HAD A TALK WITH *** FORD ABOUT THIS COMPLAINT AND OTHERS THAT MAY COME IN....I SOLD THE CO(PERMA-PIER IN TO SHAWN LAWSONI WAS TO RECEV OYALTIES FOR YEARS UNTIL IN RETURN, I WAS HELD LIABLE FOR ANY REPAIRSAFTER THE ROYALTIES RAN OUT IN MY RESPONSAILTIES WERE AT AN END AND LAWSON & ASSOCIATES PERM-PIER WAS TO TAKE OVER ANY AND ALL BUISNDONE UNDER THE NAME OF PERMA-PIERI DID SOYEARS OF FIXING ANY COMPLAINTS WITHOUT RESERVATION TO THE COSTIT IS NOWL 4-YEARS AFTER MY OBLIGATION TO SERVICE ANY COMPLAINTSIT WOULD BE HARD TO BELIEVE OTHERWISE AS I WOULD NOT LEAVE MYSELF IN A POSITION OF HAVING TO TAKE CARE OF ANY PAST BUISNESS DONE UNDER THAT NAME (PERMA-PIER)....I COULD BE RETIRED NOW AND HOW CAN I BE RESPONSIBLE FOR THE REST OF MY LIFE FOR REPAIR WORK!!! I DO SYPATHIZE WITH THE COMPLAITANT IN THE FACT THAT PERM-PIER, DOING BUISNESS OF MILLION OR MORE EVERY YEAR WOULD SAY OTHERWISE AND SEND THEM OVER TO ME SINCE IT IS THIER TURN TO START LIVING UP TO THLIER RESPOABILITES UNDER THE CONRACT.....IF I WERE STILL RECIEVING ROYALTIES FOR THE PAST 4-YEARS I COULD SEE HOW THIS MIGHT EFFECT THE SITUATION BUT I AM NOT AND HAVE NOTYEARS AGO AND A SMALL COSMETIC SITUATION ON THE COMPLAITAINS PART...THAT IS A STRETCH...BUT IF HE THINKS HE IS ENTITLED BY MYSELF TO CORRECT THE SITUATION SINCE HE IS TRYING TO SELL HIS HOME AND THE BUYER MADE DEMANDS...LET HIM GO TO SHAWN LAWSON AND PERM-PIER TO RESOLVE THE SMALL BREAK-OUT IN CEMENT THAT HE WANTS TO HAVE FILLED IN.....THE SOIL OVER YEARS OF MOVEMENT IN DRY/WET WEATHER CONDITION CAUSED THE HOLE TO SLIP DOWN SOME....BUT THAT IS COSMETICS...I TAKE RESPONSIBILITY FOR THE PIER WORK..NOT COSMETICS OVER THE YEARS...IT CAN HAPPEN.THIS IS THE BEST I HAVE....IF I AM EVER IN THE AREA I HAVE THE COMPLAINTANTS HOME ADDRESS AND WOULD STOP BY FOR MINAND HELP HIM OUT....BUT SENDING A FULLY MANNED CREW OVER TO DO MINOFF RE-DOING THE SURFACE OF A CEMENT BREAK-OUT, NOI AM NOT RESPONSIBLE FOR THAT SMALL OF A FIX THAT HAS NOTHING TO DO ABOUT THE PERFORMANCE OF PIERS NOT WORKING PROPERLY WHICH I DO WARRANTY.THANK YOU FOR BRINGING THIS ALL TO MY ATTENTIOJN*** ***

I have provided the company with everything that he has asked for and sent him a copy of the warranty. I am not the owner of the unit and the owners have not changed in either unit. I am the property manager and his dealings were with Lifescape Villas on Dublin, which is shown on the
warranty. This appears to be just another ploy to avoid honoring the warranty. In his email, sent directly to me, he claims to have a foot injury and would get in touch when he was able. Now he's saying I did not get the necessary documents to him which is a blatant lie. I have attached the email I received from him and my response and a copy of the warranty

This impass to a resolution can be resolved but it takes both parties to listen to one another and address the concerns that can be agreed uponAt this point in time of back and forth accusations of missed calls and unanswered messages are mootHere is what I am willing to doAlthough the contract stipulates in writing that I am not responsible for any floor damage (slab) that point is not valid not only by virtue that the damage was already there in when I first installed piers on the homeOver the years it has had an upheaval because of poor drainage and the result is an uneven crack that was forced up on one sideThat is why all contractors in the buisness all over the metroplex have that exclusionary clause in their contractsIt cannot be controlled by piers, especially if the crack was visible and already done before the work beganI have gone out personally as stated in last response times to make sure and make the complaintant aware of what the causation was and how my piers installed in were still holding thier integretyThe complaintant saw with her own eyes (I took her around with the engequipthat was designed to show the readings on the perimeter beam that was worked onALL areas I have worked on, especially in the bedroom that is concernable, are within fha,va, and hud standardsThese elevations were witnessed by complaintant. Now, as a resolution instead of mistrust and blameI will help the complaintant get a 3rd party engoutside of my business to verify my claim of non-negligence or shoddy workThe cost will be borne by meIt will cost me to do this but I can not figure out another way to convince the complaintant as to the damage she sees as a fault of my work and the true reasons behind the upheavel of the crack and the resulting damage she is incurringIf there were a way I could correct it with additional piers I would do so for her.I am open at this point for any suggestions she may have but cannot work with her if she refuses to do so. Waiting for a response call me *** anytime*** *** (Owner) Anchor Foundation

