Allure Design was put on retainer by *** *** on July 8, for a landscape renovation and patio projectAfter being put on retainer for $8,and scheduling the project start date, it came up through the *** conservation department that was contacted prior to a start date there were
pre-existing issues with the property at ** *** *** ***, Ma that Mr*** was aware of when purchasing the home, 50-60% of the back yard was not usable and couldn’t be used for any reason because it was under the jurisdiction of the *** conservation commissionDealing with the commission on a regular basis, I went down and spoke to *** who heads up the department and she did me a big favor, because of the response we have had with her department for years, *** put us in for a conservation hearing of the situation, she asked if I could bring a full set of 36”x24” to scale landscape drawings showing what I proposed to do, that being said I went to the hour meeting along (Mr*** was traveling) and along with the board members we came up with an acceptable resolution to the situation, giving Mr*** a complete back yard of new lawn and a safety split rail fence with a wire mesh product so the children could not fall down the 15’ rocky embankmentAgain, that being said, it was a cost from my end with the meeting, conservation visits and the design of the back yard according to the specifications given to Mr*** (approximately hours of time has been put in by me and my office)Re-capping my answer to complaint #*** we signed an agreement for sq’ of patio, after installing the sq’ Mr& Mrs*** wanted to increase the patio size from sq’ to sq’ plus decorative border, I told Mr*** we needed to sign a change order with me on 10/24/(see attached, paid in full invoice #1560) that the Unilock was a special order, he agreed and paid for it, I placed the order, it came in early November, Mr*** was in constant touch to my masonry supplier and was informed by the *** *** and my office that the patio was inOn November 1st, I was rushed to South Shore Hospital from my home by ambulance for internal bleeding, dehydration and other internal issuesI was discharged from the Hospital on Sunday November 6th, Monday November 7th Mr*** was sent a letter from me (see attached) explaining where I was that week and asked for confirmation for Wednesday November 9th if I could have materials delivered, I never got a response but that afternoon my salesman at *** *** called me and told me Mr*** called his office to see if the materials were in, he was given the same information (delivery was scheduled for Wednesday the 9th.) after not hearing back from Mr*** I sent him another email (see attached) along with voicemails and I have not heard back from him after signing the change order on 10/22/I feel as a responsible landscape constructor we have done everything as a responsible company would doI feel Mr*** is only explaining part of the actual eventsI would appreciate the facts of the matter be posted for all future clients to read, Sincerely, *** * *** Sr CEO - Allure Design

[Once again, *** *** can't help showing himself for what he is.This second reply is sloppier than the first--among other things he gets my name wrong.He can't or won't keep the simplest things straight--the $he claimed for fieldstone is now $14000.He does not answer at all to the substance of my complaint but nor does he deny my accusations of fraudulent behavior on the part of Allure design.Even aside from what I wrote I can't see how anyone would take the risk of dealing with the the entity that produced these responses to my complaints.You can deal with Allure Design at your own riskI will be dealing with them through the criminal and civil legal system.]

Per Letter of Agreement we were entitled to design session, at our place, which should have happened prior to preparing any designs, pictorials, or budget.The "designs" Allure Design sent us were made without consulting with us, without our input, without even visiting the site.You (Allure Design) have not done work per Letter of Agreement and you have not delivered anything of use.No one in landscaping business (that we contacted) charges for initial visit, design session, and estimates/budget.While waiting on Allure Design to reply to our meeting invites to visit the site we contacted four other landscaping companies.They all replied in timely manner and acted interested.Allure Design collected $deposit, sent useless "copy/paste" "designs", and then disappeared.Other companies all visited our house, sat with us, heard our wishes and ideas, prepared draft plans and estimates, all free of charge.The representative of company we finally picked visited our home multiple times, prepared two drafts/revisions of estimates and plans, and did not charge us a dime!The first payment we've made was on a delivery of the materials to the construction site.As of now the construction is finished, using our ideas and plans, ahead of time, with half of the "budget" Allure Design was trying to force on us.Allure Design have not delivered properly discussed with us and approved by us plans/budgets/pictorials.Whatever you sent us was no use.You never visited our site. You ignored/canceled already scheduled meetings and ignored follmeeting requests.You spent more time explaining why you would not return $deposit than on doing actual work.We not longer wish doing business with Allure Design and would like to warn others customers from doing so.Kindly asking to return our $deposit.Regards,

