For your reference, details of the offer I reviewed appear below.I reject the response by *** because ? my lawyer who I hired responded to Mr***‘s letter feb requesting more information and details related to the response by Topproject‘s lawyer this was during the time that when the complaint was originally received she should’ve informed us immediately that *** did not hold Surty bond at the time of the start of my project what they are failing to recognize as well is that the contract was extended by Topproject when I received a letter in November when *** held the ? surety bond that he would complete the work and he didn’t if Swissco does not compensate me the $that they made my lawyer time and money spent on because of their requesting additional information from him I will see you in court

because when I contacted ***, ? January 8th 2018, *** *** refused to talk with me and would only go through my lawyer not to mention she was incredibly rude on the phone .Had she done her due diligence and best business practices ? she could have informed me at that time-that the surety bond with ? topproject started in July and we needed to go through the insurance company that held the surety bond ? at the November start date of my project..I could have immediately sent the claim to the responsible party and this would have been a mute point ? but she ? refused to talk to me and wasted my time and my lawyers time She then sent my lawyer a letter in Jan requesting we complete a claim form and another letter in February requesting ? that we respond to *** *** attourney ? requesting additional documentation and a response from us .this letter to my lawyer I did not get a copy from Ms *** in February asked my lawyer to respond to *** *** lawyerMs *** had well over days to research and determine that we needed to go to the ? other surety bond company that ? held ? the bond in the time my project startedBut Ms *** sat on the file till May when ? she told my lawyer ***e is not responsible This also exceeds the time that ***e should have responded to the claim per legal requirements ,they left it open well over days no action.In Feb Ms *** asked us to respond to a letter she received from topproject lawyer even though at this time she should have been aware that ***e did not hold the surety bond at the time my project started in November However during the time ***e did hold the surety bond for topproject from July *** *** at topproject extended the contract by sending me an addendum to the original contract in November to fix the pool and ***e was holding his surety bond at this time so I am angry firstly that Ms *** continued to ask for information from my lawyers initally instead of communicating to us that we needed to go after the other insurance ? company and this cost me well over dollars in legal fees to respond to ms *** requests ? but in addition since ***e held the bond after July and we received an addendum for the fix of the bad work from topproject in November’s they should be held partially accountable Imagine being told to continue to submit additional documentation regarding this claim in February and March ? and then drag this out till May which has severely impacted my statute of limitations for any recovery ? due to *** improper ? handling of this claim And bad business practices even though ***e was aware ? at the time that the client would not be valid because the pool construction happened in prior to *** taking over this surety bond in July for Topproject I am angry because ms *** repeatedly asked ? my lawyer for additional information Which cost me $more instead of her telling my ? lawyer upon receipt of the original claim that we needed to go to the other surety bond company? ? So we ? were led down the amazon river without a paddle so to speak costing me unnecessary expenses ? for which I demand to be reimbursed or I am going to small claims court as I have sufficient documentation toOf only show poor business practises but improper handling of my claim by ***e insurance according to claim procedures mandated by California law.?

Unfortunately Teri's response does not help at all... and since AmTrust has stopped replying to my e-mails I will be pursuing this matter through the courts.

The most important thing we want is for her to understand her benefits and to make sure she is getting them. However, once we found out she obtained an attorney, we cannot speak directly with her. Her attorney does not like our office to have contact with her directly. We received notice of appearance of the attorney on March 8. We last spoke with Ms. [redacted] on March 6. She may have obtained the attorney before that date, but that is when we found out. This is the reason why she has not been able to speak with her adjuster. We are doing what the lawyer is requesting.
