File # [redacted] Dear Revdex.com, [redacted] signed a contract with BP Alarm on July 27, Her contract was originally for monthsAfter her three day window to cancel expired, [redacted] called the owner of the company to dispute her contract lengthThe customer was already given months for free, and the owner of the company changed her contract length to months to make the customer happyHowever, after her initial term was fulfilled she would still be renewed yearly unless cancelled by either of us in writing, days prior to the end of the contractPlease see paragraph of the contract in regards to our renewal and cancellation policies [redacted] mailed a letter of cancellation on August 30, The deadline for her current renewal was May 27, Because she missed that deadline, her contract renewed for another month periodWe processed her cancellation and as of June she has not been charged for monitoring servicesHowever, her account is past due, and due to non payment is receiving late charges every month that it goes unpaid We as a company have a right to notify [redacted] that her account is past dueHer account is currently over days past due and she owes $dollarsWe intend to uphold this contract and collect the money that has not been paid to us Regards, Customer SupportBP Alarm

Complaint: [redacted] I am rejecting this response because: October 14, BP alarm informed me that they were no longer monitoring my system They were unable to assist in turning off the alarm, and no police were summoned, even though the alarm was ringing in excess of an hourI contacted the owner in Seattle letting him know that BP alarm told me that they were no longer monitoring my system and I would not continue to pay for services not rendered He told me that he would not monitor the system because I had written a letter of cancellation outside of the window he set for cancellation He said that if I didn't pay the contract forward or relinquish my equipment in exchange for unreceived services, he would take me to courtI am years old with almost a perfect credit score for decades I don't cheat my creditors and don't expect my creditors to cheat me The last letter I sent dated October was sent certified mail If BP alarm began monitoring my system after that date, they did not inform me of their change The system was never used after October This is the first time I have heard that BP alarm reinstated my monitoring However, they have informed me uncountable times by mailings and phone calls demanding money If they have audio recordings, as the former letter indicates, I'd like to hear them If they exist, they will prove the truth of my claims Sincerely, [redacted]

Complaint: [redacted] I am rejecting this response because: they are not proposing a resolutionThey are requesting more informationI am providing that now: Last name: [redacted] Account #: [redacted] Sincerely, [redacted] ***

To whom it may concern,We receive certified mail at our PO BoxI'm not sure why she was told PO Boxes don't receive Certified MailWe do All she need to do is send us a letterIn fact, if they will just send us an email at [redacted] @bphomesecurity.com with the following:-Name-Address of Alarm -State that you want to cancel the accountIf the customer does this, we will cancel the account at the end of their term.RegardsCustomer SupportBP Alarm

Dear Revdex.com,This is not trueI was the sales rep and I did not tell her thatAnd in addition, the contract that she signed which the customer has had in her possession over years, states the contrary. In paragraph it states 'initial term of contract: Months'In paragraph 2.4, it states, 'The
original term of this agreement starts on the day this agreement is signed and continues for twenty-four months, and will automatically continue from year to year thereafter unless cancelled by either of us in writing no later than (30) days before of the end of the original term or any renewal term.So because we didn't receive a cancellation letter from her days prior to Jan19, The contract renewed for monthsThese are the terms that we both agreed to on 1/19/In addition, she was given days after signing & receiving service from BP Alarm that if she wanted to cancel for any reason, she could haveShe didn'tShe also failed to mention that after signing the contract, she called in needing months for freeShe had switch to us from a different company, and her contract with them was not overWe give her months for free so that she wouldn't get double charged

