I am rejecting this response because: the dealership was called daily because we were being called daily by the lender.  This story about the wrong address is one of a line of conflicting stories told about the payment.  The manager at the dealership first told us a check had been sent at the first of the month and lost by the lender. They promised a new check was on the way by overnight mail.  Two days later, the lender had not received any check.  The same person at the dealership told me that the check was delivered to the lender and signed for.  This was on the 12th of August.  Later in the day, we called the office and were told by one of clerks that the check was not sent by [redacted], as we were told, but rather sent that same day by regular [redacted] mail.  She confirmed this by three-way call with the lender.  By the 18th the lender had still not received the check.  That was when we were told that the check had been returned to the lot.  It is not the 19th and the lender has not received payment.  I am being dunned by the lender for payment on a car I have not had in my possession for quite some time.  My next step is to take legal action in criminal court for theft.

MR. [redacted] WAS NOT THE ONE WHO RETURNED THE NITRO TO THE DEALERSHIP IT WAS MRS. [redacted] WHO WE COMMUNICATED WITH DURING THIS PROCESS. PAYLESS CAR SALES BOUGHT THE CONTRACT BACK WHICH DID NOT COST THE [redacted]S ANY ADDITIONAL MONEY. THE WHOLE TIME THEIR CAR WAS AT THE SUBLET SHOP WE USED THE [redacted]S WERE PROVIDED WITH A CAR TO DRIVE. WHEN THE CAR WAS RETURNED IT WAS SOLD THE NEXT DAY AND HAS NOT BEEN BACK FOR ANY PROBLEMS. THE MONEY THE WANT BACK WAS PART OF US RECUPERATING SOME OF ARE LOSSES OF OVER $5000.00 OF CHARGES OF BACKING OUT OF THE DEAL MILES PUT ON VEHICLE AND DAILY CHARGE FOR USING OUR CARS AND THE CUSTOMER SIGNED DOCUMENTION EXPLAING THAT.

The car I purchased from American auto sales was advertised at 7499.00 online and sold to me before financing at 12499.00 almost doubled the price.I was looking for a family vehicle In February and found a [redacted] advertised at a reasonable price of 7499.00 online. I called the sales man that advertised the car online and arranged to come look at it. The sales man that sold me the car was linked to the advertisement. He took advantage of my tiredness knowing I had just left work and wanted to hurry home to my family and rushed through the paperwork not explaining what was going on just showing me where to sign. I figured I could look over it the next day so I could really focus on it and review it since I was exhausted that day. After me and my spouse reviewed the paperwork and the online advertisement again we called the salesman and asked why the price was different. He claimed that the online ad was not linked to them at any way and he was sorry about the misunderstanding. What he failed to realize is when we first talked about the car on the phone I mentioned the ad and that's how I found out about the car and price. He confirmed the price so I then made an appointment to view the car in question. Me personally I would not refer this business to anyone I know because their sales staff have questionable behaviors and not very truthful or trust worthy I am now paying for a car that should have only been maybe 9000 after financing but is over 15000 when the agreed price originally was 7499.00. I paid 2200 down and still is left owing over 12000. Desired SettlementI am seeking for my car to be priced as advertised and my contract to be reviewed and fixed because I love my car it's just not worth what I am paying for it. Business Response I haven't talked to [redacted] about this issue yet, only his girl friend called me and I told heir to have him call me. The total price, as well as the financing charges were gone over with the customer before he bought the car. I don't know what they saw the car listed at but I went over every detail before he bought it. In fact we went over it on the contract as well as on the bill of sale. Further more he is behind on his car payment and it sounds like he might have bought more car than he can afford. The selling price was the 9995 not 12900 and the rest is interest. The interest is accrued only as time goes on. If he would like to pay the car off the payoff will not include any further interest. I would be glad to talk to the customer but I can't talk to girlfriend about his account, he is going to have to call me himself.