Dear ***,The representative of Allure Design never met with us at our home.We had only one introductory meeting on 10am 7/31/at Allure Design's Norwood office at which point we gave you "before" pictures of our property and plan with lot boundaries.Since then, no one ever visited our property as was promised. No one took actual field measurements of our property (it has difficult landscape features, which was mentioned during preliminary office visit).No one took pictures of our property (we provided ours).We did not have a single on-site design meeting.Designs that you sent to us were made without visiting our property and without taking any input from us.The paper work, design drawings, budget and pictorial that you mailed us do not reflect actual property landscape and our wishes.On multiple occasions we tried to arrange on-site visit with design session, but you would cancel meeting at the last moment or simply ignore our invites.At this point we no longer wish to continue doing business with your company.Kindly asking to return our $deposit.Best regards*** Pyatnychko

The response from Allure Design does not in any way address our concerns The initial work done with the conservation commission was priced as part of the complete project, so that has no barring on the complaint Our small addition of sq ft of patio (the border was already part of the project and no additional product was needed), was not anything that I was ever informed would delay the project ***'s communication was horrible throughout the project The project was contracted to be done by the 27th of October It was not done This was well before ***'s sudden illness, which in reality shouldn't have affected our project In fact *** was at our home on the 24th of October (after the change order and after his stated last communication of the 22nd) and stated the patio finished on the 25th, the fence and plantings on the 26th and the sod on the 27th There was never a mention of a delayed timeline We are still requesting a full refund of our payments as per the contractual obligation.Attached is the co-signed contract I have stated the facts as I have documented them and as I have evidence to back up

To Whom It My Concern, I was retained by [redacted] on [redacted] to design a parking area on their property due to the have no driveway upon coming under agreement. I proceeded to buy out 7000 worth of fieldstone at winter prices has 30 tons of stone delivered to my ware house. I was made aware with...

my project manager that a redesign and property survey needed to be done and at that point I had to redesign the plans accurate to Belmont Building Inspections apply for several permit, according to the unusual concrete foundation. The town wanted to reproved the project and I emailed to the revised plans and represent the projects. I also revised pricing for with all professional offer and after all Mr.[redacted] called me to cancel project. I finalized the retainer we were paid was for fieldstone purchase and office  time to put in. Totally 14.500  and I believe we are even on the project with dealing up a bad city management.

Revdex.com:Ask him if he actually paid Gath any money for his portion of the electrical.  We did make adjustments (4 recessed lights, and 2 extra speakers, 1 additional flood light, which I documented and told him was my responsibility.He continues to want to put negative comments towards my husband,  maybe the social world should know about the previous business that went bankrupt, or domestic abuse or larceny...   This is about what is right, he can either pay his portion of the electrical or we will continue to fight it and put it out to anyone that ask.We stated multiple times, the work is not what we are complaining about, his business practices are.   and last time I checked my name and my husbands is on the property. He wants nothing more to do with Allure.

Here are the only outstanding things:  -Please remove the Radicans x 3 ($537). I purchased these myself from [redacted] and can show the the receipt. You charged me for the labor of installing them in line item 2. Please remove $537 for the trees themselves. -Please remove the Lilacs x 2 ($48). I purchased these myself from [redacted]. (If you recall, I wanted the darker purple ones).  -The Forest Pansy Tree was $205, so with 2.2 labor multiplier, that should be $450 not $670 -I calculated the Little Princess, Rhody's, boxwoods, and hydrangea all at 50 each, but you have them all closer to 80-100, which is fine. -We agreed on 4 days of labor and 2 debris removals. You have 3 in there. ( remove one $200). In general, I find this very generous since there is labor included in the costs of the plants. Since your team did some work on moving plants around, I think 4 incremental labor days and 2 debris removals is generous for a project that was supposed to be a week long project and 30K sq ft.?  -I have in different docs that the masonry was $25/ft or $30/ft. Understandably, I will bias towards the lower rate and you will towards the higher rate. I think your guys did a wonderful job, but would it make sense to make this $27.5/ft to split the difference?Net, given these adjustments, I think we're looking at $21400. So, the balance should look like $1600 that you still owe me.  You can confirm your invoice with my spreadsheet here: [redacted]Thanks [redacted]. To Whom it may concern, I was called to a design meeting in Belmont with the [redacted] family to design a driveway park out that they had not had since purchasing the home many yeras ago, and parkrkrd in the neighbors driveway 5 doors down- Upon desiging and getting approval it was my responsibility to submit to the town for approval. In doing so the town had no record of the plot plan on file and asked the [redacted]s to retain an engineer create a plot plan and engineer the property with property staking. When complete I was supplied a certified updated plot plan to design off of for better accuracy- . In the interim I purchased , designed and spent $ 14,000, in preparation of the project. After redesigning the project to the new plot plan the town required a different wall construction than the existing walls on the property- so a new pricing sheet was prepared by me following my redesigned plan and sent to the [redacted]s. Leonard emailed when receiving it was not right to change pricing after agreement was made. [redacted] was aware from speaking to Belmont town officilas that a different by law was put in affect re: fieldstone wall building then 1950- and [redacted] was correct in pricing for meeting the new code- I feel for the [redacted]es andss still wish to build there wall as the matched stone to their property sits at my wharehouse bought and paid for [redacted] [redacted] Sr - Allure Design

