AmTrust International Underwriters Designated Activity Company Provided Commercial General Liability coverage to [redacted] LLC dba Sonic Restaurant under policy number [redacted] , effective 5/1/to 5/1/18, with limits of $1,000,per occurrence.? ? Our records indicate that we received this claim on 4/3/18.? It was reported by our insured that the claimant, Ms [redacted] alleged, while eating popcorn chicken away from the premises, she chipped her toothOur adjuster attempted to contact Ms.? [redacted] on 4/5/18, 4/10/and 4/18/without success, but leaving voicemail messages to return her call On 6/26/our adjuster spoke with the insured and confirmed that Ms [redacted] brought the popcorn chicken back to the store complaining that she had chipped her tooth on a piece of the chicken.? The insured found nothing wrong with the chicken, but gave Ms [redacted] a complete refundOn 7/6/our adjuster spoke with Ms [redacted] and obtained the facts of the lossShe advised the claimant that we would need a medical authorization signed so that we could collect her dental records and bills for reviewShe further advised her that we would need a copy of her receipt from the Sonic for that day.? Ms [redacted] agreed to provide both On 7/9/our adjuster called for Ms [redacted] to inquire about the medical authorization and receiptMs [redacted] did not answer and our adjuster left a voicemail messageWe are awaiting the return of the medical authorization and a copy of her receipt to evaluate the claim and finalize our liability position ? ? ? For your reference, details of the offer I reviewed appear below ? I reject this response because when I contacted ***, ? January 8th 2018, [redacted] refused to talk with me and would only go through my lawyer not to mention she was incredibly rude on the phone .Had she done her due diligence and best business practices ? she could have informed me at that time-that the surety bond with ? topproject started in July and we needed to go through the insurance company that held the surety bond ? at the November start date of my project..I could have immediately sent the claim to the responsible party and this would have been a mute point ? but she ? refused to talk to me and wasted my time and my lawyers time She then sent my lawyer a letter in Jan requesting we complete a claim form and another letter in February requesting ? that we respond to [redacted] attourney ? requesting additional documentation and a response from us .this letter to my lawyer I did not get a copy from Ms [redacted] in February asked my lawyer to respond to [redacted] lawyerMs [redacted] had well over days to research and determine that we needed to go to the ? other surety bond company that ? held ? the bond in the time my project startedBut Ms [redacted] sat on the file till May when ? she told my lawyer ***e is not responsible This also exceeds the time that ***e should have responded to the claim per legal requirements ,they left it open well over days no action.In Feb Ms [redacted] asked us to respond to a letter she received from topproject lawyer even though at this time she should have been aware that ***e did not hold the surety bond at the time my project started in November However during the time ***e did hold the surety bond for topproject from July [redacted] at topproject extended the contract by sending me an addendum to the original contract in November to fix the pool and ***e was holding his surety bond at this time so I am angry firstly that Ms [redacted] continued to ask for information from my lawyers initally instead of communicating to us that we needed to go after the other insurance ? company and this cost me well over dollars in legal fees to respond to ms [redacted] requests ? but in addition since ***e held the bond after July and we received an addendum for the fix of the bad work from topproject in November’s they should be held partially accountable Imagine being told to continue to submit additional documentation regarding this claim in February and March ? and then drag this out till May which has severely impacted my statute of limitations for any recovery ? due to [redacted] improper ? handling of this claim And bad business practices even though ***e was aware ? at the time that the client would not be valid because the pool construction happened in prior to [redacted] taking over this surety bond in July for Topproject I am angry because ms [redacted] repeatedly asked ? my lawyer for additional information Which cost me $more instead of her telling my ? lawyer upon receipt of the original claim that we needed to go to the other surety bond company? ? So we ? were led down the amazon river without a paddle so to speak costing me unnecessary expenses ? for which I demand to be reimbursed or I am going to small claims court as I have sufficient documentation toOf only show poor business practises but improper handling of my claim by ***e insurance according to claim procedures mandated by California law.? ? For your reference, details of the offer I reviewed appear below.The adjustor explained to my HR manager I would receive a check every week as long as I am on Workman's CompI have be receiving my pay checks every or 1/weeksI have only spoken to my adjustor a total of times which includes the intake phone callI was also terminated from my job on March 6,not the date of March 1,And retain counsel on February 23,2018, Not March 8,as the adjustor has stated in the response letterIn the months of March and April I have reached out to the adjustor a total of times in all and left message and email to please return my callAnd to this date have never received a call back form any of the calls or messages from this adjustor,
