Bought a 2005 Komatsu D39 crawler dozer from this company. Salesman's name was Michael. I was told machine was "job ready" and had a small leak on one drive motor. Upon delivery, the drive motor was pouring fluid and the air conditioning didn't work. Not job ready.

After removal and disassembly of the leaking drive motor, it was found to have been run without oil numerous times. The drive motor is entirely unserviceable and is being replaced. This repair alone will cost over $15,000.

The A/C system hasn't been diagnosed as of yet.

Seller refuses to accept responsibility for inaccurate information, false pretenses, and will not help with the repairs.

We are responding to a letter we received in regards to a complaint against our company BCI Rental*** Complaint ID made on 04/02/2020. We do recognize and understand the customers concern and we are disappointed that this has happened to him. We did sell him a 2005 Komatsu D39 crawler dozer, this machine was as a trade in that BCI Rentals acquired; it was not one of our own machines and was not a new machine. On trade in machines we do a limited inspection which involves a mechanic performing a visual inspection of machine, checking the machines steering and controls for normal operation and function*** This is all done at our place of business to detect any major problems and is performed on all trade in machines before we list them for sale. On the machine the customer purchased, a small leak on the right final drive motor was found, this leak was not investigated to determine the cause, so the source and/or reason for the leak was unknown, this information was disclosed to the customer multiple time*** The customer was verbally encouraged to come and inspect the machine himself or to send a third party to inspect it for him; we strongly encourage this as with all of our equipment sales, before any customer makes a purchase.

In regards to the A/C problem, we did test the A/C when we received the machine and the A/C was blowing cold air. However during the time BCI Rentals had the machine the weather in Pennsylvania was 40 degrees or below. Unfortunately we believe that if there was a problem with the A/C it went undetected due to the low temperatures and therefore we did not have any knowledge of the problem. As stated we did test the A/C, it was blowing cold air and in all honesty this could have been hindered by the cold weather. If there is a problem as the customer is stating it was not known at the time of the sale.

We have all buyers sign a bill of sale that states all machines are sold "as is where is" we are not saying that this is an excuse to sell something with false pretenses, but we did not falsify any information. The buyer was well aware of the small leak on the final drive motor. BCI Rentals does not have any responsibility for what happens to the machine once the machine is picked up from our place of busines*** We can't prove that something may have happened from the time the machine was picked up at our business and transported from Pennsylvania to Alabama, all shipping arrangements were made by the buyer. We do however know that when the machine left our location, it had a small leak on the final drive motor and as far as we knew the A/C worked. We did not provide any inaccurate information or false pretense*** BCI Rentals does not feel we should be financially responsible for the repairs, as we disclosed everything that we knew about the machine and the customer signed a bill of sale that does state "as is where is".

We are very sorry this has happened to this customer. By no means do we want this to happen to anyone. It is very unfortunate that this has happened, but BCI Rentals does not feel as though we should have to pay for the repairs or other charges the customer may have incurred. We have apologized to this customer verbally and the customer seemed to understand the situation, we did not foresee a complaint from him. He asked us if there was anything we could do, we stated that the information was disclosed and that we did not feel we should be held responsible for the cost of the repair*** We explained our situation to him, apologized for what has happened and he seemed to accept our apology.

I have included a copy of the bill of sale which is signed by both the buyer and seller. Also included are the e-mails that were exchanged between the salesman Michael K and the buyer David T in which the final drive motor leak was mentioned again to him. Thank you for your time in reviewing this complaint, we wish to have this settled peacefully and hope that the buyer will understand our reasoning. We have been in business for over 50 years and don't like to hear that we have an unhappy customer, so we are truly sorry this unfortunate situation has happened.
