I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowFirst, Alpin Haus would not complete the job, there was absolutely nothing that prevented them from doing the job - that is a big difference We were told that it was "cost prohibitive" at a time when we could not get on the schedule with another pool company Second, [redacted] Pools DID NOT install the pool this week Third, [redacted] Pools is claiming that the intermediary (Clint from [redacted] Pools) purportedly lied to Alpin Haus because the owner of ***'s (***) never said that the pool would be installed this week They are now giving a "timeline" of 2-weeks for installation, with a settling period of another 2-weeks before concrete is laid Moreover, they are refusing to put even an estimated timeline together for us in an email [redacted] even went on to say that they have at least two other projects that they are working on "one that is 90% and the other that is 50%." We can't even get a clear answer as to when they will start or be done The statement made by Dana was that we were "next up as soon as the weather clears." That was in May We had an entire week of hot, bright sunshine There is no excuse to not installAt this point, ***'s has only done a "test hole," as they are calling it now They have allowed the hole to fill with water, stand un-fenced and deteriorate for what will be three (or more) weeks The excavator has supported our suspicion that the hole is now "unusable" and will likely need to be re-excavated Even further, we uncovered that we may not even be getting the exact same product that we were originally contracted for! Neither Alpin Haus nor Clint (the [redacted] Pools representative) nor ***'s ever once told us that we would not be installing an [redacted] Legacy series pool We uncovered today that [redacted] Pools does not even have the authority to install an [redacted] Legacy series pool, only [redacted] in [redacted] and Alpin Haus do In addition, we were also supposed to be getting a quality [redacted] heat pump, but instead are being sold a [redacted] heat pump at price in line with an [redacted] pump This is bait and switch, at a minimumWe have given Alpin Haus ample opportunity to honor their contract They have no legal, reasonable or justifiable cause to back-out They attempted to make resolve by establishing a relationship with ***'s to do the pool, under the guise that we would be fit into the schedule early, that we would be receiving the exact same package as Alpin Haus was affording us and that the pool would be installed before June 2, At this point we are looking at late July, if not August This is not the agreement that we all agreed toAlpin Haus needs to install the pool and fulfill their end of the agreement that was signed At this point this job is costing us a substantial amount of money out of pocket If they refuse to honor the contract and install the pool, we will be forced to take legal action Regards, [redacted] ***

I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me We do not agree with their 'reaching out' to us and the way they wanted to resolve the issue They assume no responsibility for our problem and what they offered to us was not a 'deal' at all They changed their price online on the RV they offered to us and after their offer it was more than originally posted online, not a deal at allThe response from the salesman was 'I will keep you on my wish list for a used Rv that may fit your budget.' Mr [redacted] chose to store his RV with us while parts were on order instead of using the RV. The camper was very usable and there was absolutely no reason not to use it while waiting for parts to arrive. When Mr. [redacted] arrived to pick up his camper he lost control and verbally abused... and threated our Service Manager in front of customers and employees. Replacement engine came with a year "no fault" warranty which expired in March We reviewed the engine failure with the manufacturer and they stated that due to the warranty having been expired for months there would be no warranty honored Upon inspection by us as to why the
engine failed it was determined that there was gas in the oil tank which then diluted the oil and caused the engine to run lean and ultimately fail The engine failure had nothing to do with the oil leaks which the customer had reported to us, but simply due to the engine not getting the proper lubrication due to the dilute mixture of having gas in the oilThe customer will not accept responsibility of gas somehow having been put in the oil however there is no reason for us to do anything with the oil tank contents when replacing an engine It's unfortunate that this happened and although no fault of Alpin Haus' we did and will still offer a discount should she choose to replace the engine The customer has stated they are seeking us to fulfill mechanical obligations or refund $ We have fulfilled any mechanical obligations since the original install in March Also, the invoice for installing the engine was approximately $which was for additional work not related to the engine was performed The actual value to replace the engine as quoted to the customer would be $ Attached are a couple current pictures of the customers machine which are a representation of how they take care of their watercraft

This letter is in response to the complaint submitted by *** *** on June 4th, The complaint is ID# *** and is in regard to a contract disputeThe main concern listed is that *** *** would like Alpin Haus to install an inground pool at her property located at *** *** ***
*** ***, NY ***After doing a site visit to the property it was determined that Alpin Haus could not take on the installWe notified and spoke to both *** and *** *** as well as *** Father who is a long tenure RV salesperson at Alpin Haus. The main concern being the serviceability both during the project and after. Alpin Haus then reached out to our pool supplier and asked for a recommendation for a pool company that was local to the ***'sAt this point, the new pool has been excavated by *** pools and is set to be installed this weekI have given my email, office line and cell# to ***, and asked that she contact me with any questions she may haveAlthough, Alpin Haus is not installing the pool, we still want to assist with any questions or guidance that the ***'s may need. The consumer has alleged we did a bait and switch in regards to the trailer they receivedThat is not what happened as the paperwork
they did with the sales person had the specific Vehicle Identification number on itAll of the original paperwork would have had to be redone to accommodate the vehicle change and that did not happenIn our computerized, recorded and locked deal history the only vehicle that was ever assigned to the customer is the vehicle they receivedI can only assume that the kids may have put the sold sign on the wrong vehicle and whoever may have said "we gave you the one next to it" simply we moved the sign to the one they actually saw and purchasedIt is a big lot with a lot of vehiclesI think the actual issue at hand is a door issue the customer is having with his trailerAt the time of his delivery this was an issue and we offered at that time to change vehicles for himHe declined this offer as he did not have time to waitClearly if there was a bait and switch we would not have made that offerHe went and looked at another unit at that time and decided to stay with his initial purchaseWe are working with the factory to get the door issue resolved and our service manager has told the customer we will take care of itWe are taking care of the customer even if the factory does not cover it and this was shared with the customer the end of November before we even got the Revdex.com (11/30) notice
Mr*** called me on Saturday 11/and we discussed these issuesI told him we would look into this and get it resolvedThat same day our Service Director had reached out to him and assured him it would be taken care of
We are always concerned for our customers satisfaction and want them happyUnfortunately we are not always accommodated by a manufacturer to the same desired end

