I never received a call or voicemail from this company and the only correspondence I received was from my employer stated that my wages would be garnished and a number to callI called this company to be transferred to a man that was rude and unprofessionalHe did want to help me set a payment plan and said it was too late and my wages would be garnished no matter what I didHe said that they would be garnished for months then I would be off the delinquentI called this past weekend to make sure that the garnishment would be falling off to find that this was not true and that I could have set up a payment plan from the beginningNow I have a garnishment plus a monthly payment for another months because of a unprofessional employee who was unwilling to helpI had every intension to make payments to get off the delinquent status.?

I am rejecting this response because: I just dont feel that ethical practices were used to notify me of payments! I have tried to contact you on my own, which is on file. I also have not recieved any mail inregards to a account thats in default. I not pleased with how my account is beinging handled. I have marks on my credit that are hindering from purchasing nesscesities that I need to sustain, and its not fair that I wasnt given the proper opprotunity to avoid that!

The business is incorrect in their assessment of the statute of limitations. I have paperwork showing clearly that they have exceeded the statute of limitations and therefore have turned this matter over to my attorney. In addition I also contacted the court and informed them of their tactics to collect on a debt which they are not the creditor for and have no legal authorization to do so. I will pursue this matter further legally. This company has been sanctioned many times by the court for filing bad debts and also for improper business practices in pursuing debts that they are not legally authorized to collect on. I have never been contacted prior by this company regarding any type of payment arrangements. So their statement is a false and a blatant attempt to collect monies that they have no legal right to collect.

We would like to thank you for bringing this matter to our attention. We value customer feedback and strive to improve both as a company and representative for our clients.
In response to the consumer complaint received by PBCM from [redacted], the consumer is incorrect in her assessment of the legal rights to pursue her debt. The filing date is clearly within the two year Statute of Limitations for collections on the consumer debt created by written instrument and the agreement which was extended to allow more time for [redacted] to repay the debt plus interest in full. However, [redacted] failed to repay the debt and interest on or before the agreed upon date thus resulting in a breach of contract and the current cause of action.

DOA - 1/25/2016CLIENT - Autopay ServicesASSIGNED BALANCE - $3,855.32 [redacted] took advantage of a settlement offer that allowed him to pay $2,000.00 as settlement in full on his delinquent account.   Our representatives made it very clear to [redacted] that the creditor, not our...

agency, is reporting the account to the credit bureau.  It was explained to him that the creditor will be notified of the settlement of his account within approximately 30 days of payment.  Once notified, the creditor will update the account on his credit report as a settled in full account.  At no time was [redacted] told that the account would be removed from his credit.  [redacted] paid the  settlement on 11/30/2016.  The payment was returned by his bank due to insufficient funds.  [redacted] replaced the bad check on 12/5/2016.  Once it is verified that the second check has cleared, his account with Autopay Services will be considered settled in full. The creditor will be notified of the settlement and his credit report will be updated.

Ms. [redacted] delinquent student loan was placed with our agency on January 28, 2017.  To date, Ms. [redacted] has not responded to any letters or phone messages from our representative.   In addition, on  July 21, 2017, the US Department of Education sent her a letter explaining a...

proposed treasury offset that would take place if she did not enter into a payment arrangement.  Ms. [redacted] had 65 days from July 21st to enter into the required arrangement.  She failed to respond and the offset moved forward.  On 2/23/2018, her spouse called PBCM and the Department of Education to inquire about getting a refund of the offset.  He was told that there will be no refund issued.  Regarding credit reporting, our agency does not  report for the US Department of Education.  It is possible that the loan is being reported by the Department of Education.

In response to the consumer complaint received by PBCM from [redacted] on October 20, 2016, PBCM is willing to accept monthly payments of $100.00 provided that payments are made on time each and every month.  This is a temporary payment arrangement due to [redacted]’s financial situation...

and will be reviewed for an upgrade in payment or pay-off every ninety (90) days.  The first payment of $100.00 is due on or before 10/28/2016.

In 2008 PBCM entered into an agreement with [redacted] to establish a payment plan in order to pay down her debt. This agreement was breached on or about 1/31/2011 by [redacted] PBCM hired an outside firm to file suit and collect the judgment in 2012. The Statute of Limitations for legally collecting on this debt would have been 1/31/2013 and PBCM filed suit 1/29/2013. The filing was well within the Statute of Limitations for the debt in question. For reasons unknown to PBCM, the attorney did not serve the defendant until recently. The time of service has no bearing on when the complaint was actually filed and therefore is not a violation of any kind.
