We made changes to our vehicle listings as a result of this complaintWe have, by the Ohio Revised Code and BMV rules, up to days to deliver titleI can't change the Probate Court requirements concerning the transfer of a vehicleYou're welcome to take up your argument with Judge Robert GMontgomeryWe did nothing illegal or unethical and in fact followed the requirements set forth by the court We did not require the buyer to purchase the vehicle and resold it to another buyerWe wish the buyer well in their future purchase of a vehicle

I am rejecting this response because:The seller did not list this under the listing [redacted] told me in an email I was responsible for the carAfter I told them I was contacting Revdex.com the story all changedI don't think I should lose this car over there mistakeIt is the auctioneers responsible to check on this before they list itWhen a car is left in a family's trust the title says the family's trust name on the title and all they need to do is sign the title in front of a notery and then put my name on the byers line and I take it to the BMV to get a new titleI feel they made a mistake and had received a call from one of there associate's saying they made a mistakeI have emails to prove what I'm saying is trueThey know they are in the wrong and art trying to cover there buttsWho is going g to buy a car and wait days to gat a titleThis never happens

Attached are the rules copies and pasted directly from the site and a copy of the two bids in question.As you can see the rules clearly state "MUST MEET OR EXCEED THE REQUIRED BID AMOUNT"My bid was placed first as a maximum amount of $The next REQUIRED bid was $The web site reflects this when viewing and watching as the auctionprogresses to allow bidders the opportunity to increase their bidThe lots were sold at $ each* I was told the other bidder did bid higher amounts by *** *** yet the bid reflects he wasgiven both lots for a ten cent increment which doesn't reflect the minimum required bid* Because the bid was invalid according to the rules, I did not place another bid and went tothe pickup site to retrieve my items and was again validated by the auctioneer that he should nothave shown as a winner with a cent increment above my bidAgain reinforcing the fact eithersomething underhanded was done here, the information and rules are unclear even to theauctioneers, or a mistake was made and Arefuses to take responsibility for it.The BID increments that are specified on the Asite I have also taken the liberty to copy and pasteTheAsite states the bid must be increased by $if the current bid is between $and $If he had have bided $or more that would have either been a correct bid in accordance with therules that could have allowed him to win the lots fairly or alerted me to increase my bidMy concernsAuctioneer knew the bidder by name and immediately told me "*** already picked those lights up.No one questioned an invoice with in the totals instead of whole dollar amountsThe auctioneer kept apologizing and stating there must be some computer glitch because he shouldnot have won that lot with a incrementI purchased the one remaining lot that the other bidder did not pick up (which was one of 3landscaping lights lots) and phoned Acustomer immediately and again was apologized she looked upthe bidding history between the two of us and concluded that he should not have won the bid becausethe ten cent increment was not in accordance with the rulesShe stated that they would make an effortto have the other bidder return the good and an Admin person from Awould contact me in themorningAn admin person did call as promisedMr*** *** phoned me and tried to convince me that theother bidder won fairlyEven it did not meet the minimum REQUIRED next bidI then requested my information and account be deleted from their site and that all bidding current,pending and won be removedHe refused, stating my winning bids cannot be removedI feel as thoughhe only is up holding to the rules of his site that are profitable to himHe has already broken the site agreement with meHe has shown that he does not value me as aconsumer by the way that this was handledMistakes happen, but to try to convince me that THEY ARECORRECT and not take responsibility for this mishap is unacceptableI am effective immediately refusingto do any more business with them.End of Statement

The customer was not charged the $disposal feeThe customer is correct in that our terms do not state a fee charged for disposalThis is my fault in that I gave OOAS permission to charge a disposal fee once the terms were updated to reflect the fee policy and they understood that to mean they

An Estate is different form a TrustA trust can own a vehicle and the Trustee can sign the title however an Estate (owner is deceased) requires someone to be appointed as a fiduciary (Executor or Administrator) with authority that can only be granted by a Probate CourtAgain, sorry for any confusion

The Franklin County Probate Court (and all Probate Courts) require that the buyer and purchase price be identified prior to a fiduciary (executor or administrator) executing a titleThe BMV requires an "Entry" time and date stamped by the Probate Court along with a "Letter of Authority" before they
will transfer a titleThis process cannot be changed nor can we simply have the Executor sign the titleThat is illegalWe understand that the buyer needs a vehicle and therefor will not hold the buyer to the purchase and will relist the auto on our auction site

I reviewed the response made by the business in reference to complaint ID [redacted] and  I have worked with Mr Chris Davis on a compensate amount.  As per day I have not received or heard from them yet.

one until the day after we filed the complaint.Thank you very much for working with us on this, again our complaint is with the contractor for the auction and not directly with Auction Ohio. We look forward to using your services in the future, but will be cautious as to which contractor is working the auction.Again, Thank you.

I am rejecting this response because:The seller did not list this under the listing. [redacted] told me in an email I was responsible for the car. After I told them I was contacting Revdex.com the story all changed. I don't think I should lose this car over there mistake. It is the auctioneers responsible to check on this before they list it. When a car is left in a family's trust the title says the family's trust name on the title and all they need to do is sign the title in front of a notery and then put my name on the byers line and I take it to the BMV to get a new title. I feel they made a mistake and had received a call from one of there associate's saying they made a mistake. I have emails to prove what I'm saying is true. They know they are in the wrong and art trying to cover there butts. Who is going g to buy a car and wait 30 days to gat a title. This never happens.