Complaint: ***I am rejecting this response because:
1. The saleman told me they were giving me a $monthly discount for staying with my company as they merged with BP. I asked if that meant British Petroleum and he said it did. I did not know I was changing companies. I had severe cataracts and I could not read the contract. A week later another man (service connector) came to connect me and told me I had signed a 5-year contract. He also told me I could no rescind my purchase because my time limit had passed. I was shocked and found the company that "merged" with my provider was not British Petroleum and were extremely hostile when I called. They asked for a "chance" and a 1-year contract. I agreed
2. I had cataract surgery and was still recovering from open heart surgery. I was unable to live alone and my daughter invited me to live In her home. I called BP and was told that I signed a contract that was automatically renewed unless I told them in a "window" that I would not be resigning. As I mentioned before, I could not read the contract at that time and I was not told that my either the saleman or the person who talked me into a 1-year contract. The man I was speaking to was "the owner" in Seattle. I asked him to put a stop on my account and I would pay to the end of that contract. He said he would not do that....I had to call during the "window." I explained that I was in no physical condition to be able to be sure I could do that. H essentially said, That's too bad for you
3. They claim they provided services until June of 2015, but the truth of the matter is that they discontinued me services immediately and continued to accept my monthly payments which were issued automatically by my bank
4. On October my renter called and said the alarm went off for "no reason" and he could not turn the alarm off. I thought the police would be right out, but no. The alarm just kept going off and I called BP from my daughters phone. They said they were "no longer monitoring my system" and could not turn the alarm off.
5. I wrote a letter the same day and told them I had put a stop on their payment and would not complete what they called my "contract."
6. The owner said that they would take care of the problem if I would give them all my equipment, which I bought from my earlier provider, or pay the remainder of the contract without receiving services
Sincerely,*** ***

Dear Revdex.com,
As we mentioned before, in paragraph of the contract it states that this agreement has an initial term of months and if the customer does not send us a cancellation letter days prior to the end of the term or any renewal term the contract is renewed for
monthsThe contract plainly states the renewal policy and cancellation process.
Regardless of when Mrs*** sent her cancellation letter in, she was still in a yearly renewal that ended June 30, We honored her cancellation and she was not renewed nor will she be renewed againHer account is closed, however, with her account being
past due we will be forced to take action according to the terms we agreed to in the contract
The customer has chosen to communicate with us via email for the past few months, in which we have offered our phone number if she wanted to speak to a representative directly If she has any questions she can contact us at 888-376-

Complaint: ***I am rejecting this response because:
The following is my response to Mike B***’s answer:
Mike B*** denies that he said our provider, ***, was no longer operating in our areaWhether this is a result of misunderstanding or this is a carefully crafted sales spiel meant to scare and deceive is open to debate
My wife clearly remembers when Mike B*** made a sales call in July 2014, he claimed, that *** is no longer operating in ***Because of the numerous break-ins in our neighborhood, my wife got so scared of losing a security system that she signed a contract with BP Alarm on one condition -- that it would only be implemented when we are sure that we are no longer obligated to our current provider, ***On July 7, 2014, the BP technician came to our house and made changes in our security boxAfter a few days, ***, having heard from me about BP Alarm’s deceptive claim, sent their own technician and switched us back to the *** systemWe never heard from BP Alarm after this and I believed that everything was settledHowever, in September 2015, we received a bill from BP Alarm asking us to pay $monthlyAs of today, the accumulated bill has amounted to $and Mike B*** threatens to take the matter to a collection agency
Aside from the deceptive sales pitch, there are two other matters that I need to emphasize:
1. When my wife told Mike B*** to wait until the end of our contract with ***, she was speaking of a contract that was in force until April, Therefore, there is no reason why BP Alarm would start the contract in September
2. In addition, when the BP technician tested our alarm system on Oct2, following our receipt of the BP Alarm bill, he confirmed that the alarm did not register in the BP Alarm systemThis suggests that BP Alarm was not monitoring our homeWhy then should we pay for service that BP Alarm was not providing? Paying two companies, including BP Alarm which does not provide any service at all, is totally out of the question
We are senior people who just want to retire in peaceUnfortunately, this matter has cost us countless days of tormentWe just want BP Alarm to drop the contract and stop nagging us with their collection lettersMore important, they should learn to play fair and square.
Sincerely,*** "***" *** ***

Complaint: ***I am rejecting this response because:This was never a valid contract as it is not signed by both partiesRegarding the notice of cancellation, there was no valid date provided to base the 3-day limitation for cancelling our contractPlease refer to the supporting images to verify the omissionsOur notice of cancellation was sent by certified mail on September only to be rerouted multiple timesThe cancellation notice is currently in the state of Utah for some reasonThis is one more instance of the unprofessional nature of BP Alarm on top of the misleading information we received in the beginning of this whole processWe expect the cancellation notice to be honored once our letter is finally received.Sincerely,*** * *** ***

