Mrs. [redacted] is mistaken in saying they used us a year ago. Prior to sealing the driveway on March 20, 2015the last time we sealed their driveway was April 27, 2012. Had we sealed their driveway in 2014, when theycalled us on March 16, 2015 for service we would have advised them not to seal the...

driveway again this year(we recommend every 2-3 years).Most of our customers are prompted to call us by the flyers we mail to previous and potential customers. Ourflyer clearly states our policy on crack filling:I don’t think we could be anymore upfront about the limitations of our service when it comes to crack filling.We don’t want customers to think we can “fix” cracks with sealcoating.In addition to the policy statement on the flyer, on the day a customer calls to schedules service, they receive anemail the same evening with this attachment:If the customer chooses not to read our policy on crack filling, I do not consider that to be our fault.Mrs. [redacted] also states that they “…had asked them to come and fill some cracks in our driveway, WHICHwe explained upfront about the cracks and they said no problem.” When a customer brings up the issue ofcracks in their driveway on the phone with us, NO ONE in this company would say “no problem”.She goes on to say, “They DID NOT fix any of the cracks and just sealed our driveway again, which wasn’tnecessary.” We do not offer a service for “fixing” cracks that does not include sealcoating.If she had her driveway sealed in 2014, it was likely with Academy Sealers, but it was not Collegiate Sealers &Paving. If that is the case, she should have called Academy to come “fix” the cracks.Had we not completed the service we advertised we would be happy to re-visit the driveway or offer a refund,but that is not the case.Sincerely,John P[redacted]John P[redacted]Collegiate Sealers & Paving

May Concern,
On July
27, 2011, Collegiate Sealers and Paving paved [redacted]’s driveway for
$2,850.00 (not $4,600.00 as stated in the complaint). In November 2011 we
received a call from [redacted] with concerns regarding settling near the
concrete apron....

Although we do not warranty settling, a manager stopped by to
evaluate the situation. When the manager evaluated the driveway, he noticed
that due to a poorly poured concrete apron a low spot was forming in the
asphalt. This was explained to [redacted] and he stated he understood.
At that
time, part of our paving service included a free seal one year after the
driveway was installed. [redacted] scheduled his free sealcoating for July
25, 2011. When this appointment was made, no concern regarding the driveway was
brought up.
On April
22, 2013, Collegiate Sealers and Paving sealed the driveway and filled the area
between the concrete and asphalt at no additional charge. Filling the gap
between the asphalt and the concrete is something we do not normally do,
however an exception was made for [redacted]. 
[redacted] was still not happy with the crack filler, so on April 25,
2013, our crew dropped off a jug of crack filler, free of charge, to allow [redacted] to fill the cracks as needed. Each time [redacted] spoke with a
manager it was explained that we have done everything we could do to prevent
the minor settling. We feel we have done everything within reason to
accommodate [redacted]’s concerns.
Our
records indicate that we had no contact with [redacted] in 2014.
Please
note, our estimate clearly states we only have a one year warranty against
potholes. It does not cover settling or cracking.
At this
point there is nothing more we can do to help [redacted] with the minor
settling in his driveway.

I checked my b.o.a acc last night on 9/17 and it was not over drafted. This morning it was overdraft. The scam is I'm supposed to have a day to put the money in the acc but the bank conveniently put the check in as yesterday 9/17 even though it went in at 12 midnight which would really made it 9/18 which would mean I should be able to put money in my acc today before they charge me $35.00 for an overdraft fee... and this isn't the first time they have changed the date to be able to charge me

Review: I have account at Bank of America. They charged me a 8.95 fee which is fine. I made a payment for a bill through ebill payment. Did not us my card or about a week cause I knew there was nothing there. I had 2.00 in the account. Pay day comes and Iook at my account and they have charged me a 35 dollar fee for there monthly withdraw of of 8.95. So after talking to them they want to say it's my fault. So after paying that one in they held my check and hit me for a additional 35 fee when there was money in the account. I have made numerous attempts but they will not budge on this position.Desired Settlement: Fefund my manufactured charges they create by doing what they wish when they wish it. That's now 89.95 I am paying for a e banking account in which I can not go and talk to any one with out being charged 8.95.

Response:

Bank of America has refunded the customer the two overdraft fees he refers to in his complaint. We have also refunded, as an additional courtesy, an additional overdraft fee. The customer's account is now credited these amounts. Attempts to reach the customer via the telephone number submitted have been unsuccessful because the customer has yet to set up his voice mailbox. However, we will continue to try to reach the customer to inform him of the refunds and our resolve. Thanks for bringing to our attention!