I recently posted a 2006 [redacted]r from the [redacted]. This vehicle has been nothing but problems that they won't fix. I purchased an extended warranty and now the motor is blown. I'm now stuck paying for a rental every week to get to and from work. This can't be right after I've given this business $3,700 in cash to get this vehicle and still making payments on a vehicle that's not drivable.Desired SettlementI would like to get a full refund of my money to take my business elsewhere. Business Response First off this customer is behind in payment and has no mail box to leave him a message, because we have been trying to call him. Second I have checked with everyone here and no one has talked to him about any issue with the [redacted]. This is the first I am hearing of any problem that he has had. He did not buy any extended warranty on the [redacted] in fact he bought it as is with no warranty. I would be glad to help him with a issue on the truck if he will call me and get the payments current. I hate that he is having any issue but the first step that any one needs to take is call me and at least give me a chance to get the issue resolved. Consumer Response I'm not behind in payments. What I can't understand is how this company still wants me to pay a $350 per month bill for a vehicle that they have on their lot that I'm not driving. It hasn't been fixed plus I'm stuck paying the expense for a rental. That's $176 per week. Just a reminder I began leasing this vehicle on October 15, 2015 and on January 2, 2016 it broke down. This is rediculous to provide them with a down payment of $3,700 and I'm still with no vehicle.Final Business Response I am sorry that he is having a issue with his truck but there was no additional warranty sold to him by this dealership. The truck was sold As Is with no warranty. I have tried to help him out with some consumer good will but he is willing to work with me at all. there will be no refund issued and I can email you the buyers guide showing it was sold as is if needed.

Was told the vehicle had clean carfax and NOT been in an accident also had not been smoked in. The car had been wrecked also smoked in.On June 23, 2014 I contacted the seller American Auto Sales several times regarding the advertised vehicle being a 2008 Lexus IS 250 in which I was told the vehicle had a clean carfax with no accidents also was told the vehicle had not been smoked in. My husband and I both got off work early to drive 2 hours with the intent on purchasing the vehicle. After arriving it was very obvious the vehicle had been extensive front end damage from a front end collision with possible frame damage as nothing lined up in the vehicle. Also had hail damage after being told the body of the car was in perfect condition. In which the GM lied about also there was still ash in an ashtray after we were advised the vehicle had not been smoked in. Desired SettlementBecause the company FALSELY represented themselves and a vehicle causing myself and my husband lost wages we should be reimbursed! Business Response I am sorry that they came down and didn't like the car but is something that happens from time to time. Every one has a option about what they like and don't like. I did tell them that the car didn't have salvage history because it doesn't. I was as up front with them as I could be and told them that the car didn't seem to have been smoked in and it doesn't, there is no cigarette burns or odors in it. She claimed that she say ashes in the rear ash try but in realty it was just dirty. They came down didn't like the car and that should have been it but the husband decided he needed to curse me out several times to which I only told him to have a nice day. I did nothing wrong but tried to sell them a car, they didn't like but because they drove for 2 hours they seem to thing I owed them something for there time, but I don't. I stayed open for two extra hours waiting on them to get here so I could show them the car, and I don't thing it fair to say they own me anything just like I don't owe them anything. Once again I am sorry that they didn't like the car and could make a deal but there was nothing done wrong by anyone here.Consumer Response It was not a matter of "not liking the car" it was a matter of being lied to about several aspects of the vehicle. When questioned multiple times regarding the shape of the vehicle I was told it was "perfect". I do not call a vehicle being wrecked and having hail damage being anywhere close to "perfect". My husband and I both had lost wages as well as mileage put on my vehicle and gas to go down there to see a vehicle that was NOTHING like it was described by this hole in the wall dealership. It was a complete waste of time and had the salesman been upfront and honest I would not have wasted mine and my husbands time to drive 300 miles(150 miles each way) to see a vehicle that was a complete piece of [redacted]! The salesman was questioned if the vehicle had been in an accident the response was "NO" which was an obvious lie you can look at the vehicle and see it has had major damage and a bad repair job at that. I was told the car had a CLEAN CARFAX WITH NO DAMAGE ETC...Once we arrived and he was questioned YET again he then FINALLY disclosed the vehicle had been in a front end collision. He was also questioned the vehicle had been smoked in the answer "NO" as a non-smoker myself and having 2 children I will not purchase a vehicle that has been smoked in and the car had a bad odor as well as ash in the ashtray I know the difference between ash and being dirty. Again it was not a matter of not liking the vehicle...it COULD have been a nice vehicle but the salesman was dishonest and very misleading about this vehicle had the car been in the condition it was described I would have had no problem purchasing the vehicle but it was far from that. People should be aware of this companies sales practices they are very misleading and falsely represent the condition of their vehicles which is very wrong!