Reasons for rejecting response are: Information in his response is incoherent*** *** in Fort Worth (the home he send a diagram of) has absolutely nothing to do with usNot our houseNot our nameNot usMr*** continues to state that he has nothing to do with the foundation on the house in Irving even though we have his signature on more than one document that states we purchased a transferrable LIFETIME warrantyIn his mind, it is everybody's fault but hisEven went so far as to place blame on the people that chose him originallyTheir mistake that we are now paying for
We will be filing a complaint in the applicable court of lawThis is NOT how good businesses do business

THE CUSTOMER WAS SENT A WARRANTY VIA EMAIL...THEY RESPONDED THAT THEY HAVE RECIEVED...ASKED THEM TO LET YOU KNOW BUT MOST DONT BOTHER ONCE THE COMPLAINT IS TAKEN CARE OF....CAN CALL HER AT THE NUMBER SHE HAS PROVIDED AND VERIFY...THANK YOU*** *** 11-6-

SINCE THIS WAS DONE UNDER PERMA-PIER YEARS AGO...I HAVE NO RESPONSIBILITY TO HONOR THE WARRANTY...THE REASON HE CALLED *** AND NOT MYSELF IS THAT THAT WORK WAS DONE UNDER PERMA-PIER...I WAS HELD RESPONSIBLE WHEN I SOLD THE COFOR REPAIR WORK FROM TO YEARS BECAUSE I WAS
RECEIVING ROYALTIESAND I DID HONOR THE WARRANTY WORK FOR YEARS....NO MORE! YOU KNOW OF THE PROBLEMS INCURED DURING THAT TIME ALSO ***..COMMON NOW....THE DRIVEWAY WAS PATCHED WITH CEMENT YEARS AGO!!!! I WILL NOT DISPUTE THAT IT TOOK 3 WEEKS TO SERVICE 1ST VISIT TO MS. [redacted] TOOK 3 WEEKS. I DID INFORM HER THAT I HAD HEALTH ISSUE (HOSPITALIZATION) AND THAT I WOULD RESPOND AS BEST CAN UNDER CIRCUMSTANCES. THE SECOND VISIT WAS MADE (UNINVITED) AS MS. [redacted] WOULD NOT ANSWER MY CALLS NOR MESSAGES...

