We are in receipt of your letter to the Revdex.com and appreciate the opportunity to clarify some of the facts we uncovered during our research of your concerns.Our Funds Availability Policy, which complies with Federal Reserve Regulation CC, states in part, "...If we are not going to...

make all of the funds from your deposit available on the first (1st) banking day, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the next business day following the banking day we receive your deposit. If you will need the funds from a deposit immediately, ask us when the funds will be available".We show on April 9, 2017, you deposited checks numbered 97 for $240.00 and 98 for $540.00; both drawn on your account with Chase, in to your accounts ending in -[redacted] and -[redacted] respectively. The following morning at approximately 8:08 a.m., you completed a $240.00 ATM withdrawal from account -[redacted] and a $500.00 ATM withdrawal from account ending in [redacted]. During our post deposit review on that same date, a seven business day hold was placed on the amount of the check as allowed by Regulation CC when we received confidential information indicating the item may not be paid. When we placed that hold, a notice of funds delayed availability (copy enclosed) was delivered electronically to your Gmail email address on file outlining the amount held, the reason for the delay, and the date funds would be made available.We show checks numbered 97 and 98 were returned to us unpaid by JP Morgan Chase Bank on April 12, 2017 for 'Closed Account' and charged back to your account. The associated return item fee was assessed along with an overdraft fee when the charge-back debit overdrew your account.As of today's date, your accounts ending in [redacted] and [redacted] have a charged-off balance of -$346.84 and 5685.33 respectively. You may make a deposit to correct this overdraft by visiting any of our branches or by mailing a deposit to First Convenience Bank, Attention: Mail Teller, [redacted].

As stated, in recognition of your efforts to monitor your account balance, I
have processed a credit of $34.00 to your account.During our phone conversation, we discussed our overdraft services
as outlined in the Deposit Agreement provided you at account opening. I asked
you if you wished to change your overdraft election from full overdraft
privilege to our standard overdraft service or no overdraft service but you
declined.Please note, the account will not be assessed an overdraft or
non-sufficient fee if at the time you write a check or otherwise authorize a
payment from your account, there are sufficient funds on deposit to cover all previously authorized
outstanding debits as well as the new transaction being initiated.To help our customers be successful in managing their account, we
provide free account monitoring tools such as Online Banking and Mobile
Banking. You may also wish to enable text alerts to receive notifications of

Inactive account are those accounts with no owner initiated debits or credits for eleven (11) consecutive months. These accounts are subject to an account inactivity fee of $35.00 or the remaining balance of the account (whichever is less).So that our customers are not surprised by this action, we send written notification on the tenth month of inactivity which provides information on the inactive status, the associated fee, and actions you may take to avoid the account becoming inactive. We show this notification was delivered electronically to your ATT.net email address on May 7, 2016. Another copy of the letter is enclosed for your reference.On June 7, 2016, your account was assessed an inactivity fee of $25.43 and closed with a zero balance. We are in receipt of your recent letter to the Revdex.com. It is frustrating when unexpected fees are charged to your account so we appreciate the opportunity to respond to your concerns.When you established your account with us, you were provided with a disclosure packet covering the...

terms, conditions and fee schedule governing your account. Included in that packet were documents titled, "What You Need to Know about Overdrafts and Overdraft Fees" and the "Banking Services/Fee Schedule" both of which disclosed your account would be charged $34.00 for each item we pay into the overdraft. We will not charge an overdraft fee if the items we pay are $1.00 or less or result in an overdrawn balance of $10.00 or less. We will also limit the number of per item overdraft fees we charge on this account to 12 per month. However, if you do not return your account to a positive balance then your account will be subject to a Negative Balance Fee on the sixth (6th) banking day your account remains overdrawn. We will waive the fee if the on the sixth (6th) day your account is overdrawn $10.00 or less.The aforementioned disclosure documents also outline our overdraft services. Our records show that you opened your account on July 27, 2014; and, at that time, made an overdraft privilege participation election of full overdraft privilege. This means we may use our discretion to authorize and pay overdrafts for ATM and everyday debit card transactions or recurring debit card transactions when your account does not have sufficient available funds to cover the transaction at the time it is attempted, checks, ACH transactions and automated bill payments.A review of your transaction history shows on February 21, 2017, during our nightly transaction processing routine, a transaction of $15.19 from GERBER LIFE INS/INSURANCE presented for final payment against an insufficient available balance of $2.51. responsibilities are outlined in the Deposit Agreement provided at time of account opening. The accountholder's responsibility is to maintain an accurate transaction register of the account activity, to ensure that we have your current mailing address in our records, and to review and balance all statements promptly and notify us of any suspected errors, forgeries or irregularities concerning your account.A review of our records shows you did not complete the enrollment process to Online Banking and E-Statements, therefore; your account was set for paper delivery of the monthly account statements. Upon researching your concerns, I found your February 2015 bank statement was returned to us by the United States Postal Service. This caused the account status to be moved to "AUK" or "address unknown" and the assessment of the $10.00 returned mail fee as disclosed in the Banking Services/Fee Schedule. To decrease the risk of identity theft or fraud on your account, we stored your statements that were generated thereafter in our system until such time as you provide us with your correct address information. Eventually, your account became overdrawn and when no deposits were made to return the account to good standing, the overdrawn balance of $76.00 was charged off on September 8, 2015.It is our desire to end this dispute amicably so as discussed, I have credited $76.00 to your account ending in 8512. Your account is now closed.We wish you much success in your future financial endeavors.

please keep in mind these transactions impact your account available balance differently than checks and traditional ATM card transactions. In most instances, when you use your Debit MasterCard@, a "hold" is placed on available funds in your Account. These holds or pending transactions will remain on the account until (a) the charge is presented by the merchant and clears your Account or (b) up to a maximum of three (3) banking days, whichever is sooner. Funds on hold are not available for withdrawals, payment of checks or other debits. If the charge is not presented by the third (3rd) day, the "hold" is released. However, a merchant has up to ninety (90) days to present a transaction for payment, so you should continue to carry the purchase amount as an outstanding item in your transaction register.In order to avoid unwanted fees, never assume that items will pay in a specific order and always use your transaction register to keep track of your account balance. Just because an item receives a hold and is authorized for payment does not guarantee that the item won't generate an overdraft fee when it clears your Account. If other items are posted to your Account in the meantime and create a negative available balance, items with a hold may generate overdraft fees.We found this to be the case on July 2 1 st when you made use of our overdraft service by completing two ATM withdrawals totaling $244.50 against an available balance of $21.1 1. We used our discretion to authorize and pay the withdrawals into overdraft assessing the associated overdraft fee for each withdrawal. The following day, two debit card purchases (Taco Bell and Burger King) totaling $8.63 presented for final payment against an overdrawn account balance. When a transaction is preauthorized, we are legally obligated to pay (post) these debits upon presentment. These transactions were posted into overdraft and the associated overdraft fee was assessed for each item. When no deposits were made to restore the account to good standing, the negative balance fee was assessed on July 26, 2017.The enclosed documents titled DDA Holds/Transaction History detail transaction activity are for the days of July 21 st to July 22nd, and July 26th. Please take a moment to read the informational sheet which is also enclosed.As of today's date, your account ending in [redacted] has an overdrawn balance of $398.39. Please take this opportunity to make a deposit to cover the negative balance in your account.
