Complaint: [redacted] I am rejecting this response because: Let me start with I did receive the letter that you received from Apex portraying me to be abusive to their employees,and having no knowledge of what their business is about, and that the case as your organization sees it, is closedBut as I see it you do not have all of the informationPlease bear with me because you will probable read some things you have already read, but , you are also gonna read some things you have not already readI am taking these things out of a note book of which I have everything recordedI am however am going to, so as not to bore you or waste your time, condense a few things so they will not be in order as I have them written in my nnotebookI feel this is necessary for you to see what I am dealing with I am starting this on May the Ninth to show the pattern the company has developedThe roof was completed in January I might add that a gentleman maned [redacted] was sent to my house and he saw the problem with our roofAnd we have pictures of flashing being on my roof between the roof and patio cover, taken by [redacted] , and by [redacted] who told my wife and myself that his title was project manager, but whom the company portrays him to be simply a sales manAnd even though it is not specifically referred to in the contract, the contract does say to remove and replace the entire roof systemAnd I did contact the insurance company and asked why there was no mention of paying for the flashing in the proceeds from the insurance companyI was told by [redacted] that unless the flashing was damaged by the storm, they expected the flashing to be reusedSo that means that Apex was supposed to salvage the flashing and replace it with the new roof systemAnd as I previously stated we have pictures ta [redacted] by [redacted] and by [redacted] ***,prior to roof removal and we took pictures of the same area after roof system replacement and there is no flashingSo there is no other way to read the outcome but the company, Apex, has not completed their work May 9th [redacted] called me and told me they would be out to fix my roof either today or tomorrow, that tells me that they did know of the problem and were going to take care of itMe being a considerate person told him that it was raining that day and should not come because, even though Apex says I have no knowledge of what they do, I do have enough knowledge that I knew that a few rows of shingles in that area will have to be removed to put down flashing and I do have enough knowledge to know you shouldn't remove shingles when it is rainingAnd there is no reason for them to waste a trip just to find out it is raining,and I told [redacted] to call me tomorrow and I will tell them if it was rainingBut I received no call the next day from Apex to find out if it was rainingIn fact I did not recieve any communication from any one until June 7thWhen I received a call from [redacted] She did not identify herself as a lawyerI did not find that out until some time laterShe wanted to get the payment schedule set back upAt that point in time, I thought that Apex must have gotten them a new accountantThe reason I thought that was At the time of final payment from the insurance company, I had been told over and over that final payment from the insurance would not come until the end of the jobAnd there was a conversation between myself and [redacted] about having to replace the plywood on the entire roof to bring it up to codeAnd as it had been the entire length of the job, there was no communication between Apex and myselfThey were supposedly handling everything, which was ignorant, because the [redacted] pays me and then I pay ApexSo when I received the final payment in December, I had no Idea that that was the final payment because the roof had not been put on yetAnd I have a friend that stocks all of the stores for a major home improvement store chain.who told me if at any time I need a truckload of supplies to call him and I could get rock bottom prices.So with no communication between Apex and myself and the last conversation between [redacted] and myself I thought the big check was for plywood for the entire roofAnd I was prepared to let Apex benefit from my friends offer by supplying a truckload of plywood cheapSo I spent some of the moneyI hadn't worked in a couple of years because of health reasonsBut alas that was not the caseSo when the roof was installed, and I didn't have the funds for final payment, I asked their accountant how much time I could have.to payShe told me I could pay out over four months.And the total was a little over $She told me she would send me paperwork for me to sign and send back stating how much the payments would be and for how longWhen I received the paper work it said I had to make four payments of over $apieceI called [redacted] in the billing department and asked where their accountant went to school, because where I went to school into didn't come out to over He agreed and told me to pencil in the correct amountBut before I sent the paperwork back we discovered the leakThat is why when [redacted] called, and did not identify herself as an attorney I thought it was a new accountantSo Apex had not contacted me until Ms [redacted] called on June 7th I even asked Ms [redacted] to please have the owner of the company call meI was very polite and told her that in my plus years in the construction industry I have never met an owner who had no interest in talking to the people who pay his salary, so surely he must not be getting my requests to talk to him June 12th I called [redacted] and asked him to call me at his earliest convenienceI received no call backThis is also the day I first made a complaint to you, The Revdex.com June 12th thru the 23rdno response from Apex at allBut we did receive a letter from a lawyer firm here in San AntonioIn it, Ms [redacted] asked for immediate payments to be set up and she told me not to contact the company or any of its employees any longerAll of my communication was to be done through herI immediately called her and asked her what was going onShe explained that because I refused to make payments that I was in default of the contractI told her that I had not refused to make payments to Apex just to be contrary, but that I am refusing to make payments to Apex because the work had not been completedAnd I proceeded to tell her that the job had not been completed in January, and that [redacted] knows that the job had not been completedMs [redacted] said that she was not informed that the job wasn't finished and that she would get to the bottom of the problemI again, told her, I am not refusing to pay,for the job, but I am refusing to pay until the job is completedShe said she would get back to me From June 23rd through July 16th there was no word from Apex or [redacted] On the 17th of July I called Ms [redacted] againI was transferred to ***, an assistant to Ms [redacted] .I told [redacted] that in the letter I received from them I was instructed not to contact Apex, and that it had rained and we still have a leak, and that they would be hearing from me every time it rained until the leak was fixedThis was about 1:PMI asked her to please have [redacted] call meAt 4:PM I called Ms [redacted] back only to be told she was away from her deskI left her a voice mail telling her she would be hearing from me every time it rained until Apex completed the job On July 18th I called for Ms [redacted] againThis time I got the lawyer who was handling the case, Ms [redacted] Imagine my surprise when I found out what I thought had been Apex's new accountant, was in fact a lawyer.I asked her why she had not identified herself as a lawyer when we first spoke on June 7thAll she could say was she was sorryThat kinda goes without saying! I then asked her what was going onShe said she did not know but would contact her client Apex and find outI will say one thing for her she did get back to me later that day, saying that her client, Apex Construction would settle for dollars more and would then consider the job completeI told her I am paying no more money for an incomplete jobAnd I told her that with all that I have written in my notebook I was ready to go to court anytime they wanted toHow about tomorrow? We hung up, and after talking to my wife I called her back and made a counter offerI told her that with a noterized letter releasing us from any more financial responsibility to Apex,and that their year guarantee would still be in effect, as per the original contract, that I would accept that from ApexShe said she didn't think Apex would agree to that, but she would ask themI said if they don't accept then I will see you in courtShe said she would get back to me On July I was reviewing the estimate from [redacted] and did not find anything in it about paying for flashingI called [redacted] , the person who had been handling my case to ask about itI had to leave a voice mailThere was no response On July 29th I received a call from [redacted] It was not from [redacted] but from another specialist from [redacted] She told me that the reason there was no allowance for the flashing in the estimate was if the flashing wasn't damaged by the storm, [redacted] expected the company to salvage the flashing from the original roof and reuse itwell apparently that didn't happenBecause as I previously statedwe have pictures from [redacted] and [redacted] before roof replacement, showing the flashing there, and we have pictures taken by us after roof construction, showing no flashingAnd even though there is no specific mention of the flashing in the contract, the phrase, " the complete removal and replacement of the entire roof system," should be enough to cover the reuse of the existing flashingOf course as Apex so plainly put it I am not an expert in this field! But I am not the dummy, as they so plainly are! You see the problem with Apex starts at the top and flows all the way to the bottom! And we are not quite done! On the 31st of July I called [redacted] I asked her why I had no reply from her or Apex about my counter offerI told her It was July 18th since we last spoke and now it is the 31stI asked her if she thought that was ample time for a reply from her client? She assured me it was and she was e-mailing them as we spoke Finally oh the 7th of August I received a call from [redacted] at Apex asking for me to call him backI returned his call and he told me he was aware of a problem we had and asked if I could bring him up to speedHe said he was in " Regards, [redacted] ***

