Our complaint remains the same. A/V Sales lied and assured us "no one will ever build behind you." We believe that A/V knew of plans for the school to be going in and deliberately withheld this information from potential buyers, including us in order to get us to the table and close the deal. A company is only as good as is its word. We took the sales rep at his word. Had we known a school was going in adjacent to our property, we would not have purchased and certainly would not have paid a substantial lot premium. A/V must respond as to whether or not they knew about the school when they charged the lot premium and why this was not disclosed to us and other buyers, or rather purposely withheld information.

Given Mr. [redacted]’s limited availability, it has taken a bit longer than our standard response time as we work with our subcontractors to fit into his availability window. Our Customer Care team have attended multiple in-person home visits to address his concerns, and have requested an additional meeting to resolve anyremaining items that may still be outstanding as soon as he’s available.  It is our intent to satisfy any reasonable concerns that Mr. [redacted] has remainingas soon as possible.

I live across the road from AV Homes construction site in [redacted], which is in [redacted]. My Uverse cable (which controls my internet, security system and TV) has been cut SIX times over the last 6 months. I work from a home office and an internet connection is my lifeline. AV has been contacted 5 times (3 site managers) who have done NOTHING to stop this madness. The most recent manager (Jason) has not even returned our call. At the very least, a barrier could have been constructed around the box, but to-date, that has not happened.

I realize that when simultaneously building 8 homes (five of which are across the street from me), contractors work in assembly line mode; but AV Homes is not holding is contractors accountable for the damage they are doing. A little preventive action could have avoided this.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  I will wait until for the business to perform this action and, if it does, will consider this complaint resolved.

In response to Complaint #[redacted] AV Homes in response to the complaint of a school and a recreation center to be built adjacent to the purchasers homesite. AV Homes acknowledges the current, or future presence, of a recreation center to be built on adjacent land and also the future...

presence of a school or another use for adjacent land to the home of the complainant. The acknowledgement was described and explained in two documents which were presented and signed by the buyer at the point of purchase of the home and accepted by the homebuilder. The first document was the Public Report which required a signature acknowledging receipt of the public report and the recommendation to read the report prior to signing. Specifically on Page 10, Adjacent Lands and Vacinity – “North is zoned Planned Area Development, East is zoned Planned Area Development, South is zones Planned Area Development, and West is zoned Planned Area Development.  NOTE: Owners of the adjacent lands described above may seek to rezone their property, may seek zoning variances for their property or may modify their site plan within existing zoning. Consequently, no assurance can be given that the zoning or uses for the adjacent lands will not change from that described above. Purchasers should contact the City of Goodyear at 623 932-3910 or visit their website at www.goodyearaz.us for zoning information”. The area in question is the adjacent land west of the subject’s lot and home. The second part of the Public Report on page 7 discusses NNPIII – Estrella Mountain Ranch, LLC, the Master Developer of Estrella is proposing to build a Recreation Center on a portion of Parcel 7.11. The building site is proposed to approximately 5 acres and is proposed to be approximately 18,000 square feet of building under roof. The Recreation Center is proposed to consist of a swimming pool, multi-function meeting rooms, child watch area, fitness room (exercise and weight lifting equipment), locker rooms, aerobics room, snack/juice bar, lounge/multiple purpose room, main lobby, and reception and admin offices. Prior to the start of construction, the proposed site plan, building (s) and renderings must be approved by the City of Goodyear and therefore are subject to change. Subdivider advises that there are no guarantees as to the completion date of the Recreation Center and the amenities proposed.  For further information, purchasers should contact NNP III – Estrella Mountain Ranch, LLC at 602 468-0800, 5090 N. 40th Street, Suite 210, Phoenix, AZ 85018 Thirdly on the Public Report  on page 13, NOTE – Views and/or scenes that may be visible from particular portions of the development will change over time and may be wholly or partially obstructed as development activity continue and landscape matures. APPLICANT MAKES NO REPRESENTATION OR WARRANTY REGARDING THE FUTURE PROTECTION OF VIEWS WHICH MAY BE A FACTOR IN THE DECISION TO PURCHASE IN THIS COMMUNITY. PURCHASERS ARE ADVISED TO DETERMINE FOR THEMSELVES WHAT AFFECT, IF ANY, THE USES ADJACENT TO OR IN THE VACINITY OF THE SUBDIVISION WILL HAVE ON THE USE AND ENJOYMENT OF THEIR LOT.  Furthermore, the second document was the Sales Purchase Agreement. Specifically Exhibit H, Page 12, Line 4, and 13. Page 12 was initialed by the buyer and Page 13 was signed finalizing Exhibit H. It states: “Monecito Village, subject neighborhood, is adjacent to land designated or development as commercial, industrial, and/or multi-family uses and may be subject to potential noise intrusion, vibrations, and all other effects that may be associated with such uses. The purchaser does release and discharge the City of Goodyear, the developer, and the homebuilder from any liability from any claims for future damages and complaints of any kind to persons or property that may arise at any time in the future from the development of such property with commercial, industrial and/or multi-family uses.” AV Homes has verbally communicated with the complainant to discuss the issue specific to the school and recreation center currently being built. AV Homes has had discussion with the Estrella Master Plan Community to understand what is being planned for the area of the potential school. AV Homes has communicated the response which is the land has not been announced for it’s use although a school is a possibility. There is no other information to give. Also, per the contract and Public Report, a recreation center has always been planned on parcel 7.11 and is under construction currently. It is AV Homes position that all adjacent property has been fully disclosed within the signed documents, The Sales Purchase Agreement and the Public Report. There is no action due from the homebuilder.

Our customer service representative in Florida met with Mr. [redacted] this week.   When pressure washing his driveway, some aggregate was exposed which is normal when this is done.  He was pleased with the cleaning but not with the exposed aggregate.  A repair was made...

in 2 areas on the left side of the driveway but since that was not acceptable, we are going to replace the left side of the driveway in the next few days.  There will be some color variation between the old and new concrete which Mr. [redacted] understands, and we believe this will be a good solution.
