Responding to complaint: Terminal was returned in July but cancellation form was never received, therefore acct was never closedWe spoke with merchant on 10/**/requesting merchant to provide a signed cancellation form to proceed with account closureOn 10/**/2016, merchant faxed

[I am enclosing a note of how many times I called Argus to cancel my accountNOT ONCE did they tell me that as soon as I return my swipe reader my account will be cancelledIf that was the case the matter would have been resolved alreadyAs for my refund of $and $it is an outrageous amountThey have been charging me $every month so why did they start charging such outrageous amount ? I am also enclosing the cancellation form that was emailed to meI followed the instructions on the form, but when I called a few days later to find out if my account was cancelled, they said the email and fax number on the form was incorrect The guy I spoke to gave me another fax number to send the form, but when I tried to fax the form to the number he gave me (###-###-####) the fax number kept ringing outI tried another day and the same thing happened so I got frustrated and gave upEven when I spoke to this other person that gave me the other fax number he did not say anything about sending the swipe backAlso I cannot send the swipe back even if I want to ,because I don't know where to send itI am just confused and angry that these people keep taking my money from my bank, but refusing to cancell my account ]

On 12/**/we filed a complaint on Revdex.com against Argus Merchant Services and asked for Early Termination Fee refund (Complaint ID ***)Argus Merchant Services agreed to refund all ETF related feesHowever, it has been more than a week and: we still haven't received the refund we haven't received any calls from Argus Merchant Service showing that they are working on the settlement when we call Argus Merchant Service no one there is aware of this "refund settlement" and they say that they can't do anything for us Jacob Shimon (the President of Argus Merchant Services) who responded to our previous Revdex.com complaint and made the settlement offer is unreachable through his extension that he leftAlso, he is not responding to voice mails that we leftSince we are back in square #we are attaching our original complaint letter and response letter from Argus Merchant Services: Argus Merchant Services sales persons (a group of girls) came to our Beauty salon around September *** to convince us to switch from our current credit card processor company to Argus Merchant ServicesThey asked us to provide our bills from previous months with our other Credit Card ProcessorAfter inspecting our bill they promised that our monthly credit card processing fees will be lower by $15-$with themThey also promised that they have one month risk-free trial period during which we can cancel service for free so we don't have anything to fearHowever, their service turned out to be $per month more expensive than with our previous credit card processor companyBasically sales person was misleading usNote that the amount of money we made from August to December was sameSince their advertised product did not live up to their promises we decided to terminate the service by calling them and writing official termination latter within this month periodHowever, one day we noticed that they had charged us $After calling them they informed us that this is Early Termination FeeAgain this is complete opposite to what their sales representative promised to us at the time we signed up for the serviceWe have done research on Internet and it seems that we are not the only ones who have encountered exactly the same problem with this company where it misadvertises its service and promises free trial, then underdelivers and makes its potential customers want to switch back to the old provider; and then they make money by collecting really harsh early termination fees that they charge without getting proper authorizationHere are few places we have found bad reviews that exactly match our case: 1)*** *)Other review on Revdex.com Also, when calling their customer service they verbally admitted that, there is a free trial periodHowever, for them to be able to waive the ETF that they have already charged we would need to remain their customer for extra monthsSince we found these terms unreasonable we asked them to send us a copy of documents signed by us that would require us to extend the service termThen sales person abruptly hanged up the phoneAfter calling back again they told us that there is nothing they can do now because we don't agree to extend service for extra monthsThe response from Argus Merchant Services: Hi *** ***, I am sorry for the inconvenience you have experiencedIf you were to give us another opportunity we would most certainly make sure that the pricing is cheaper then our competitors and work out all the detailsOf course that would mean waiving the fees (cancellation fee and terminal fee as well)Also I would like to thank you for bringing bad customer experience that you had, as we will take disciplinary actionsWe would be able to reopen your account which will take 24-hoursI believe you still have the terminal that you can still use and the pricing will be dropped to match what you have been promisedIf you are still not happy we would cancel the account without any questions and no Cancellation FeesIn regards of the Early termination fee of $I am attaching the statement to show you that the cancellation is only $and $is the fee for the terminalIf the terminal is returned this price will also be waivedIf you have any questions do not hesitate to contact me at ###-###-#### Ext *** so we could work it out.As a minimum, refund of early termination fees - $However, to truly settle on this we would appreciate refund of $840, because besides $ETFs we were charged extra $just because Argus Merchant Services customer representative insisted that we should wait for them to send us over regular mail termination notice template that we have to fill and then send backBasically, this artificially postponed service cancellation day in their system and resulted in extra $just because service cancelation over phone was not acceptedWe find this comical because their sales person advertised service as "no contract" and easy to get in and get out under the "risk-free trial"

Responding to complaint:1. Merchant account was placed on hold due to situation of excessive charge backs, and debit attempts being rejected. On 02/**/2017, Client support spoke with merchant's bank and had confirmed that merchant's bank acct will allow debit attempt to be posted on merchant's bank...

acct. Online portal was also provided to merchant for reconciliation purpose.2. On 02/**/2017, merchant was connected with Risk dept. to address the held funds situation. Portion of held funds had been released on 02/**2017 and 02/**/2017.3. Merchant is advised to directly reach out to  Risk dept., via ###-###-#### to address the remaining held funds.

Merchant account was erroneously closed with ETF in June. Negative balance $1468.21 has been written off from this merchant account. Merchant will no longer received any billing.

In response to merchant's concern:1. Attached please see April billing statement. Merchant processed $559.00 in April 2017. Therefore a monthly fee of $63.96 was billed. Due to account being opened and service was used in April, refund request cannot be accommodated.2. There was no record that a...

written cancellation request, plus mobile swiper provided being returned from the merchant's end. For these reasons, merchant account remains to be opened in May. If merchant has already returned the credit card terminal, please kindly provide a courier tracking number. Attached please see MAY statement billing. 3. As soon as mobile swiper is returned and received on our end, merchant account will be closed without any cancellation fee.
