Dear Revdex.com,
On 5/17/*** *** signed a Month Contract on 5/17/In paragraph on the front of the contract it states,
"The orginal term of this agreement starts on the day this agreement is signed and continues for sixty (60) months, and will automatically continue from year to
year thereafter unless cancelled by either of us in writing no later than thirty (30) days before the end of the term or any reneal term.
We here at BP Alarm did not receive a cancellation letter from *** *** thirty (30) prior to the end of her orginal term, therefore the agreement renewed for monthsWe also have customer support reps available Mon-Fri 9am-5pm if there is any questions any customer has regarding their contract or the cancellation process
We intend to hold *** *** to the contract she signed.

To Whom it may concern,Here are the answers to your recent complaint:Claim #The contract was not signed.A: The agent doesn't have to sign his/her name for the contract to be enforcedIf you read in the contract, the paragraph underneath where both parties sign their names it states, "...This agreement will not be binding until either (1) signed by a BP supervisor OR (2) We start the installation or Monitoring serviceCustomer acknowledges and agrees that customer MAY NOT receive a copy of this agreement signed by our supervisor, and such of receipt shall not, in any way, invalidate or otherwise affect this agreement."Since the *** received monitoring services on Aug29, That is the day the contract is enforced, regardless of weather or not there is signature by the sales rep or a supervisor. Claim #No Date to provide when the 3-day notification. A: There are locations on the Contract and the SOP (Schedule of Protection) where the date of the traction/installation is provided and took placeof the dates is in the handwriting of *** or *** ***They were left with carbon copies of both of these documents. Attached are the copies of the originals. In addition, no where on the contract does it state that the contract void if all the dates are not filled out. Claim #Cancellation letter was forwarded to Utah. A: CorrectIt wasWe are in the process of opening a location in the State of UtahCurrently one of our Managing Members is located there for the time beingI not sure why this has anything to do with the *** contract. At the time of signing up with BP Alarm, we gave the customer three options for billingSign up for auto pay with his Checking accountHe would have options (1st, 15th, 25th) for billing datesSign up for auto pay with a Debit/Credit CardThe customers billing dates would be the (1st, 15th, 25th)InvoicingThe Customer picked invoicingIf the customer would like to pick another option, please have them call us at 888-376-We can switch it immediately
It is true that we have had some issues with the Post Office forwarding our mail from our PO Box to our Physical AddressWe apologize for the confusion to the customerHowever, the customer is free to call as anytime at 888-376-to get an issue such as this resolvedIt should be stated that customers who pick invoicing as a mode of payment should be advised that problems like this could arise because of the addition of lag time of mail and the addition of an extra step in the payment processThough the Post Office is fairly consistent, they have made some mistakes regarding our account with themWe hope this issue is behind us going forward
Regarding cancellation of the customers contractThe contract which they both signed and agreed toIf you wish to cancel, please send a cancellation letter to PO Box Silverdale, WA It needs to include:
-Name
-Address where the security system is located
-Stating that you want cancel the account
- Signature
As soon as we receive this letter we will cancel the contract at the end of the term

Dear Revdex.com,*** *** *** *** signed a contract with BP Alarm on August 8, for an initial term of monthsIn paragraph of that agreement it states that the contract will renew on a year to year basis unless cancelled in writing by either party days prior to the end of the
agreement or renewal termPlease see the attached agreement. *** *** *** *** are in a year long renewal starting August and ending July We received a cancellation letter from *** *** *** on September 9th, The customers were responsible to pay for the remainder of the renewalThe customers opted to pay the remainder in a lump sum, and they were given a discount for choosing to do so. I am rejecting this response because: Your company is not responding to the miscommunicationby your employee that I was given? Your employee stated to me in 2016 that I had my contract until November 2017, because that was my first payment,  I wrote this down and called you in September. Because of this BAD communication by an employee at your business I was signed up for another year! Bad business!

Lets clear up a few things 1. The customer owns the alarm equipment in their home. 2. What they contract us to do is monitor there alarm system.  3. As a courtesy, we notified them of the changes AT&T is doing to their network which would affect their alarm monitoring. If they...

wanted THEIR alarm to continue to be monitored, they would need to get an updated GSM unit to work off of their new AT&T network.
In the letter we sent of our customers who have this issue, we told them that if they wanted to sign a new contract at the same price you are paying now, we would give them this GSM unit for free. If they didn't want to sign a new contract, the customer could purchase them from us for $300. The Retail price of the GSM unit.
Per the contract that the customer signed, it states in paragraph 8, "You agree to reimburse us for any cost we may incur to reprogram the communication devise of the alarm system"
We believe giving them the option of installing and receive the GSM unit for free if they sign a new contract is a fair option to our customers who don't want to pay out of pocket for the new GSM.

