To Whom It May Concern: It is always our intention to follow the proper protocol when facing varies issues within the HOA’s that we manageIn this case, where the legality of the decisions we have made in this process have been challenged, we have used specific legal counsel from an attorney to ensure that every step was followed correctlyWe are confident that the process was followed as the law and the community governing documents was written Regards, Blue Mountain Community Management

[redacted] is a community with many vacant lots and maintenance is necessaryThis is typically done once a year and notice is provided in advanceThis year a notice of lot maintenance and potential charges went out with the June assessment indicating a date to have them maintained by if the owner chooses to do this on their ownWe do not threaten to lien the property in order to receive paymentI believe this is a misunderstanding and the owners received a "Notice of Right to a Lien" from the contracted vendor who performed the landscaping servicesContractors send these notices for their own protection in the instance that they do not get paid by Blue Mountain on behalf of the HOAThe lot maintenance notification sent out to the owner's is attached ***SUPPORTING DOCUMENTS REDACTED BY Revdex.com***

As a management company, Blue Mountain takes the concerns of the owner's within a community very seriouslyAt no time would Blue Mountain consider closing down a communication line for a concerned home ownerIn the case being referred to here, which was brought to our attention by the home owner, there has been continual and diligent work being done on all frontsAt this time there are multiple parties involved including, the local jurisdiction, property managers, HOA community managers, as well as the home owners and procedures need to be followed on all frontsAs an HOA management company, Blue Mountain has limited authority and will continue to work with the external parties all while continuing to enforce the CC&R's and Bylaws for the association through the process As always, the lines of communication remain open and the continued work from everyone involved will have the end result being a pleasant and enjoyable community

Complaint: [redacted] I am rejecting this response because: Hello, I appreciate your kind responseYour management company has NOW blocked me from being able to email violationsI am not longer able to communicate at all with blue mountain and this is a violation of my rights as a member of the hoaThere are continual violations that directly go against bylaws set forth by the hoa and this has been going on for years with this particular house [redacted] and [redacted] are well aware of the mess that these people have created in the neighborhood and don't even feel as though they need to respond to emails with pictures and documentation of the violationsNow, as I stated above, I'm not even able to email violations -- they have blocked my email address and whether you want to respond to the emails that come every single day, I need to be able to report violations that are occurring and are against bylaws.Sincerely, [redacted] ***

Complaint: ***I am rejecting this response because:It is boilerplate legal jargon (and gibberish) without any basis or response to why the original legal fees were added before the HOA billing closing date of the payment in full that was made in November Blue Mountain has suggested I recover these penalties from the realtor for not informing me about the HOA
in the first place! He has written them and taken this up with his attorney A lack of ethics and total irresponsibility on the HOA administration's part is apparent

Per our contractual agreement with the HOA in which you reside, we conduct compliance visits on a monthly basis and enforce the CCR's as they are writtenSince the beginning of the year we have issued
citations and fines, to homeowner's that were currently not in compliance with the governing documents for the HOA. The citations and/or fines have been issued for a variety of violations, including but not limited to, landscaping, improper storage, parking, recreational equipment, nuisance, and holiday lights being left up.
Per your request to resolve the issues you have brought forth, we will send a letter to your home address in reference to your HOA account.

Complaint: ***I am rejecting this response because:Blue Mountain has not communicated the violations to the HOA of the neighborhoodMultiple board members (the only two that exist) have never even heard of complaints made in last few months -- that is horrible communicationThis management company does NOT respond to emails -- again horrible customer serviceAlso, management company SHOULD be calling property managers on these tenants each and every single day if that is what it takes -- make it a DAILY problem for them as it is for us. owner chooses to do this on their own. We do not threaten to lien the property in order to receive payment. We are sorry that you disagree with the decision made, but we have been more than open sharing information with you throughout this process and will not have any further public comments made.

We apologize about the delay, we have recently changed vendors and were awaiting confirmation of the payment from the old vendor. The refund is in processes and should be received in the next week or two.

If HOA is not responsible , why not give us the correct business to deal with instead of leading us on?

We are working with the homeowner to correct the problem and appreciate their patience. There were some lapses in response time on our part and we are working to resolve the issue as quickly as possible

Is there another address of the property that you have referenced originally? Again, we do not manage the property you have mentioned and never have. We also do not take part in any type of eviction services.
