Greetings, The form that the consumer filled out does in fact have a disclaimer stating that "Color is not guaranteed" the reasoning for this is because colors and models do get discontinued and may not be available for replacementThe consumer claims that he had requested for his shoes to be returned to him if we could not replace with the same colorUpon further investigation this is not correctOn the consumer's paperwork he requests the same color, and did not indicate sending the shoes back to himSimply requesting we send the same color does not supersede our guidelines, nor does it change the fact that the specific model is out of productionOur liability is limited to the replacement of the product, and not the aesthetic features of the product in question

The shoes are digging into my foot!!! This is not from misuse I am not sure how you can even misuse shoes These were only worn indoors, for min to 1hr each day for my workout only, NO other time they are worn The company also didn't just "kindly" upgrade me to the Rocket shoes, they are no longer make the Rocket shoes or I would have rather have had the "downgraded shoe" If they are an upgrade, why is it that they are less expensive? It was never explained that these are made differently either, which would explain why these are not molding to my foot, if they are not made the same I am not letting this go These shoes are worse than the ones I had sent in.I guess now I know the reason is because the soles are made differently I would like shoes that do not have the gel mold since you do not make the Rocket shoes anymore I am not asking for anything unreasonable here Regards, [redacted]

Greetings, Unfortunately the consumer is incorrect, the email correspondence that he provided verifies that he mentioned the size being too big back on December 9, not on September 12, I have checked all of the correspondence between ASICS and the consumer for the months of September-December and never was the size an issue until December 9, Furthermore the consumer is claiming that he emailed us on September 12, which is impossibleWe received the consumers shoes on September 9, and a replacement order was not placed until September 10, The shoes shipped out on September 11, and if needed we can provide the tracking for the shoes showing they did not arrive until September 15, Also in the consumers email he mentioned that he had to get the shoes forwarded to him in Hong KongIf the package arrived on September 15, to the initial address then the package was forwarded to him in Hong Kong, then how did the consumer email us on September 12, 2015, days before the package was delivered to the U.Saddress that he provided? I believe the consumer is mixing up the dates in the emailMy emails are showing 12/9/which is DecemberIf the settings on the consumers email is set to an overseas dating style December 9, would read 9/12/Unfortunately the claim closed months before we were ever contacted by the consumer Kind regards, ASICS America

Greetings, We apologize for the frustrations that the consumer is having with our warranty processHe has opened a claim for a defective warrantyThe complaint was that the consumer "felt that the rubber pocket has prematurely worn out"Unfortunately when the inspectors physically
inspected the shoes they were not able to find any premature wear with any part of the shoeThis was the main reason the claim was not approved for a replacement, however a receipt was not present to determine if the shoes were purchased with in the year warranty from date of purchase timeFurthermore the consumer did provide the information that the shoes were purchased at Sports Authority which has been out of business since August of putting this shoe too far outside of our warranty time frameThe Gel-Nimbus did not have a significant amount of complaints, more than likely the Gel-Nimbus just does not work for the consumerASICS does not return, exchange, or warranty for fit or feel issues. Greetings, ASICS does warranty shoes up to a year for manufacturers or material defects that are not attributed to improper fit, wear and tear, damage due to misuse, alteration to the product, or negligenceThe consumer did receive our warranty guidelines when the claim was originally
opened. As the warranty does not cover misuse a replacement pair was not provided as the consumer was using a running shoe to play the sport of tennisThis was determined by the distinct wear that occurs when playing tennis and the consumer also let us know that is what they were used forThe shoe in this warranty claim is a performance running shoe and is not designed for the the lateral motions, abrasions, and pressures that come with the sport of tennisThe fabric mesh, welded overlays, EVA foam, and the synthetic leather toe cap will not withstand the friction when sliding along the courtI have included a picture of a shoe that is designed specifically for the sport of tennis and you will can see the major differences between the two types of footwear stylesA tennis shoe will have a PGuard that wraps around the upper to protect it from exhibiting damage to the upper of the shoeAlso in a tennis shoe the high abrasion rubber wraps over the EVA foam midsole in the forefoot to prevent damage to the soft foamThe toe cap of a tennis shoe will also be protected by the high abrasion rubber and the PGuardI do apologize for the inconvenience of this, but unfortunately we are unable to replace this pair as the issue is not due to a manufacture defect or the quality of the materials, it was due to being used for activities that it was not designed for.Kind regards, ASICS America
