the response we have for this homeowner is as follows.We received a phone call from Mr& Mrs*** requesting us to come give them a quote for roof and siding replacementThey mentioned at the sales meeting as they also mentioned in the complaint; they already had an existing leak in their
roofThe sales meeting was in June after every area in central Illinois had been hit by hail and all home improvement companies are extremely busy with work as a result of the hail stormsThe homeowner requested us to try to complete the roof ASAP due to the existing leak which is also evident by the paperwork from their insurance companyWe were able to move the roof repair only, to a higher priority but under no uncertain terms did this include the siding work to be completedThis job did not cost the homeowner money out of pocket, they submitted a claim to their insurance company and we worked within the scope of the insurance settlement. Up until this point; we can state or certainty that Mr*** arrived at our office after the roof has been completed, he was threatening, yelling at staff and throwing items in the managers officeWe have since been unable to gain access to this property to either confirm or deny the allegations in the complaint, therefore we are under no obligation to reimburse any persons for additional work completed on this propertyThe only way we have been able to communicate with this homeowner is via certified mailThey will render any warranty with out company void if they move forward with having a different company work on the roof

Again we sincerely apologize for any dissatisfaction this customer has experiencedIt is our understanding the check refunding the down payment
has been mailed to the homeowner and the check was cashed on 4/21/It was never our intent to delay the return of this down payment, our understanding was that it had already been return to the homeowner by an employee who no longer works here

Betterway contracted to build addition for meAlong with a kitchen remodel, room addition large enough to include a bathroom within the new room addition, and a new garage; new staircase to basement, complete finish work on existing
staircase to upper level, tie in new bathroom sewer to existing sewer
They told me they're not doing any moreAs Illinois State law states, a contractor may vacate a job when there is lack of payment for services renderedWe repeatedly requested payment as contracted and also for the additional work requested be completed by MsSAfter a refusal to pay us multiple times, we vacated the job siteMsSis in violation of QUANTUM MERUIT statutes, she has benefited from the services of our company without further compensation to our companyThere is a contractual defect with the original contract and MsS knows very well about contracts from her real estate businessThere is no explicit mention of pricing for such items as kitchen cabinets, as a business we are not obligated to offer unlimited financial resources to the customer because the contract lacks this informationWe stopped work on the kitchen remodel because it became apparent that MrS was attempting to take advantage of the contract gaps and request more expensive items be ordered for her homeA homeowner cannot use the excuse "they are unaware" of things such as price limits, the homeowner has personal responsibility to ask the contractor such questions as, "what is the price limit of the kitchen cabinets"We are not in violation of not completing what is on the contract because many of the things listed in the complaint were later requested by MsS, and reported to the crew to be approved by the companyWe later would find out that this way a lie to the crew and communication for these changes and additions were not discussed or approved by the companyWe require all additional work to be addendum to the original contract, there is not one reason we would make an exception with this homeowner
The contract was to commence building by March 15thWe do not set start dates for job in the contract, any start date given to you would have been a rough estimate by the sales personThere is no starting on time or not
I was not told of any pricing but the salesperson told me that *** had all my information and would send me drawings once completedAgain, if there is no mention of pricing for individual items, the homeowner should ask, this is common sense, if there was not a sticker on a new car, one would ask how much the car was before agreeing to buy it
The contract also called for a new sewer lineC the contract called for us to tie in the new bathroom sewer line to the existing sewer, MsS has demanded that we replace the sewer line out to the street, this is not part of the agreement, and it would require excavation and additional cost which the homeowner is unwilling to pay
They did not back-fill when they should have and with the excessive rain we had the mud poured into the basementThe basement was back-filled properly, the sump pump failed due to manufacture issue and this is under warranty, and homeowners are responsible for manufacture warrantyThe other issue with mold in the basement would also be caused from the high amounts of ammonia, requiring the crew to have to stop work frequently due to feeling the work conditions were unsafeWe made numerous requests of MsS to have the feces and ammonia problem taken care of so we could continue to work at a timelier pace but she failed to comply even after agreeing to have the area cleaned
The electrician in fact was not licensed to perform the work eitherWe do contract with a licensed electrician and he has electricians who work under his guidanceThis is not in violation of Illinois State law
*** *** told me that his salesperson had underbid the job and he wasn't going to spend another nickel on my addition because he wasn't going to go in the hole over itThe job was severely underbid, this is correct, this was exacerbated by the fact the MsS added on many adjustments as the crew was completing the work adding additional cost to the job, but at the same time refusing to make addendum to the contract or pay the contractor for the additional workAt MsS request, the basement wall height was increased, the new garage ceiling height increased reinforcement of existing staircase to support additional weight
Since then I've been trying to work with them to find a resolution but they want me to eliminate my kitchen, the new staircase, the appliances and many more thingsThere was never an agreement for a new staircase; she already has her new appliances and kitchen cabinets
He was also very abusive during the callHe has made it very clear he will not be completing the workStatements like this and saying that "we don't want to go in the hole" are an attempt to maliciously attack the business and its ownerAs a business in the community for the past years, we strive to meet all the needs of our customersThere are times when the requests of the homeowner cause insurmountable issuesWe have unfortunately reached an impasse with MsSand unfortunately her route to rectifying this is an attempt to publicly and maliciously report falsehoods about our businessUnfortunately we have to leave any resolution between both parties up to the lawyersOne request we will be making as part of the resolution process is that this complaint, this attempt to publicly defame our company is restricted from being eligible for all to read who visit the Revdex.com siteWe would hope that this remain confidential until a resolution has occurred as to avoid further damages and bringing more parties to the table as participantsMsSis a business owner and we respect that fact and decline from further comment at this point

6/15/Revdex.com spoke to Mrs*** she stated the issue was not resolvedShe said he had never done the work or returned her money

We have been to this homeowners house more than one time to address the issues, and we were just there recently; met with the homeowner took care of the issues that she was concerned about; and she expressed to us that everything had been addressedTo the best of our knowledge all of these
complaints have been taken care of to the homeowner satisfaction

We are not responsible for the sidewalk, there is no damage, on portion of this sidewalk is sunk and with the great amount of rainfall this is most likely the cause. we did not drive a vehicle or heavy equipment on the sidewalk.

They broke the side walk the very first day they were here! But being the shady company they are im sure we will never get anything from them. Or for them to even own up to their mistakes.

I am rejecting this response because:
I filed an initial claim that was closed without the issue being resolved ([redacted]). Betterway was paid $2400 to do a layover roof. They only did part of the roof, was paid in full, and never returned. They have said multiple times now that they would be over to finish the job, yet it is still unfinished. They did the initial work in early August, yet the job is still not finished.I initially was only looking for the job to be finished. I now believe that reimbursment of part of the amount paid along with finishing the job is more then fair. I have had to hound this company for almost 5 months over $600, and yet the work is still not complete

We have been told by lawyers to not comment on this complaint. This has gone to litigation unfortunately.There is no apparent reason for this to remain as unresolved, due to the progression of this issue. We will not be able to report back to the Revdex.com regarding this case.

The homeowner will get her down payment returned within the next 2 weeks. The business was confirming contract information prior to decision making.
