Apex Construction replaced my roof in April Their roofing warranty states "All Materials are guaranteed under the Manufacturer's warranty and the Company further warrants that any roofing home improvements shall be free from all defects caused by faulty workmanship for a period of ten (10) years from the date of installation." I have several leaks in my roof and have made multiple calls (starting 10/24/through 11/14/18) requesting repairs to be made and have yet to have someone return my call or come by to make the necessary repairs

I had a great experience with Apex Construction putting a new roof on my houseCustomer service was excellent; Apex went above and beyond what they needed to doWe were in the process of moving and needed to have the work done quickly to have the house ready for the new ownersThe employees at Apex could have told us that the timeframe was unrealistic, but not only were they confident that they could get the work done in time, they were able to complete the roof--which looks great--earlier than expected! I would definitely recommend this company to anyone who needs to have their roof replaced

Don't do business with Apex Construction I made the mistake of using them before I checked them out At first glance they looked like a great company When I meet with the salesperson Peter, I was told my roof would be done by the first of the year: this was October I made numerous calls to the company to ascertain what the status was I was shuffled to Meagan, a very rude and could care less attitude that stated my roof would be done by the first of Feb I went ballistic My neighbors were getting their roofs done in a month....I asked the personnel installing the roofs how did they get their shingles so fast as mine was taking ions They said it's based on the company you go with Many laughed when I mentioned Apex, and stated youllbe waiting monthswell it's going to be that long I called today and was told my roof is scheduled for Feb and they have to days to finish it, which puts it into March, however that's if nothing happensso they have my check and my hands are tied I would cancel but they charge 15% to cancel and that equates to $so yes I'm screwed They never call you, don't follow through, etchad they been honest in the first place and told me hey it's a month waitcool, but they didn't Don't use themif you do you'll be sorry!!!

This Better Business response is made in response to the baseless complaints made by Mr. and Mrs. [redacted] against Apex Construction (hereinafter “Apex”) on March 14, 2017.  Since the inception of their contract with Apex, the [redacted] have been recalcitrant, non-communicative, and have caused Apex...

to incur unnecessary legal fees. On June 8, 2016, Mr. and Mrs. [redacted] entered into a contract with Apex in relation to the property located at [redacted].  Pursuant to the contract, Apex was to perform the removal and replacement of their roof. Apex made repeated attempts to communicate with the [redacted] in order to begin working on their roof.  Apex was unable to begin working on the [redacted] roof because they obstructed its ability to deliver materials and to access their property.  After numerous failed attempts to begin work and the [redacted] failure to cooperate, Apex was forced to expend resources and retain legal counsel.  On December 12, 2016, Apex’s legal counsel contacted the [redacted] and requested they contact her to confirm a date they would allow Apex access to their property to deliver materials and perform the roofing work.  After no response from the [redacted], on December 20, 2016, Apex’s legal counsel sent the [redacted] a certified letter.  The letter provided that it had been over a week since the December 12th conversation and the [redacted] had never confirmed with Apex’s legal counsel whether they would allow Apex to commence the roofing work.  The letter further advised that Apex remained available to perform the work as contracted, and would like to deliver the materials to their residence and begin work as soon as possible.  The only thing holding up the work was the [redacted]’complete failure to consent to Apex’s accessing the property.  After repeated attempts to communicate with no response, Apex sent a second certified letter on January 11, 2017.  In said letter, the [redacted] were advised that Apex remained willing to perform the roof work and was simply waiting on the [redacted] approval to get started.  In the letter, the [redacted] were advised that the only impediment to commencement was their lack of cooperation and the longer they refused to commence and grant access, the longer the job would be delayed.  Because the certified letter that was sent on January 11, 2017, was never picked up by the [redacted], Apex’s counsel sent the letter by regular U.S. mail and it was never returned, indicating the [redacted] received it, however; once again, there was no response.    Unfortunately, due to the lack of consent and access to the property, the project never began and Apex only incurred additional attorney’s fees.  To date, Apex remains willing to work with the [redacted] and perform its contractual obligation.