I am rejecting this response because: the adhesion clause was never pointed out at anytime by any agent of BPAlarms they used subversive tactics to over look that aspect of the contract until you try to cancel in reading reviews after the fact is see that I am not the one one like I said before I will pay for the month of July but no more

It is our policy (and an industry standard) that we do not install security systems into homes where the contract holder rents the home. We only install systems where the contract holder is also the homeowner.
On my March 12, 2012, both [redacted] & [redacted] signed a contract for 60 months with...

BP Alarm. Their contract does have a clause where if they move, we can move the system with them. However, they MUST be the homeowners. The system can be transferred to someone else. However, they must also be homeowners. If the [redacted] have a Homeowner that will take over the remaining time on their contract, have them contact us at 888-376-4057.
 
This contract is a lot like a cell phone contract. Where even if the individual(s) don't use the service they are still contractually obligated to pay for the service. We intend to hold the [redacted] to this contact and use every legal means possible to enforce it.

only party that has been misleading is [redacted]'s Mr. [redacted]. We have had multiple complaints regarding Mr. [redacted] and his false claims reguarding BP Alarm and its Employee's History, Legality of BP's contracts, BP's business practices, and BP's relationship with its Equipment suppliers. Even the statements made in [redacted]'s complaint are helping us as we move forward with our Legal Case of slander by [redacted] and Mr.[redacted]. We thank them for that.If the [redacted]'s need a technician to came to their house, please have them contract [redacted]-[redacted]-[redacted]. On 7/5/2014 I knocked on the door of [redacted] & [redacted] knowing they had an alarm. I was training a new salesmen so there was two of us on the doorstep of their home. I told Mrs . [redacted] that if we switched to us, we could l[redacted] their rate by $5 per month to $25 per month and add a motion...

sensor in their garage for free. I did say that their company was based out of [redacted] and that we're were based in Western [redacted]. But I did not say they were out of business or that our they were 'closing shop'. The trainee that was with me is willing to sign an affidavit claiming I didn't say those things.
I did tell Mrs. [redacted] at the end of the sale that we wanted to make sure that she didn't get double billed by us and her current alarm company, so I left her my number and said call me if she was. 
On 7/7/14 the tech came to switch the [redacted] to BP Alarm from their Previous Company. At the end of every install, a survey is done with each customer, to ensure the customer's questions have been answered regarding their alarm, and to make sure they know it's BP Alarm who is doing the monitoring and billing. This survey was done with Mrs. [redacted]. At the end of every question there is a place to circle Yes or No. Then there also a space next to The Yes or No where the customer has to initial as well. We also have the technician read out the questions to the customers and then have the customers answer yes or no. These conversions are recorded. One of the reasons we mandate this survey and recording is to to keep customers like Mr. [redacted] (who had nothing to do with the sale or install) from coming back and claiming that we lied. Attached are the files of the oral conversation Mrs. [redacted] had with the technician and the written one she filled out.
The story does not end there, Mrs. [redacted] called me a few days later and said that when she called her previous company tp cancel she was told that she still had 1 year left on her contract. I told her that I would keep my word of her not being doubled billed and would give her 1 year for free. But I said that if she take care of the cancellation at the end of the year should would be doubled billed starting September 2015. She agreed. 
Then in September of 2015, I get a call from Mr. [redacted] confused on why they got a bill from BP Alarm. He claims that he has a 3 year contact from his previous company. And that the previous company came in and installed a new system after we switched them to us. I told him that we would hold them to the contact regardless what they had done. If they needed us to send out a tech to reinstall the system we would do that free of charge, but that we intend to hold them to the contract that they signed.
We intend to use all legal means necessary to enforce the contract that was signed by Mrs. [redacted].

[redacted] sent in his 3 day notice of cancelation. His account has been canceled. We have an appointment to pick up of equipment on May 11. We hope he has our equipment. If not we wil be charged for it.

The letter needs to include Name, Address, Statement that they want to cancel the account & a signature.Please have them do it ASAP.

Therefore, according to the agreement that we both agreed to, the contract renewed for 12 months. We have processed her cancellation letter sent in after 3/30/15.
