This complaint has been brought to our attention for response. Although the student has completed her course of study and passed her licensing examination, we will nonetheless respond to her list of issues.The student's complaint is very general in nature, and other than specifics about a meeting...

with the owner of the school, contains no actionable items for us to address. In an effort to be compliant, however, we will address each item as it is set out in the lengthy single paragraph.1. The student indicates that she had several issues that she overlooked while at school - The student admits in her statement that she overlooked the issues. Since those issues were not brought to our attention for resolution and are not specified, we will not address them.2. The following issues were part of the same lengthy paragraph, we are not sure they were among those that were overlooked by the student, but will nonetheless address them individually.a. Teacher teaching two classes at one time — without the name of the instructor or course, we are unable to address this or even confirm that this occurred.b. 3 weeks late with books in one class — without a course name and time frame, we are unable to address this.c. Instructor shoved desk at student - Again, with no names or identifying information, we are unable to address this. It does appear from her remarks that she was not a victim of the alleged incident. 3. No consistency in administration — This complaint is general in nature and does not address a particular problem. Nonetheless, the College always retains the right to change administration for the betterment of the program and for the benefit of our students.4. Class schedules changed with < 2 weeks' notice - It is hard to address this with any specificity, but a look at correspondence with the student shows that this complaint may refer to the addition of a Capstone to the schedule. The Capstone instruction was added to assist the RN students to prepare for the NCLEX exam. This instruction was added as soon as was practical, and notice was delivered to the students immediately thereafter. The student completed the Capstone material successfully. The pinning ceremony was re-scheduled to accommodate students that were affected by the change.5. When we complain, we were told to leave by "regional director" or program director — The College does not have a "regional director" so we cannot address this complaint.6. Forced to abide by handbook we never signed or agreed to — The student handbook is a part of the rules, regulations and structure of the nursing program. There is not a provision in the program for the students to "accept" or "agree" to the terms of the handbook.7. Unhappy with clinical sites, never had opportunity to go to labor and delivery — This was an issue that the student addressed with the School Director. Clinical sites were assigned randomly and with consideration of the number of slots available at the site, the instructors available, and the student's schedule. The student wanted to be able to pick and choose here clinical sites, which is contrary to the way clinical sites are assigned. The nursing director at the time did provide the student an opportunity to attend some mother/baby clinical sites prior to the student's completion of the program.8. Kicked out in last two months of program because of threat of complaint to VA — The student was removed from the program not because of her threats, but because of continued unprofessional behavior in the classroom and with staff.9. Escorted off school premises — This is standard procedure when a student is dismissed. This is done to prevent any disruption to classes or the conducting of business at the school.The remainder of the complaint deals with the appeal of her dismissal and the meeting with the VP and owner of the school. The student's name was listed as a complainant in a TWC complaint. The VP and school director called each student that signed the complaint into the office to discuss their issues. At this point the student's dismissal and appeal were considered. The College acknowledges that the student met with the VP of the school (who is no longer employed at the College), the owner, and the nursing director. 10. It was ambush, I was not allowed to bring husband — The meeting was specifically meant to address the student's wish to be reinstated to school. The student's husband's presence was not relevant to the issues being discussed. The term "ambush" is very subjective and general, and is nothing more than the student's perception of the meeting.11. Told by owner he would give money back and issue a transcript, but that the transcript would not mean anything — The College admits that it offered to refund the student's money and issue a transcript for the courses completed to that point. The College denies, however, that the owner stated that the transcripts would "not mean anything." Only the receiving school can make the determination about accepting credits from another school. \12. Would not be allowed to return if money refunded — The College agrees to this statement. The student could either return to school, or have a refund, but not both.13. Owner said "Now, do I ruin your life?" — The College denies that the owner made this comment.14. Made to beg to return to school — The College strenuously denies this statement. The entire purpose of the meeting was to try to get the student to return to complete here studies.15. Owner says he has best lawyers and he was not afraid of me. — The College denies that this statement was made. Even if it was made, there is no actionable issue in the making of the statement.16. Owner said that when 1 attack school I attack him, and by putting name on TWC complaint I attacked him — The College admits that the owner takes complaints personally. That is the reason why the owner agreed to meet with the student, to address the basis of her complaints.17. Owner said TWC complaint would not do anything, he would just show his friends at TWC some paperwork and he is good to go — The owner denies making this statement. All complaints made to TWC are addressed vigorously and with appropriate documentation.18. My $30,000 means nothing to him — The College agrees that the statement was made. The issue being discussed at the meeting was not about money, but about returning the student to classwork so that she could complete her training. No decision would be made about the student solely because of the money.19. He takes young single moms out of the ghettos and puts them in 30-40K jobs — The College admits the statement. It is part of the College's mission to assist a vastly underserved portion of the community and the College stands by its record of doing so.20. Insulted when he asked me who the Vet was in my family — The College does not know how to address this very personal and subjective feeling of the student. 21. Called a problem child. — The College denies that this statement was made. It should be noted, however, that the student had been dismissed for unprofessional and disruptive behavior.22. Never given on opportunity to talk except to answer questions — The College denies that the student was not given an opportunity to address her concerns.23. The issue of the termination was never part of the conversation —The College denies this assertion. In fact, the entire conversation was about the student's return to school.24. Meeting was set up to scare me and it did. If I did not get back into school it would have wasted 16 months of my life — It is the College's position that although the meeting may have tough in the student's perception, it was this "tough love" approach that convinced her to continue her studies and become an RN. The student agreed to return under probation and with specific guidelines for her completion of the program. A copy of her re-entry agreement which set out the terms of re-entry is attached to this letter.25. I was intimidated — See response to #24.26. I was allowed back in school and on my own I persevered and became an RN — The College takes umbrage at this particular allegation. Although the student's hard work and dedication to the completion of her program were exemplary, it was accompanied by extensive instruction, tutoring and support from the faculty, staff and administration.27. I have a hard time dealing with the humiliation and disrespect in the meeting and overall treatment at CPC — The College denies that the student was humiliated or disrespected. See response to #24. The comment about "overall treatment at CPC" is too general and non¬specific to address.28. Issues I encountered were never resolved while 1 was at CPC — As with so many of the other allegations in the complaint, this is non-specific and general and as a result cannot be addressed effectively.The desired settlement is not an option. The student was offered an opportunity to get a refund and walk away from her obligations, and was even offered a chance to get a transcript of her work completed to date. The student chose instead to return to school and complete the program. To suggest that the student deserves a full refund after taking and completing all her training and being prepared to take the NCLEX exam is unjustified and would result in unjust enrichment.Thank you.
