While the issue may have been misdiagnosed in your eyes, we have gone above an beyond by sending crews and field supervisors out to try and help pin point the issueWe expended many man hours trying to help your request to have the full deposit refunded I can not honor, however I would be willing to split the difference of the deposit simply because we did install a membrane and came back numerous times to try and figure out why you were still getting water in the basement If you are in agreement I would be more than willing to have this expedited asap I look forward to your response

We are more than willing to assist with the seepage issues, the foundation crack is warrantied for lifePer the notes in the file an agreement has been reachedIf the crack is still getting seepage we can send someone to remove the work bench and replace it to service the crackIn regards to the membrane the work is warrantied and does require us to remove concrete to access the area, while it is unfortunate that a new patio was poured there is no other way to repair from the exteriorPlease contact Chris N [redacted] directly if you should need any further assistance with the matter

U.SWaterproofing installed two escape windows in April of for the previous homeowner a Mr*** while installing these windows we hit a drain tile that was about 8' away from the house, this drain tile was installed by the
original builder and not installed by us, we repaired it since we ran into it unexpectedlydrain tile is usually right next to the footingwe have photo documentation of the pipe and where it was in relation to the house and where we were while we were conducting our workdOur install was done to code and the repair to the drain tile was made properlyThe construction of the house and where the drain tile was placed when the house was originally done was not our doing

The issue you were having ended up being an above grade problem, we do not fix above grade issues we only repair below grade problems, we have been nothing but willing to help you even if it wasn't something we can't fixWe rely on you the homeowner for information as to when and where you get water if your walls were never opened as our contract states there is no way for us or anybody to properly diagnose the issue. I would be willing to refund half the deposit, I can't refund the entire amount nor offer any warranty since our contract states that any balance needs to be paid in full for our warranty to be valid

We have tried numerous times to commence work at this home, the issues have ranged from the Homeowners belongings in the way and people living in the basement who refused to let us work, after we got back to start the work a second time it was noted that there is radiant heat lines in the
floor that we could not be responsible for and she would have to have a plumber on call if one of those lines happened to get damaged, she signed off that she she would be responsible for this After we got all this situated Mrs called our office and demanded we come back the next day to start the work, which we couldn't because we had other work scheduledMrs was upset and said she wanted to cancel and get her deposit backAccording to our consumer rights pamphlet Mrs has three days right to recision to cancel and get her deposit backWe have had a field supervisor visit and two different crews of men show up twice and couldn't do workWe don't feel the deposit should be returned because the lost time we have had to endure because the homeowner did not do our part to allow us to do the work

The work we conducted was done in accordance with signed contract dated 12/2/Our General Conditions were also initialed and accepted as part of our contract Our contract states that is is a "mutually agreed upon contract " and "it is possible there may be additional problems that are not
included in this contract."The original contract amount was $There was a separate contract for additional work that totaled$A total of $10,in work was performedWe had already reached a settlement, where we discounted the work by $( we received a deposit of $and then we received a separate check for $3500).We feel we have been more than fair;the foundation had an existing issue that needed to be addressed and the water softener line was an entirely separate issue

Our notes show that our sales manager tried contacting Mrs [redacted] on 9/7/16 and 9/8/2016 to see why she wanted to cancel the order she placed with us. Since the contract was cancelled within three days we will refund her deposit.