Roof is incomplete, rodents damaged attic because of holes not sealed properlyWe have had to pay over $to fix this problemI’ve reached out to ***  [redacted]  and he has failed to contact me back about these issues*** and I had been keeping in touch to try and solve these issues but now the communication on his side has stoppedI’ve tried to reach out to him via email and phone calls but he has not responded I’ve sent him invoices and pictures of the damage, along with a copy of his company’s roof inspection letter stating that the roof is complete and up to standard, which it is notI cannot wait anymore and I need to have my gutters fixed as wellThere is gaps along the screens they put in

Complaint: [redacted] I am rejecting this response because: As stated on the original complaint, and not addressed on their response Payment had been made to them according to the fees and expenses they had accruedWe received a final payment in the mail that was almost a thousand dollars over the amount explained to us as cost When we I quoted as to why, we were just told that was their expense We asked if they would speak to our insurance, as they had done IThe past, to explain the cost and we're told that that was the fees we needed to pay out of pocket Please read the initial response and review our wishes for a resolution The details you addressed were part of the complaint because although you have those issues outlined in your contracts, your salesperson and sales team continuously misrepresented your capabilities and service I think that as a company you should properly equip your sales staff to provide correct I formation in order to manage realistic expectations I believe that a complaint to the Revdex.com is warranted, especially after viewing other people's reviews since the bad service we received Your company has to be held accountable for its inefficiencies Regards, [redacted]

Complaint: [redacted] I am rejecting this response because:If anyone was recalcitrant and non-communicative, it was ApexI have call logs that show we tried to call for status updates often In a letter welcoming us as customers, Apex states "We will call you as soon as possible with work start dates." Apex rarely, if ever, called to give us status updates or work start dates That is why we called, and were always given the runaround as to when materials would arrive and when the project could be started and completedApex claimed that the insurance company was holding them back I immediately got on the phone with my insurance company who claimed they have not seen any paperwork from Apex So I called Apex again and spoke with a "manager" The paper work suddenly shows up in the insurance company queue and was processed that day Again, Apex is making up a story, as seen in many complaints on Revdex.com and Google.The start date of the contract was JUNE, and Apex never delivered so much as a nail to the property Come November, we are getting more frustrated with the lack of response from Apex to get this project completed We paid a premium to get the work started in summer and it was now nearly winterBefore we started calling as often as we did, we gave Apex a generous grace period before questioning their integrity and business ethic.We finally asked Apex to give us a written statement on when the materials would be delivered and when the job would start I have an email from " [redacted] " on 12/2/that states we would get materials on 12/15/ That date came and went without a word from anyone within Apex as to why they failed to deliver [redacted] from the front office called my wife to get the gate code, it was passed back, consent was there to deliver.It wasn't until my wife started asking standard questions about our project, that things became escalated to Apex's legal counselApex could never tell us who the owner was, who the management was or who really worked at these offices listed on their website.We called one location and found out that it was a software company, who constantly got calls about roofing because this address was listed on the Apex website This made us question the legitimacy of the business and this is when we decided to call the city and police to figure out next steps This is the time when Apex decided to hire counsel, because we were asking real questions that couldn't be answered by management or the owner The certified letter from counsel put words into my wife's mouth At no time did we say we would reject the work being done or materials being delivered Law enforcement and city officials advised that we do not allow Apex onto the property at this pointWe asked for proof from Apex that they are still insured and certified to work on roofing (paperwork was included in the folder when we signed the contract that shows both expired between the time we signed the contract and December)We gave Apex plenty of leeway but were never given respect when calling to inquire about statusThe front desk workers ended up being lost in their own process, management was belligerent when we wanted information and the owner told us "I don't deal with small fry customers".We were told by both the management and owner that we were not worth the time to deal with - "It's not fruitful to live in the past" is the response we consistently got Regards, [redacted] ***