I am rejecting this response because:If anyone was recalcitrant and non-communicative, it was Apex. I have call logs that show we tried to call for status updates often.  In a letter welcoming us as customers, Apex states "We will call you as soon as possible with work start dates."  Apex rarely, if ever, called to give us status updates or work start dates.  That is why we called, and were always given the runaround as to when materials would arrive and when the project could be started and completed. Apex claimed that the insurance company was holding them back.  I immediately got on the phone with my insurance company who claimed they have not seen any paperwork from Apex.  So I called Apex again and spoke with a "manager".  The paper work suddenly shows up in the insurance company queue and was processed that day.  Again, Apex is making up a story, as seen in many complaints on Revdex.com and Google.The start date of the contract was JUNE, and Apex never delivered so much as a nail to the property.  Come November, we are getting more frustrated with the lack of response from Apex to get this project completed.  We paid a premium to get the work started in summer and it was now nearly winter. Before we started calling as often as we did, we gave Apex a generous grace period before questioning their integrity and business ethic.We finally asked Apex to give us a written statement on when the materials would be delivered and when the job would start.  I have an email from "[redacted]" on 12/2/16 that states we would get materials on 12/15/16.  That date came and went without a word from anyone within Apex as to why they failed to deliver.  [redacted] from the front office called my wife to get the gate code, it was passed back, consent was there to deliver.It wasn't until my wife started asking standard questions about our project, that things became escalated to Apex's legal counsel. Apex could never tell us who the owner was, who the management was or who really worked at these offices listed on their website.We called one location and found out that it was a software company, who constantly got calls about roofing because this address was listed on the Apex website.  This made us question the legitimacy of the business and this is when we decided to call the city and police to figure out next steps.  This is the time when Apex decided to hire counsel, because we were asking real questions that couldn't be answered by management or the owner.  The certified letter from counsel put words into my wife's mouth.  At no time did we say we would reject the work being done or materials being delivered.  Law enforcement and city officials advised that we do not allow Apex onto the property at this point. We asked for proof from Apex that they are still insured and certified to work on roofing (paperwork was included in the folder when we signed the contract that shows both expired between the time we signed the contract and December). We gave Apex plenty of leeway but were never given respect when calling to inquire about status. The front desk workers ended up being lost in their own process, management was belligerent when we wanted information and the owner told us "I don't deal with small fry customers".We were told by both the management and owner that we were not worth the time to deal with - "It's not fruitful to live in the past" is the response we consistently got.

We are handling all leaks expeditiously, however, there is a shortage on laborers so the wait times are longer than usual. We have been in contact with the customer and will be out to fix the issues today.  We spoke to Mr. [redacted] and he was understanding and satisfied with our resolution...