This business towed my car(s) from my residence at 10:30 p.m. on 7/5/16 saying that my vehicles had no insurance. I was charged 300.00 to get each oneOn 7/5/16 at about 10:30 p.m., a tow vehicle pulled in my drive way saying that they've come to collect my vehicle. I asked why they replied "You have no insurance". I stated I did have insurance and even tried to show the man my proof of insurance. The man wouldn't even look at my paperwork. He then proceeded to take both of my vehicles. A 2002 Dodge Durango account number (XXXXXXX) and a Ford Mustang account number (XXXXXXX). I had changed agencies on 6/28/16 to [redacted] and I was told by [redacted] that processed my policy that she would send a copy of the policy to my lean holders at [redacted]American Auto Sales. I called [redacted] twice that day once to get the address and a second time to inform them that I was now insured with [redacted] and that they were going to send them a copy of my policy. On 7/6/16 I called and spoke with [redacted] at [redacted] and he informed me that it would be 300.00 to get each vehicle back and also he says that my insurance is invalid because I need a 250.00 deductable. He also says they have tried to contact me and that he never received my policy. I then let him know that I work two jobs so I was sorry if I missed him but I explained to him he shouldn't have taken my cars. He then tells me that if I don't come for them in 10 days they would be put up for resale. As a result of these actions I went to get my Durango on 7/7/16 and the Mustang on 7/8/16. I don't think I should have to pay 600.00 to get my vehicles back and I had insurance. Also I don't understand why they didn't get my policies and [redacted] from the [redacted] agency said she would send them to [redacted]. When I spoke with another agent in the office she told me that she spoke with [redacted] from [redacted] and she sent him my policy with the the 250 deductable however this was on 7/6/16. I have yet to speak to Mrs. [redacted] on why wasn't my policy sent but I do not feel like I should be responsible for the 600.00 dollars that I had to pay to get my cars. And because of this I missed work on 7/6/16 and I'm out 600.00. And even if the deductable was 500.00 or 250.00 I was still insured and the reason they came and took my cars was because they claimed I did not is wrong. I had insurance and was still made to pay for the return of my vehicles. And I tried to show the guy from the [redacted] office my insurance card and my policy he wouldn't even acknowledge it. [redacted] assured me they had no right to take my vehicles and the police informed me to contact the Revdex.com. Things got pretty nasty and words were exchanged and they wouldn't even help to get my car out of the position that it was in I had to get the officer and a friend that took me there to help me get my truck out of the vehicle sandwich it was in.Desired SettlementI just want to be refunded the 600.00 I had to spend to get my cars back.Business Response I am sorry that we did have to pick up both of her vehicles but it was do to a breach of our contract. We called the customer on 5 different days and times trying to find out if they had proper insurance but couldn't ever get a response from any one. We were not notified from [redacted] until the day after we picked the vehicles up and Mrs [redacted] gave me number to them. She broke our contract on two separate items, first being the responsibility of the consumer to notifie us with a change to her insurance and second being the deductibles can not be over 250 for comp and coll. This could have all be avoided if she would have simply called us back one of the times that we called. She stated that she didn't have time to call us back. There was a issue when they came to get the car, the mustang was blocking the Durango from getting out and they didn't have the key with them for the Mustang but wanted to get the Durango right now. I told them we didn't have a wrecker until after 5 that day so they would either have to wait until then or bring the key to the Mustang to get the Durango. They choose to run into a parked car instead to get the car out and messed up that car as well as there Durango. I did have to call the law to file a report on the damage. I am not going to be able to refund the fee because they were both picked up and I had to pay my