This Better Business response is made in response to the baseless complaints made by Mrand Mrs*** against Apex Construction (hereinafter “Apex”) on March 14, Since the inception of their contract with Apex, the *** have been recalcitrant, non-communicative, and have caused Apex to incur unnecessary legal fees. On June 8, 2016, Mrand Mrs*** entered into a contract with Apex in relation to the property located at *** *** *** ** *** *** *** *** *** Pursuant to the contract, Apex was to perform the removal and replacement of their roofApex made repeated attempts to communicate with the *** in order to begin working on their roof Apex was unable to begin working on the *** roof because they obstructed its ability to deliver materials and to access their property After numerous failed attempts to begin work and the *** failure to cooperate, Apex was forced to expend resources and retain legal counsel. On December 12, 2016, Apex’s legal counsel contacted the *** and requested they contact her to confirm a date they would allow Apex access to their property to deliver materials and perform the roofing work After no response from the ***, on December 20, 2016, Apex’s legal counsel sent the *** a certified letter The letter provided that it had been over a week since the December 12th conversation and the *** had never confirmed with Apex’s legal counsel whether they would allow Apex to commence the roofing work The letter further advised that Apex remained available to perform the work as contracted, and would like to deliver the materials to their residence and begin work as soon as possible The only thing holding up the work was the ***’complete failure to consent to Apex’s accessing the property After repeated attempts to communicate with no response, Apex sent a second certified letter on January 11, In said letter, the *** were advised that Apex remained willing to perform the roof work and was simply waiting on the *** approval to get started In the letter, the *** were advised that the only impediment to commencement was their lack of cooperation and the longer they refused to commence and grant access, the longer the job would be delayed Because the certified letter that was sent on January 11, 2017, was never picked up by the ***, Apex’s counsel sent the letter by regular U.Smail and it was never returned, indicating the *** received it, however; once again, there was no response Unfortunately, due to the lack of consent and access to the property, the project never began and Apex only incurred additional attorney’s fees To date, Apex remains willing to work with the *** and perform its contractual obligation

Apex Construction Services, LLC was referred to me by my property management company, Liberty Property Management, to inspect my roof after the hail storm in April *** *** was the Project Manager who was working with me and send me information that my roof was badly damaged and need to have a complete roof replacement *** was very friendly and worked with me over the phone and through e-mail and help going over the damage with my insurance company USAA to show them the damage and got USAA to reimburse me for the roof damage Since I don't live in Texas, *** assured me that all I need was to send the money to Liberty Management and when the roof replacement is completed, she will present the Certificate of Completion to my property management in order to collect the fee *** told me that my roof was severely damaged and time is an essence in a complete replacement and to prevent any interior damage *** assured me that she will work with my property manager in

Took them over months to do my roofing when I was told it would of been done in weeksThere was no communication and I had to keep calling to find out what was going onThey kept giving estimated dates on when materials were going to arrive Once I called them to cancel services after many times of dealing with their lies, they tried telling me there would be a fee for 15% of total cost but to be patient as the materials were on the truck ready to be shipped Once installation was complete, I was billed almost a thousand dollars over the original and revised quote and would no longer negotiate with my insurance to cover the additional cost Because we were unable to pay, they have threatened with their lawyers, who have sent a collection notice with a threat to put a lien on the house unless debt is payed in full within days

*** ***Just want to inform Revdex.com that the someone who called on behalf or as owner of Apex, was so angry that he called to yell at me and falsely accused me and my property manager for refusing to pay them when in fact, I had to tell him to look at the nature of my complaint and that I had contacted Apex by e-mail and phone both on cell and company phone for *** ***, project manager and after almost 1/month of no reply from Apex is why I contacted Revdex.com with the complaint My property manager, *** *** *** at Liberty property Management and I both have not received any e-mail or contact from Apex at all and only after Revdex.com has sent them my complaint did I receive a one line reply that my roof has been done My property manager had to sent another company to get a bid and due to the honesty of the 2nd company, who told us that the roof didn't need work because it looks like it is only about 1-year old There were area of concern that Apex was made known about and we are now working on the finalization of invoice, get a certificate of Completion, warranty and any other paperworks that I am leaving for my property manager to received before she will make the payment We just want to let you know that the man who called to yell and accuse me of refusing to pay him, jumped from being angry with my complain, to accusing my property manager for refusing to pay and then accusing me for refusing to pay when I tried to tell him that I was trying to find out what happened to my roof and if his people would have called or e-mailed me back, this would have not happened Apex despite falsely accusing me of refusing to pay, threatened to go to small claim court and file lien against my house and this is how they treat their customer when they failed to communicate and was upset that I complain about them not replying or communicate with me