I am rejecting this response because:   Let me start with I did receive the letter that you received from Apex portraying me to  be abusive to their employees,and having no knowledge of what their business is about, and that the case as your organization sees it, is closed. But as I see it you do not have all of the information. Please bear with me because you will probable read some things you have already read, but , you are also gonna read some things you have not already read. I am taking these things out of a note book of which I have everything recorded.. I am however am going to, so as not to bore you or waste your time, condense a few things so they will not be in order as I have them written in my nnotebook. I feel this is necessary for you to see what I am dealing with.      I am starting this on May the Ninth to show the pattern the company has developed. The roof was completed in January 2017. I might add that a gentleman maned [redacted] was sent to my house and he saw the problem with our roof. And we have pictures of flashing being on my roof between the roof and patio cover, taken by [redacted] , and by [redacted] who told my wife and myself that his title was project manager, but whom the company portrays him to be simply a sales man. And even though it is not specifically referred to in the contract, the contract does say to remove and replace the entire roof system. And I did contact the insurance company and asked why there was no mention of paying for the flashing in the proceeds from the insurance company. I was told by [redacted] that unless the flashing was damaged by the storm, they expected the flashing to be reused. So that means that Apex was supposed to salvage the flashing and replace it with the new roof system. And as I previously stated we have pictures ta[redacted] by [redacted] and by [redacted],prior to roof removal and we took pictures of the same area after roof system replacement and there is no flashing. So there is no other way to read the outcome but the company, Apex, has not completed their work.    May 9th [redacted] called me and told me they would be out to fix my roof either today or tomorrow, that tells me that they did know of the problem and were going to take care of it. Me being a considerate person told him that it was raining that day and should not come because, even though Apex says I have no knowledge of what they do, I do have enough knowledge that I knew that a few rows of shingles in that area will have to be removed to put down flashing and I do have enough knowledge to know you shouldn't remove shingles when it is raining. And there is no reason for them to waste a trip just to find out it is raining,. and I told [redacted] to call me tomorrow and I will tell them if it was raining. But I received no call the next day from Apex to find out if it was raining. In fact I did not recieve any communication from any one until June 7th. When I received a call from [redacted]. She did not identify herself as a lawyer. I did not find that out until some time later. She wanted to get the payment schedule set back up. At that point in time, I thought that Apex must have gotten them a new accountant. The reason I thought that was At the time of final payment from the insurance company, I had been told over and over that final payment from the insurance would not come until the end of the job. And there was a conversation between myself and [redacted] about having to replace the plywood on the entire roof to bring it up to code. And as it had been the entire length of the job, there was no communication between Apex and myself. They were supposedly handling everything, which was ignorant, because the [redacted] pays me and then I pay Apex. So when I received the final payment in December, I had no Idea that that was the final payment because the roof had not been put on yet. And I have a friend that stocks all of the stores for a major home improvement store chain.who told me if at any time I need a truckload of supplies to call him and I could get rock bottom prices.So with no communication between Apex and myself and the last conversation between [redacted] and myself I thought the big check was for plywood for the entire roof. And I was prepared to let Apex benefit from my friends offer by supplying a truckload of plywood cheap. So I spent some of the money. I hadn't worked in a couple of years because of health reasons. But alas that was not the case. So when the roof was installed, and I didn't have the funds for final payment, I asked their accountant how much time I could have.to pay. She told me I could pay out over four months.And the total was a little over $1400. She told me she would send me paperwork for me to sign and send back stating how much the payments would be and for how long. When I received the paper work it said I had to make four payments of over $600 apiece. I called [redacted] in the billing department and asked where their accountant went to school, because where I went to school 4 into 1400 didn't come out to over 600. He agreed and told me to pencil in the correct amount. But before I sent the paperwork back we discovered the leak. That is why when [redacted] called, and did not identify herself as an attorney I thought it was a new accountant. So Apex had not contacted me until Ms. [redacted] called on June 7th I even asked Ms [redacted] to please have the owner of the company call me. I was very polite and told her that in my 40 plus years in the construction industry I have never met an owner who had no interest in talking to the people who pay his salary, so surely he must not be getting my requests to talk to him.   June 12th I called [redacted] and asked him to call me at his earliest convenience. I received no call back. This is also the day I first made a complaint to you, The Revdex.com.    June 12th thru the 23rd. no response from Apex at all. But we did receive a letter from a lawyer firm here in San Antonio. In it, Ms. [redacted] asked for immediate payments to be set up and she told me not to contact the company or any of its employees any longer. All of my communication was to be done through her. I immediately called her and asked her what was going on. She explained that because I refused to make payments that I was in default of the contract. I told her that I had not refused to make payments to Apex just to be contrary, but that I am refusing to make payments to Apex because the work had not been completed. And I proceeded to tell her that the job had not been completed in January, and that [redacted] knows that the job had not been completed. Ms. [redacted] said that she was not informed that the job wasn't finished and that she would get to the bottom of the problem. I again, told her, I am not refusing to pay,for the job, but I am refusing to pay until the job is completed. She said she would get back to me.   From June 23rd through July 16th there was no word from Apex or [redacted]..    On the 17th of July I called Ms [redacted] again. I was transferred to [redacted], an assistant to Ms. [redacted].I told [redacted] that in the letter I received from them I was instructed not to contact Apex, and that it had rained and we still have a leak, and that they would be hearing from me every time it rained until the leak was fixed. This was about 1:30 PM. I asked her to please have [redacted] call me. At 4:50 PM I called Ms. [redacted] back only to be told she was away from her desk. I left her a voice mail telling her she would be hearing from me every time it rained until Apex completed the job.   On July 18th I called for Ms. [redacted] again. This time I got the lawyer who was handling the case, Ms [redacted]. Imagine my surprise when I found out what I thought had been Apex's new accountant, was in fact a lawyer.I asked her why she had not identified herself as a lawyer when we first spoke on June 7th. All she could say was she was sorry. That kinda goes without saying! I then asked her what was going on. She said she did not know but would contact her client Apex and find out. I will say one thing for her she did get back to me later that day, saying that her client, Apex Construction would settle for 400 dollars more and would then consider the job complete. I told her I am paying no more money for an incomplete job. And I told her that with all that I have written in my notebook I was ready to go to court anytime they wanted to. How about tomorrow? We hung up, and after talking to my wife I called her back and made a counter offer. I told her that with a noterized letter releasing us from any more financial responsibility to Apex,and that their 10 year guarantee would still be in effect, as per the original contract, that I would accept that from Apex. She said she didn't think Apex would agree to that, but she would ask them. I said if they don't accept then I will see you in court. She said she would get back to me.   On July 28 I was reviewing the estimate from [redacted] and did not find anything in it about paying for flashing. I called [redacted], the person who had been handling my case to ask about it. I had to leave a voice mail. There was no response.   On July 29th I received a call from [redacted]. It was not from [redacted] but from another specialist from [redacted]. She told me that the reason there was no allowance for the flashing in the estimate was if the flashing wasn't damaged by the storm, [redacted] expected the company to salvage the flashing from the original roof and reuse it. well apparently that didn't happen. Because as I previously statedwe have pictures from [redacted] and [redacted] before roof replacement, showing the flashing there, and we have pictures taken by us after roof construction, showing no flashing. And even though there is no specific mention of the flashing in the contract, the phrase, " the complete removal and replacement of the entire roof system," should be enough to cover the reuse of the existing flashing. Of course as Apex so plainly put it I am not an expert in this field! But I am not the  dummy, as they so plainly are! You see the problem with Apex starts at the top and flows all the way to the bottom! And we are not quite done!   On the 31st of July I called [redacted]. I asked her why I had no reply from her or Apex about my counter offer. I told her It was July 18th since we last spoke and now it is the 31st. I asked her if she thought that was ample time for a reply from her client? She assured me it was and she was e-mailing them as we spoke.   Finally oh the 7th of August I received a call from [redacted] at Apex asking for me to call him back. I returned his call and he told me he was aware of a problem we had and asked if I could bring him up to speed. He said he was in "

