [redacted] calling the office for broken locks or homeless people near the building We did run into an issue with packages being stolen We had several residents contact the office regarding missing packages in March/April During our investigations, we did find the note on the front door of the building about unauthorized persons and a suitcase of items was found abandoned in the laundry room We inspected all external locks (and again on 5/1/18) and ensured the security camera in the lobby is functioning properly, which it is We are continuing to investigate the root cause of this issue, as the safety of our residents and their belongings is a top priority Next, regarding any smoke smell, Ms [redacted] has not reached out to the property office, nor have any other residents, on this issue We do allow people to smoke cigarettes in their apartments, but not in the common areas Recreational marijuana is illegal and therefore, not permitted We would be happy to put out a notice to the building regarding this matter Next, regarding work orders, we have several in the system On 3/16/18, Ms [redacted] contacted the office regarding a clog in her bath tub and sink The office had someone dispatched to her apartment the same day On 3/27/18, a member of the property office left a message for Ms [redacted] to follow up on this work order The property manager recalls a conversation with Ms [redacted] on 4/28/about the tub and sink being clogged again During that conversation, Ms [redacted] did mention that she had called the office a few days/week prior, but had not received any response Unfortunately, the work order was not in our system The property manager apologized and entered a work order Ms [redacted] did not mention during that conversation that she did not have use of her shower Finally, on 3/16/18, a note was entered in the system regarding Ms [redacted] ’s interest in moving to Akron with her fiancé prior to 6/1/ The office explained the skip and buyout options available to her Ms [redacted] was interested in subleasing the apartment and not the buyout, however, we do not allow subleasing We explained our options and that we had to apply them consistently to everyone Ms [redacted] noted that she wanted to take a week or so to think things over and would call the office back We apologize for any inconveniences Ms [redacted] has experienced during her time as a resident with us The office is happy to have additional discussions on her lease options or any other concerns she has regarding her lease agreement or her apartment

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below In regards to the landlords response, I would like to highlight the fact that [redacted] claimed that the shower was ran, however the walls, window inside the shower, blinds and wash rags/shower puffs were all dryInside of the tub was the filth residue from the bathtub backing upThe responder also claims that the bathtub was empty, but water was draining, so unless they can see invisible water then this statement is clearly a lieIn regards to the humidity, the weather for the area on the 4th and 5th of that day was hot and humid, at 73% according to the weather record for those days so the entire building was humid because there is no central airThe responder also claims that my phone number was not updated, however I have received calls from the office in prior incidents including from maintenance.Furthermore, I have called previously for them to repair the issue of the water backing up into the apartment which was ignored for an entire weekend and supposedly fixedIt clearly was notThe maintenance personnel claimed that I was filling the tub with water from the drain, which again is impossibleIn both cases of maintenance being required, I was blamed for instead of maintenance coming to fix the issueThis recent incident in particular is the primary cause of concern as I was threatened with fines and fees if the water was used instead of them apologizing for faulty equipment and repairing the issueI've attached a picture of the backed up water to this response Regards, [redacted]