We contracted with Apex to replace our roof following hail damage in The work was completed in We hired an inspector to review the work, and had to call Apex back out to correct a number of issuesLast month (Sept2018), we began experiencing a significant leak in our roof that is letting water into our attic and garageWhen we tried to contact Apex, we learned the company is no longer in existenceThus, we are unable to request repairs via a warrantyThe repairs are estimated to cost us nearly $4,for the roof alone (not counting repairs to framing, sheetrock, insulation, etc.)

Apex came to my house on July of on asking me if I needed my roof to be doneI have them a chance and was told it would be done within weeksafter signing the contract and me giving them my deposit, I waited and called them back after the 8th week asking them what's going on with my roof getting doneThey had told me that I needed to call my insurance company to get something approved which I was upset that Apex waited for me to call them for me to find out about thisSo I called my insurance and took care of it that dayI called Apex back and they said order will be placeI called again in December asking AGAIN about my roof and then they said order is been placed and should arrive by January 26-February I called AGAIN and their Secretary kept telling me they were busy and someone would call me backThat day I called times hours apart they kept telling me they would call me backNo one called me back That daySo the next day I called them AGAIN to tell t

the 3rd week they came to the correct houseWe scheduled work for Fri Sept 2nd but per Nolan material was not in stock and had to be orderedNolan was very rude in speaking to me and my wife so I asked to talk with a manager and was transferred to JeffJeff assured me he was talking over the project and the work would start on Fri Sept 9thJeff called the day before to ensure the work would start on Sept 9thFriday Sept 9th APEX did show up no call received so we called Jeff back who stated the material was on hold but the roofers had already started the projectRoofers left around 3pm with half my roof missingI received a call from APEX on Saturday evening stating they would be here Sunday morningI explained again that I work from home and if they could finish, she agreedSunday roofers didn't show until around 3pm and explained the materials was still on the truck and asked them to return around noonI told them I was sorry but I had to work on Monday so they had to return on Friday Sept 16thI called APEX again on Monday Sept 12th asking to speak with managementCalled twice and both times the receptionist stated they would give the message directly to the VP/ ManagerNo call receivedCalled back today Tues Sept 13th and Mangers are in a meeting again they would give the message to call me backI then called our Sale agent Peter about timesAmanda picked up and assured me she would have Mike from a Area Code call me and APEX would make it rightMike called me and spoke with my wife who was beyond rudeMy wife cried and handed to phone over to meMike was ranting stating we Roof is incomplete, rodents damaged attic because of holes not sealed properlyWe have had to pay over $to fix this problemI’ve reached out to *** *** and he has failed to contact me back about these issues*** and I had been keeping in touch to try and solve these issues but now the communication on his side has stoppedI’ve tried to reach out to him via email and phone calls but he has not responded I’ve sent him invoices and pictures of the damage, along with a copy of his company’s roof inspection letter stating that the roof is complete and up to standard, which it is notI cannot wait anymore and I need to have my gutters fixed as wellThere is gaps along the screens they put in

Having a roof replaced is a major concern for a home owner Knowing there are so many roofers in the business, one experiences some angst about having a crew that is totally qualified and a crew that takes pride in the finished product I am particularly interested in maintaining my home to meet or exceed neighborhood standardsI didn't know the Apex people until their representative came to the house and demonstrated an in depth knowledge about roofing I signed a commitment to give them the contract, but later thought I might have been too hasty so I called Apex's owner, MrKinchey to back off He was very nice - he told me it would be no problem; that I could choose any company I wished to to the work and to disregard the written commitment I eventually contracted with Apex to do the roof and was very pleased with the resultThey installed ridge vents and replaced all pipe covers and heater vent They sprayed painted each pipe to match the roof and the shingles were installed flawlessly After the job was completed, within an hour the debris was cleaned up - I couldn't find a nail or shingle scrap anywhere I am proud to show off my new roof, it improved the original look of the home