I am rejecting this response because:
As stated on the original complaint, and not addressed on their response.  Payment had been made to them according to the fees and expenses they had accrued. We received a final payment in the mail that was almost a thousand dollars over the amount explained to us as cost.  When we I quoted as to why, we were just told that was their expense.  We asked if they would speak to our insurance, as they had done I. The past, to explain the cost and we're told that that was the fees we needed to pay out of pocket.  Please read the initial response and review our wishes for a resolution.  The details you addressed were part of the complaint because although you have those issues outlined in your contracts, your salesperson and sales team continuously misrepresented your capabilities and service.  I think that as a company you should properly equip your sales staff to provide correct I formation in order to manage realistic expectations.  I believe that a complaint to the Revdex.com is warranted, especially after viewing other people's reviews since the bad service we received.  Your company has to be held accountable for its inefficiencies.

This Revdex.com (“Revdex.com”) response is intended to respond to the unfounded  Revdex.com complaint made by Mr. [redacted] (“Mr. [redacted]”) against Apex Construction (hereinafter “Apex”) on May 17, 2017.  On September 9, 2016 Mr. [redacted] entered into a contract with Apex in relation...

to the property located at [redacted].  Pursuant to the contract, Apex was to perform the removal and replacement of their roof.   According to the terms of the contract, final payment in the sum of $854.80 became due and owning upon completion of the work, and an invoice for final payment in the sum of $854.80 was submitted to him for payment in November 2016.  After numerous failed attempts communicate with Mr. [redacted], Apex was forced to expend resources and retain legal counsel. Based on review of the Revdex.com complaint, Mr. [redacted] contends that an issue arose regarding the amount of time it took to perform the roof work on Mr. [redacted]’s property.  However, pursuant to the contract, Apex made no representations or promises as to when the roof work would be performed.Paragraph 10 of the contract provides: ANY REPRESENTATIONS, STATEMENTS, OR OTHER COMMUNCATIONS NOT WRITTEN ON THIS AGREEMENT ARE AGREED TO BE IMMATERIAL, not relied upon by either party, and do not survive the execution of this Agreement . . .  Mr. [redacted] also communicated to Apex that he wished to cancel the contract months after entering into the agreement.  Apex advised Mr. [redacted] that he would incur a fee of 15% of the total cost of insurance proceeds.  Paragraph 8 of the contract provides: IF THIS AGREEMENT IS CANCELED BY THE CUSTOMER LATER THAN 3 DAYS from the execution, customer shall pay to the customer fifteen percent (15%) of the insurance proceeds awarded by your insurer . . . and the Company agrees to accept such as a reasonable and just compensation for said cancellation. After receiving a demand letter from Apex Construction, Mr. [redacted] agreed to make payment arrangements; however, he was non-responsive to correspondence sent memorializing this agreement.  After Apex contacted Mr. [redacted], he requested to be put on another payment plan.On April 14, 2017, Apex contacted its legal counsel and requested that they send Mr. [redacted] a detailed payment plan.  A payment plan agreement was sent to Mr. [redacted] on April 17, 2017, and Mr. [redacted] was non-responsive to this correspondence as well.On May 11, 2017, Apex’s legal counsel sent Mr. [redacted] a final demand letter asking that Mr. [redacted] pay his outstanding balance of $854.80 in order to avoid legal action.  On May 30, 2017, Mrs. [redacted] (“Mrs. [redacted]”) contacted Apex’s legal counsel and stated they wanted to pay half of their outstanding balance immediately, and the remaining $427.40 at the end of June 2017.  Apex has been more than willing with Mr. and Mrs. [redacted] and remains committed to resolving this matter.