ON PHONE OR TEXTS. THAT IS THE REASON I WENT TO HER HOME (UN-ANNOUNCED). I CAN ONLY SPECULATE ON MOTIVES AFTER 1ST VISIT BECAUSE SHE SENT A CERTIFIED LETTER INSTEAD ON ANSWERING MY CALLS TO COME BACK OUT AGAIN. I SPECULATED THAT THIS WAS GOING TO BE A PROBLEM AND I SHOULD RESOLVE. THAT IS WHY I JUST WENT OUT TO HER HOME ON THE CHANCE SHE MAY BE THERE.TO THE ROOT OF THE PROBLEM. IN 2013 ON OUR INITIAL INSPECTION IT WAS FOUND THAT THE REAR BEDROOM WHICH IS HER MAIN CONCERN WAS DOWN SEVERELY. WHEN THE ELEVATIONS WERE TAKEN THE HOMES PERIMETER BEAM WAS DOWN A NEGATIVE 5 INCHES. THAT WAS OF MAJOR CONCERN AND I POINTED OUT THAT THE CRACKS IN SHEETROCK AND FLOORING WERE AGGRAVATED BECAUSE OF HER NEGLECTING TO INITIATE A FIX A LITTLE SOONER. I ALSO INFORMED HER THAT I COULD STOP THE DESTRUCTION BY INSTALLING PIERS ON THE PERIMETER GRADE BEAM AND WOULD GET IT UP TO WITHIN A -1 INCH LEVEL. IT TOOK 14 PIERS ESPECIALLY IN THE REAR BEDROOM ARE TO CORRECT. I ALSO INFORMED HER THAT THE CRACK IN THE MIDDLE OF THE BEDROOM FLOORING WOULD/COULD NOT BE REPAIRED WITH PIERS. ONCE AN 8 INCH SLAB IS CRACKED IT WILL FOREVER REMAIN THAT WAY. THE JOB WAS DONE AND FOR 4 YEARS I HAD NOT HEARD OF ANY PROBLEMS. WHEN SHE WENT TO SELL THE HOME SHE WAS HAVING A HARD TIME BECAUSE THE CRACK IN THE MIDDLE OF THE BEDROOM FLOOR HAD ELEVATED ALMOST 1/2 INCHES. THE PROBLEM BEING THAT ONE SIDE OF THE CRACK WAS ELEVATED TO TO POOR DRAINAGE ON REAR OF HOME AND ACCESSIVE RAINFALL THIS YEAR. THE SOIL UNDER THE SLAB WAS PRONE TO EXPAND WITH THE MOISTURE AND DRAINAGE PROBLEM. THIS IS NOT SOMETHING THAT I CAN CORRECT WITH PIER WORK. AND ON MY FIRST VISIT TO RE-ASSESS THE PIERS TO SEE IF THEY HAD FAILED, THERE WAS NO MOVEMENT FROM THE DAY I INSTALLED THE PIERS AND THEIR POSITIONING 4 YEARS LATER. I EVEN HAD MS. [redacted] GO AROUND THE BEDROOM PERIMETER WITH ME AND CHECK THE READINGS. ALL READINGS INDICATED THAT MY WORK WAS STILL HOLDING THEIR INTEGRITY AT -1/2 TO 1 INCH. THAT WAS THE READING WE TOOK AS AN AFTER REPORT DONE IN 2013. NO MOVEMENT. 2 WEEKS OR SO IS WHEN SHE CALLED ME TO COME BACK AGAIN AND RE-CHECK THE ELEVATIONS, STILL NOT CONVINCED THAT IT WAS THE PIERS FAILING THAT HAD CAUSED THE CRACKED SLAB TO GET UNEVEN 4 YEARS LATER CAUSING A RIDGE OF 1/2 INCHES. AGAIN I HAD HER LOOK AT THE NUMBERS ON THE LEVELER AND AGAIN IT SHOWED THE SAME READINGS AS THE FIRST TIME. AND AGAIN I EXPLAINED WHAT THE CAUSE MOST LIKELY WAS (EXCESSIVE MOISTURE DUE TO RAIN AND DRAINAGE) AND SUGGESTED SOMEONE WHO DEALT WITH SLAB LEAKS WHICH IS A WHOLE DIFFERENT BALLGAME THAT ELEVATING BEAMS ON THE PERIMETER. I COULD SEE THAT EVEN ON THE SECOND VISIT AND SEEING THE ELEVATION READINGS FOR HERSELF, SHE WAS STILL NOT BELIEVING WHAT THE PROBLEM WAS.IT IS MY SPECULATION THAT WITH SENDING A CERTIFIED LETTER TO ME AND NOT ANSWERING THE MESSAGES OR CALLS FROM ME TO SET TIME/DAY FOR A SECOND EVALUATION THAT THERE WAS NO WAY SHE WAS GOING TO BELIEVE ME THAT IT WAS NOT DUE TO PIER FAILURE. THAT IS MOSTLY THE REASON THAT I HAVE TO DEFEND MYSELF WITH ANSWERING THIS COMPLAINT. FLAT OUT, I CANNOT CORRECT A CRACKED SLAB WITH PIER WORK, AND MY PIERS INITIALLY INSTALLED ARE HOLDING THE INTEGRITY. SHE NEEDS TO CONTACT A CEMENT/SLAB CO. TO COME OUT AND SEE WHAT THEY MIGHT DO FOR HER. I KNOW THAT SELLING A HOME WITH THE PROBLEM SHE HAS IS GOING TO BE TOUGH. BUT MY CO. AND MYSELF ARE NOT AT ALL HOW SHE PORTRAYS IT OR ME. IF I COULD HAVE HELPED IN ANY WAY I WOULD HONOR MY WARRANTY. THERE IS NOTHING FOR ME TO DO. I HOPE SHE GETS HER PROBLEM RESOLVED WITH A SLAB/CEMENT CO. AND SELLS HER HOME AND WISH HER THE BEST.SINCERELY,[redacted] (OWNER) ANCHOR FOUNDATION CO.W

when I contacted perma pier about this they gave me [redacted]'s  name and number and that's who I spoke with about this issue he never asked me to call anyone else.
if not [redacted]r(who sat down at my kitchen table and sold me on using his company) who owned perma pier at the time then sold his company, then who is responsible for the lifetime warranty now? perma pier say's its not theirs because it was with the previous owner
where they patched the concrete is in the middle of the drive way at the garage, there has been no cars driving over this patch because I don't use the garage for vehicles, only traffic over that area is foot traffic and yes it has taken this long for the concrete to fail
tried to attach copy of their warranty but for some reason wont let me, that say's and I Quote again" this warranty includes labor and material on all of the work performed"  they cut a hole in my driveway and then poured concrete back....to me that is worked performed.
if they had used a hand tamper when they replaced the dirt and used  rebar and tied it into the existing drive way(which is recommended for holes bigger than 14"x14") to reinforce the new concrete instead of just pouring it into a 30"x30" hole and walking away we  wouldn't be having this issue now( surprised it lasted as long as it did)
not trying to sullies any one's business just want the man that shook my hand and offered a lifetime warranty on all work performed to hold up to his end of the agreement, nothing more and nothing less