Apex’s Revdex.com ResponseThis Revdex.com (“Revdex.com”) response is intended to respond to the unfounded Revdex.com complaint made by *** *** (“Mr***”) against Apex Construction (hereinafter “Apex”) on June 12, On September 27, 2016, Mr*** entered into a contract with Apex in
relation to the property located at *** *** *** in *** ***, Bexar County, Texas Pursuant to the contract, Apex was to perform the removal and replacement of their roof Apex had agreed to repair his carport, as a courtesy Apex was ultimately unable to do this work and issued a credit to Mr*** for said work Thereafter, final payment in the sum of $1,became due and owning upon completion of the work, and an invoice for final payment in the sum of $1,was submitted to him for payment on or about January 16, Based on review of the Revdex.com complaint, Mr*** contends that there is a leak between the roof and the patio/carport because there is no flashing between the roof and the patio cover, however, Mr*** is not a roofing expert and has no business opining as to causation of an alleged leakFurther, the shingled roof on Mr***’s home was replaced by Apex and the flat carport roof was replaced by a different contractor It is Apex’s position that the shingled roof was built properly and is not the source of leak, especially given the fact that the leak was present before Apex did any work. *** *** (“Mr***”) (the Apex salesman who worked with Mr***) went back to Mr***’s home on April 26, 2017, to try and seal the leak with caulking Mr*** indicated that he was upset due to the length of time that it took Apex to seal the leaking since he reported the leaking on March 13, Between the times that Mr*** reported the leak and the time that Mr*** came out to inspect and seal the leakage, Apex sent a roofer out to Mr***’s property on at least one occasion to inspect and figure out the issue since the leak was not the result of Apex’s shingled roof Additionally, it was difficult to quickly address the issue because Mr*** had particular specifications as to how he wanted to the work performed After Mr*** repaired the leak, Mr*** began to call Apex’s office repeatedly and demanded to talk with Apex’s owner At this time he refused to talk with *** ***, a production manager for Apex who was Mr***’s main contact, (“Mr***”) Mr*** used profane language with Mr*** and other Apex employees and became increasingly verbally abusive and threatening Mr***, who had been Mr***’s main contact, always returned Mr***’s phone calls in a timely manner until Mr*** suddenly refused to speak to him Apex performed its contractual obligations and as a result Mr*** received a new roof Moreover, Mr*** should perform his end of the bargain and adequately compensate Apex for its services

My elderly mom's house was recently effected by the storm that came through San AntonioAs the manager of her household, I found out that there was a lot of damage to her roofing and gutters that needed to be repaired We contacted a lot of local companies and was very pleased with Apex The representative Steve that came out was very friendly and professionalHe answered all of our questionsThe crew was very clean and friendly and did excellent workI was really happy and so was my mom!

Apex Construction replaced our roof in the fall of The roof has a year warrantyIn the months immediately following the roof replacement, there were a number of leaks in one areaAfter several attempts to contact, they came and fixed the leaks and later repainted all of the damaged internal ceiling as wellThis fall, two years after installation, the same leaks that were repaired are backThe phone numbers listed on my warranty, the business cards and the contract papers are all disconnected and it took me several searches to find a working number to the companyPhone calls go to an answering machine and calls are not returned

Would not recommend this company While they were helpful in filing the claim, they never returned calls, refused to send a superintendent to the site when we requested and also refused to let us talk to oneDamaged gutters, plants and did not supervise their workers Believe the only reason they finally corrected issues and finished the work was because we told them they would not get final payment until everything was corrected Two months later and we are still waiting for signed warranty certificate