repossession company to pick them up. Consumer Response I honesty did not think about the 250.00 deductible. And the fact that I did have insurance was overlooked completely. Also I did contact their office and state to one of their workers that I had gotten insurance with [redacted]. They are denying that completely as well. I called them at 11:13 a.m. on 7/28/16. They need to check their call records. Also how am I wrecking a car with "JUNK" written in the windshield. They wouldn't even lift a finger to assist me with getting my car. The police helped push the Mustang out of the way! There was more damage to my own vehicle than the one he claims I damaged. As far as your repossession crew they work there, one sold me my previous car so how is it that you have a "repossession company"? As for them contacting me like I've said I work two jobs and 9 out of 10 times I'm leaving one and going straight to the other and by the time I even notice the missed calls it's to late to contact them. And if you couldn't contact me by phone why wouldn't you try another way? I've been a very loyal customer to them but this stunt they pulled was ludicrous. As far as the deductible is concerned that could've be resolved that same night they came for my cars seeing as to I contacted my insurance company and spoke with them as they were taking my cars. All I'm saying is they shouldn't have taken my vehicles then hit me with a 600.00 dollars tow fee all because of a deductible issue with could have been resolved right there over the phone that same night. I mean doesn't the fact that I had insurance count for anything?Final Business Response The facts are that you were in violation of your contract for separate reasons, and that is why both of your cars were repossessed. You singed the paper work stating that you had to notifie us of any insurance changes and what your deductibles had to be as well as that we have a minimum repo fee of $300. You and your friend walked into my office cursing and even throwing all my things on the ground and telling me to pick them up, so I'm sorry if I wasn't jumping up and down to help you. We left you messages to call us and gave you plenty of time to do so, everyone gets a lunch brake and has to travel to an from work and at that time you could have called us back or left us a message. We were never notified by you or your insurance company that you had any insurance on either vehicle until the day after we picked them up.

we were sold a 2003 ford expedition. we told the [redacted] what was wrong with the truck and he agreed to repair what was listed. The purchase was on 9/17/2013. The check engine light was on and he agreed to see what the problem was. A couple of days later it was back in the shop for a couple of days because it would cut off everytime I drove it. The following week it broke down at [redacted] High School and was back in the shop again and the starter had to be fixed. The week after it cut off so we replaced the coils. Now it is shaking and puttering. Desired SettlementUpon purchase we agreed that the minor things we would take care of like the dvd player, the driver seat, the driver window, the sunroof leaking everytime it rains. He agreed that the car was fixed 100% everytime we had to take it back. I have always wondered how can a car pass inspection with the engine light on? Business Response I spoke to the customer yesterday and told them that it was sold as is but I would be glad to take a look at it under consumer good will and see if I could help them fix it. They told just come pick it up as a repo or come pick it and fix it they were not going to drive it down to me. I don't run a wrecker service and the car is running so if they would like for us to take a look at it then all they need to do is bring it down. I never once told them that I would fix anything but the few things that we talked about before the time of sale. I have tried to help them out since then but because they are having a problem with the payments being behind I am afraid this the reason they are complaining today. The car was inspected before the car was sold to them or I couldn't have gotten them tags. The light came on after the customer had drove the car for several days. I am willing to try to help the customer but they must be willing to help themselves and bring the truck to me and get the payment current.