We have contacted *** RV the manufacture of the RV numerous times for guidance and they have flown out a representative to inspect and oversee the repairs of the RV. Below is the latest contact that we have had with Mr*** and there seems to be positive progress being made

In Speaking with Mr*** the communication on our behalf could have and should have been more clear. At any rate we did have conversations leading up to the install and also during the install. The crack to the driveway was discussed and I did tell Mr*** that I would
certainly meet with him to review the damage. At the point that the driveway was cracked, Mr*** told me to put the entire project on hold, I asked him if we could resume and address the driveway once the project was done. We both agreed this was ok. I am more than happy to meet with Mr*** to address the driveway as it is unfortunate it was cracked, but as I told him prior we would address this damageI also had asked Mr*** to allow us to finish the skimmer hook up and the outlet plumbing to which he agreed. Unfortunately, we did not get to his home prior to 5pm on the day scheduled and he called us telling us that if we showed up, he would consider us trespassing. We tried to explain to him that being a seasonal business we do not work the typical 9-hours and that we had people heading to him to complete the install. The portion to be completed would take us about 20-minutes. He would not allow it. At this point I would like to meet with Mr*** to handle the driveway concerns and also go over the entire install to ensure that he is happy and to also answer any questions he may have on the pools operation Thank you, Jamie G

UPDATED HIM THAT *** *** WOULD NOT AUTHORIZE CLAIM PAYMENT , BECAUSE THE MILEAGE WAS LESS THEN WHAT IT WAS THE LAST TIME THAT IT WAS WORKED ONTHEY SAID THAT THEY NEED AN ECM PRINT OUT SHOWING WHAT THE ACTUAL MILES ARE ON THE COACH BEFORE THEY WILL AUTHORIZE THE REPAIRSJW @ *** *** SAID THAT THE CUSTOMER NEEDS TO PAY FOR THE REPAIRS UP FRONT, GET THE ECM READING & SUBMIT IT TO THEM, IN ORDER FOR THEM TO GO FORWARD WITH AN AUTHORIZATION FOR THE REPAIRS*** SAID TO REPAIR THE COACH SO THAT HE COULD PICK IT UPI GAVE HIM AN ESTIMATE OF $TCOMPLETE THE REPAIRSSincerely, Ron CDirector of Service & Parts Alpin Haus

Mr*** *** purchased a used motor home from Alpin Haus on 2/2/and traded in a *** Travel trailerHe picked out the motor home he wanted and he represented his trailer in very good condition, fully functional and with no water damageOur purchase agreement clearly states that
our obligation on his purchase was to Prep the vehicle, do a walkthrough demonstration and make sure "All appliances work at Delivery"He scheduled the delivery and we prepared his purchase for deliveryOn the day of deliver he came in and went through his vehicle and accepted itHis trailer was inspected by us and we found significant de-lamination of the side wall panels on the door side where the awning is attached which is due to water leaksIn his case it was most likely where the awning was attached at the factory and there was not sufficient sealant placed around the screws that mounted the awning to the side of the trailer We told Mr*** that we could not accept his trade at the value it was originally sold at due to the damage we found and we told him we needed to lower his trade value based on the on site inspection we didHe told us he could not pay the difference we wanted which was actually thousands of dollarsWe discussed the issue at length and all agreed that we would complete the deal but there would be no customer satisfaction adjustments or considerations on the used one he was takingHe was instructed to make sure the vehicle was acceptable in everyway that day because there would be no considerations after he physically took deliveryHe accepted these terms and left with his newly purchased motor homeI personally dealt with Mr*** on this matter We regret that years later he has water damage but we cannot know how the vehicle was cared for and used regardless of the representations made at this timeIt is also unreasonable to ask us to address it years later We have offered as a regular practice to our customers free annual roof inspections but I show no record of Mr*** ever coming back to us to provide any service work or free inspections on his purchaseIf he had done so we could have intervened in any leaks that may have been found and caused his current water damage I trust this satisfies Mr*** complaint and it will be closed as satisfactorily addressed Sincerely, David BAlpin Haus Director of RV & Boat Sales

We apologize for the confusion in you efforts to purchase a pre-owned camper from us. After looking into the matter, this campers was mistakenly taken off the market for a short period of time due to a keystroke error so the salesman was not inaccurate when he shared that information. As far as...

pricing is concerned, as part of our company guidelines we do not offer verbal quotes for simply this reason. We feel our pricing is very aggressive and the type discount mentioned would not be available. We could offer the $300.00 prep fee and the $179.00 camping package at no charge in an effort to help resolve the matter.

Customer has agreed to trade in his Trailer toward a newer model which is due in mid to the end of April