Dear Revdex.com, To address your last remarks, in regards to this rejection: 1- We find that you can see the faint marking of the circle around the monthsThat means that the salesman must have circled it on the original copy before removing the pink copy, which was left with the customerThe Contract had an initial term of months and a monthly fee of $The salesman made a change to the monthly feeThere was no change to the term lengthThese changes took place while the salesman and customer negotiated before the sale was made. Regardless of this argument, the months does not have to be circled. The only way to become a customer of BP Alarm, is with an agreement*** *** signed this agreement, with the terms clearly stated, which means he agreed to the terms on the agreementThe customer is even left with their own copy, to look overIn the agreement it states above the signatures that the customer should read the entire contract before signingIt is the customer's responsibility to read the contract and make sure all information is correct before signing*** *** signed an agreement for months. 2- *** *** does indeed ask the technician to repeat himself at least once in the surveyOur technician was very thorough and made sure *** heard the questions clearly and repeated any questions she may have misheard or didn't understandThe purpose of the audio and written surveys are to ensure that the customer is fully informed and absolutely certain they know what the terms of our service are and what agreement they are committing toIn the audio recording we have *** took her time to make sure she heard each question, and then answered accordingly.3- The terms of cancellation are clearly stated in paragraph of the agreementThe customer is outside of their Day window to cancel outrightThey are now responsible for the remaining balance of the agreement. 4- *** *** has not requested any such reduction in term lengthWe have received communication via email in which *** *** demanded to cancel his contractWe have requested that he call our office to speak with a customer service representative, as opposed to only via email, so that we could better work to resolve his frustrationsAs of today we have no records of phone calls or voicemails from ***If he would like to negotiate his contract he can call his salesman or our office*** *** has made no attempt to call our office, but has decided to communicate via email and now through the Revdex.comWe have cooperated with these communications and addressed all questions asked to us. 5- The customer contacted us outside of his day window to cancel outrightHe has mentioned his month for "free." This is yet another courtesy provided to the customer from his salesmanWe have been providing the monitoring for *** *** since the day our technician came to his home, switched his alarm monitoring service to our company, and *** performed that audio recording. Please see the previously attached agreement and audio recordingWe are also supplying the Schedule of Protection (SOP), which shows the installation notes and written post-install survey with ***'s signature and initialsBP Alarm has these safety nets in place to ensure that our customers are fully informed of their decision of switching to our companyThe terms of the agreement are clearly stated in the first few paragraphs*** *** signed this agreement and will be held to the terms that were agreed upon. We are supplying our end of the contract that was agreed upon by *** ***, and we expect him to do the sameIf *** *** has any other questions, we invite him to call us at 888-376-He may also call his salesman if he would like to negotiate his contract any furtherWe sincerely hope to come to a resolution with *** ***Again if we have not addressed any questions please let us know. Regards,Customer SupportBP Alarm888-376-

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to meSincerely, *** *** *** ***

Dear Revdex.com,
According to the contract that both Mrs*** and BP Alarm agreed to, in paragraph it states that this agreement has an initial term of months and if the customer does not send us a cancellation letter days prior to the end of the term or any renewal term the contract is
renewed for months.
We received a cancellation letter from Mrs*** dated May 5, stating that she wants to end her contract with us at the end of the term which ends June 30, We have received and processed her requestHer contract will not be renewed
However, at this time Mrs*** is days past due on her accountIf we don't receive this payment we will be forced to take action according to the terms we agreed to in the contract, which is attached
If she has any questions she can contact us at 888-376-
Sincerely,
BP Alarm

To whom it may concern,Two days ago, *** called in wanting to know if we received her cancellation letterI said that we hadn't but if she had some documentation that she sent it in (and she said she did), if she could email it to me directly at ***@bphomesecurity.com then I would
would process the cancellation ASAPI also told her that I can make a request for someone to go through to the cancellation letters again to see if we may have misplaced itI told her that his process takes about a week. Today she called in asking if we had received the her email, I checked my email and I hadn'tI asked her what address she sent it toShe said bphomesecurity.comI said if she would send it to ***@bphomesecurity.com then I could process it ASAPShe then became frustrated with me and said that she was going to contact the Revdex.com.As of right now, we have not yet received an email from herThe request to double check our cancellation letters will be completed early next week. As far as being lied to, We have confirmation that Ms. *** knew she was switching companies and needed to cancel with her previous oneWe also have safeguards and procedures in place to insure that this doesn't happenIn addition, we gave Ms *** months for free at the beginning of her contract to insure she had enough time to cancel with her previous company so that she would not being double billed