twice max. The entire project came out extraordinary, after completion of the project I was contacted by [redacted] that the plumber and electrician that were hired by [redacted] were paid by [redacted] and he asked if he could get a reimbursement, I asked him to give me a my portion of the 2 invoices (we had a plumbing and electrician allowance) [redacted] went over each allowance by app 50% which he was responsible for, it came to be so bad I did not want to speak to [redacted] any more with all his foul language, so I referred him to my attorney to settle things down, [redacted] spoke to my attorney, they set up a time and met at my attorney’s office, my attorney put together a release form that [redacted] signed along with my attorney, [redacted] was given his check for reimbursement of his allowances and a copy of the release form. I finalize my response, [redacted] claimed to me and my attorney that the paid the sub-contractors and was just looking to be reimbursed which he was by certified check. I was hospitalized for 2 ½ out of 6 weeks late summer/early fall where in that time frame I read when I was back to work 13 email threats from [redacted] that he was calling the Attorney General, filing a complaint at Revdex.com and was going to use social medial to defame me, even though in the release there was language put in by my attorney that upon receipt of the certified check noted paid in full. My attorney is seeking a restraining order against [redacted], his wife and all subcontractors involved and pressing charges for slander along with other charges.  There statement is false, and in fact our contract clearly states the cabana includes a bathroom with the all plumbing on his end.  See attached contract, and even ask him if he pulled the permits which he didnt and I paid for.  This is complete fabrication, and wish to pursue this even further. You can also speak with [redacted] Plumbing since Allure Design contacted him about doing the project and I was instructed by Allure to have [redacted] do the work

Attached is the agreement between Allure Design & [redacted].) never had any correspondence with [redacted] before, during or after the project, it was all negotiated between [redacted] and myself. Also, attached is an invoice from [redacted] in the amount $4,690.00 As per page 2 with my contract with [redacted], I owed The [redacted]'s a custom 14'x24' cabana with the stated interior as listed on the last sentence in the cabana section of the contract, I owed The [redacted]'s one hanging fan, 2 outdoor flood lights, 1 bathroom light and 4 plug outlets. As you can see on [redacted]'s invoice #[redacted] added 27 custom electrical components to his cabana, that is all fine, however I am not responsible for the payment of those 27 additional electrical items.We (allure Design) worked very closely with [redacted] with the design and construction phases of the 10-month project, accommodating every needs on a day to day basis, I have attached for all to see various photographs of the completed project. The [redacted]'s are making it seem like we are the villain when in fact after all review the photographs, you all can be the judge.I have been in the industry for 40 years and seen all types of clients, my opinion now that the project is complete, [redacted] would smile at you while you were there and stick a knife in your back once you leave.I invite the whole social media world to see the contract docs, the electrical docs and the completed photographs of the completed project, and you all be the judge of this sticky situation.Sincerely,[redacted]

The comments on the Conservation Commision have nothing to do with Allure Design not meeting their contractual obligations.  I was never informed of a delay based on the paver type (which was in stock at many locations).  Allure did not move forward on any other work while they were theoretically waiting on the pavers.  Furthermore, my expectation was that Allure Design was run as a business not with work relying on one person.  If I had wanted that I would have hired one person.  We were given no notification of [redacted]'s illness nor the "delay" for the pavers.  Allure did not meet their contactual obligation after assuring me they were on track, well after the minor patio addition.  I am expecting a complete refund of all the monies I have paid to Allure Design and [redacted] at this point as that is what is contractually obligated.

We signed an agreement with Mr [redacted] on 7/8/16 after that it was brought to our attention by the Westwood conservation Department that his property at [redacted] was "red flagged" by the Conservation Department for violations of the Wetlands Protection act. Upon learning of that we reached out to the Wetlands Departments of Westwood, they requested that all of the Wetlands plants that were on the property and removed by the previous owners were to be replaced in order to move forward with our Landscape renovation project. They also requested a full set of 2 scale drawings labeling all the replacement plants and locations. A town meeting was scheduled on 7/27/16 which we attended in Mr. [redacted]'s behalf (Mr. [redacted] was out of the country on business), at the Town meeting we were given approval to move forward with the project and the Wetlands replication. They required a revised set of drawings with modifications that I prepared and mailed to the Conservation Department. We were then given final approval to move forward with the project on 9/22/16.On 10/26/16 we mobilized equipment and labor to remove all existing landscape and lawn, establish sub-grade as per the Conservation Department and called for a first inspection. The first inspection went well, that was approved and continued to move forward with the landscaping and hardscaping. We installed all the topsoil to the property, laid out the Unilock patio, install the Unilock patio and matched fire pit. Mr [redacted] requested the patio to be build larger than he had originally approved. They style of Unilock we used was a special order, when asked to enlarged the patio, we had to re-order more Unilock patio products that was approximately 10 days wait time. During that wait time. I became ill and was hospitalized for 3 weeks when returning to work there was a letter and numerous emails from Mr. [redacted] requesting to cancel the contract even though he had five conversations with our Unilock supplier and he knew when the patio would be in stock and was confirmed by my supplier when it arrived.In reaching out to Mr. [redacted] by email, text and mail the product was in and would like to start an installation date, Mr. [redacted] did not return any of our messages(approximately 10). We are still willing to complete Mr. [redacted] project as special order Unilock patio is paid for and sitting at my distributor wholesale yard in Newton.There are approximately 5 days of work left in the project and 2 conservation sign offs to be 100% complete, it makes no sense to me why Mr. [redacted] wont return our messages so we can come and finish the project, we are ready to willing and able to start and complete the project weather permitting.Sincerely,[redacted]

I went to the design meeting as scheduled and only [redacted] was there. She was going to...

After 3 hours of site meetings, measurements, photographs and notes I quoted [redacted] our design fee pricing and she agreed and wrote a check so I could get started on there new pool, and back yard design. After designing, pricing, putting a 80+ page pictorial together with 2 sets of auto cadd design a design meeting was set up at there home with [redacted] & [redacted]. I met both Mr. & Mrs. at there home and spending 2+ hours going over design ,pricing, pictorial and plans we signed an agreement to schedule the project. I sought out 4 pool companies for quotes made 5 site visits for site analysis.We received a call from [redacted] requesting an office meeting to go one on one with one of my Architects for some revisions. The revision meeting lasted  7 hours and was a complete redesign of the entire project we agreed to and signed off on. The pool was a complete different style that chosen and the back yard was completely different-the plans were taken by [redacted] to her husband for review and revised pricing , the project went up 20% - since that office design meeting 3 additional complete different plans have been completed  with bringing the same  4 pool companies back out for new pricing. There was 100plus hours of office time put in at a billable rate of $125 per hour plus materials ordering, canceling orders being assessed 20% handling fees - I had to make a business decision and  make it clear to my client our time is valuable, and all the wasted hours site visits we nonsense. I offered a fair refund to [redacted] and his wife with a release form to close out our relationship but the refuse to comply-I HAVE NOT WORKED WITH SUCH AN INDESICIVE CUSTOMER EVER! I was called to the [redacted]'s home summer of 2016 to look at designing and installation of a "Zen" garden look throughout the entire property (see attached before and after pictures)The reason we were called in was they...

originally hired a Cape Cod Landscape firm to design and install the "Zen" project, after months oping by the [redacted]'s got taken for $100,000 and a $30,000 lawsuit by their neighbor due to the incorrect drainage installed by the Cape Cod landscaper. We completed all base contract work for the [redacted]'s and were paid in full, [redacted] in August requested another project which was to include Landscape lighting and 3 Oriental large Evergreens, the lighting was installed, however, the special order for the Evergreens were not available, at the same time period of [redacted] reaching out to me, I was hospitalized in 2 separate occasions for a combination of internal things. We were put on retainer by [redacted] for a landscape and masonry design. I usually in 99% of the time, I set up a consultation at the client’s property to take before pictures, take field measurements and prepare an existing conditions plan to design from. After emailing the design for agreement, it was sent back signed with a check for the retainer. I asked what would be a good time to come out to their home to have a site meeting, [redacted] wanted to come to our office and showroom to look at samples and ideas. He was to bring a certified plot plan and before pictures which he did, [redacted] came with his wife on Sunday July 13, 2016, we spent a couple of hours going over his difficult property, I made many notes per area for design, picture by picture. I explained I would put a set of preliminary but complete 24”x36” colored to scale plans and mailed them with a budget sheet to [redacted] and his wife approximately 10 days from our meeting. I followed up with a call to set up a design meeting at their home and I was told by [redacted] “not yet” they wanted time to go through the plans and mark them up (typical) and he would be in touch to set up a meeting, obviously it was a very busy year for us, so his folder was filed in what we call “pending customers”, yes, I forgot about [redacted] and his wife as I was to wait for his call. Now 2 months have gone by and I receive this complaint from Revdex.com. I am willing to go to their home and view the property, make my notes and go over theirs. It clearly states in the design agreement “the client is due a full complete set of plans with one complete revision”.
