This letter is the second response to [redacted] , from [redacted] in regards to his [redacted] As per the initial response all verified manufacturer defects have been addressed per FCA guidelinesEvery due diligence has been made to duplicate any customer concerns by this dealership This dealership has at no time noted any manufacturer defects with the side doors The complaint about the vehicle being "jumpy" appears to be a concern that was not mentioned to this dealershipCustomer did express a concern that the vehicle was shaking and whining all the time on 06/08/with miles at which time there was no manufacturer defect noted with the vehicleNo driveability related issues were mentioned on the three following visits by the customerThe customer did show virtually all interior seat mounting bolts to myself that are simple oxidation that are well within normalAgain, in the event that Mr [redacted] believes he has a manufacturer defect with his vehicle we will certainly continue to take every step to address his concernMr [redacted] also has the ability to have any [redacted] dealer inspect vehicle for any warrantable concerns that he may havePlease contact our Service Director, Chris Rat either ###-###-####, or [redacted] @***.com with any questions or concernsSincerely, Christopher R

I an responding back to Mr& Mrscomplaint they filed with the Revdex.comAfter receiving the complaint, I reviewed the complaint with Billy Caprara himself who was not aware of this situationBilly Caprara instructed me to get hold of Mr& Mrs, [redacted] and assure them we would correct their concerns with their [redacted] truck they had purchased from us.I was finally able to reach the [redacted] on Monday evening 8/17/The phone number that was on the complaint was Mr [redacted] cell phone which he works construction during the day and unavailable to be reachedMrs [redacted] went over everything that had happened with me and what other concerns had come up with their truck since then.The next day I had a flat bed truck pick up Mr& Mrs [redacted] truck in their driveway, being their was a issue with putting gas into the truckWhen the truck arrived Tuesday afternoon, I had our [redacted] Service Manager "MsLori M.", call Mrs [redacted] as we now had Mrs[redacted] day time phone and go over completely again the concerns they were having with their truck so we could correct themBilly Caprara himself was involved every step of the way on this complaint to insure the [redacted] would be given top notch supportWe were able to get the [redacted] truck into our shop mid day Wednesday and had one of our ***/ [redacted] certified technicians go one by one through each concernHe corrected the fuel tank issue as it was just an alignment and clamps being tightened to insure their were no leaks occurring, which corrected the putting gas into the truckWe also found that the serpentine belt was in need of being changed as it was making a very loud noise, so we replaced the belt at no charge to the [redacted] Mrs [redacted] also stated that the A/C on the truck was not working, so I had the technician do a complete check over of the system and after testing the system, we found that the A/C needed recharging which we did and the A/C is now working to factory specificationsMsMstayed in touch with Mrs [redacted] all along the repair process to keep her and her husband up to date with our progress and she coordinated having the truck delivered back to Mr& Mrs [redacted] , at their house, so as not to further inconvenience themBeing the person Billy Caprara is, and the problems Mr& Mrs [redacted] had with their truck, Billy did not charge them anything for all the concerns that were addressed for Mr& Mrs[redacted] This should complete this complaint with Revdex.com

This issue has been reviewed with the customer several timesthe vehicle history, vehicle computer, train of ownership, Manufacturer history and [redacted] history all verify that the vehicle's odometer is accurate and without discrepancyCustomer's complaint has no basis or merit

I apologize for the delay in responding to this complaintI have been away on unexpected family mattersOnce I initially received this complaint, I got with our [redacted] Service Manager, Jason P., to find out exactly what was the issue with Ms***'s [redacted] Being the vehicle had originally been a Canadian vehicle, we had installed a new U.Sinstrument cluster which was defective creating the issues Ms [redacted] was having with her [redacted] We reordered another U.Sinstrument cluster along with a new control module and once we got the replacement cluster we installed it and thoroughly checked to make sure that the cluster was working correctly, which resolved all of Ms***'s other problemsShe picked back up her [redacted] the week of 6/20/All the time we had Ms***'s [redacted] , she was provided courtesy transportation from F.XCapraraThis should resolve this complaint with the Revdex.comRespectfully - Ron L/ F.XCaprara Corporate

The purchaser was aware of the Canadian origin of the vehicle purchased as per the Origin statement executed by the buyerThe purchaser (on the first purchase, see exhibit: buyers order) agreed to make a downpayment due to FX Caprara Chevrolet of $The purchaser made further acknowledgement
of the down payment due to FX Caprara Chevrolet with a handwritten promissory note (see exhibit: promissory) proffering an excuse as to why payment wasnt made yetFX Caprara Chevrolet fulfilled all obligations to the purchaserDue to an issue unrelated to the purchase obligations of the seller/purchaser, the purchaser stopped payment on the $downpayment check due to the seller , thereby defrauding the seller and materially and unjustly enriching himselfThe contract the complainant refers to has been paid off and FX Caprara paid off the gross amount due even after being shorted $by the complainant on a second purchase (see exhibit buyers order 2) which clearly indicates the gross payoff reflected from the first purchaseThe complainant owes FX Caprara Chevrolet $and a complaint to the Revdex.com does not negate that obligation or the utterance of a bad check or having received benefit of goods received without paymentFX Caprara worked diligently and in good faith in trading the customer out of the first purchase and into another vehicle acceptable and on terms acceptable to the complainantThe complainant benefited from the good faith efforts and interest of FX Caprara ChevroletAs of this writing the complainant has made no efforts to make good in the utterance of the check for $As a result of this breach and subsequent loss to FX Caprara Chevrolet, FX Caprara Chevrolet intends to pursue every available remedy to recover the $including possible criminal, civil, collection or repossession efforts as allowed by NYS lawThe complainants complaint is without merit and is being levered and submitted as purely retaliatory in nature

I appoligize for the delay in responding to Mr***'s complaintI have been away on family and health mattersBilly Caprara himself, has been in touch with Mr*** and on Saturday 8/27/supplied Mr*** with a rental vehicle at NO-Charge to Mr*** so Mr*** could make a trip to Chicago, as Mr*** was still having issues with his *** ***Once Mr*** returns back to the area, Billy Caprara and Mr*** are setting up a appointment to meet and see what maybe done to possibly trade Mr*** out of his *** if he so desires that optionI know there was some confusion about the previous use of Mr***'s ***, being he had not received a *** *** report on his truck at time of purchaseThe vehicle was indeed a new vehicle that a Fleet & Leasing company Leased to the *** ** *** in ***, Canada and was registered as a "Corporate Fleet Vehicle" as the fleet company owned the vehicle they were leasing to the *** ** ***It was never registered as a rental vehicle(See Attached *** ***) As you will see by the copy of a buyers order I have attached, that under Vehicle and Traffic Law 417-A, a automotive dealer must disclose if a vehicles prior use was used as a police vehicle, taxicab, drivers education vehicle, or a rental vehicleNone of these classifications fall under a lease vehicle, which many consumers lease their vehicles today, verses buying them and the vehicle is actually owned by the leasing companyI personally verified with *** ***'s service department on 8/29/the actual manufactures warranty that was left on Mr***'s ***, being it was originally a Canadian vehicleThey confirmed that the balance of Mr***'s 36/Manufactures Exclusionary warranty and 5/Powertrain warranty were still in effect and good at any *** dealership in the United States or CanadaI'm sorry to hear that other dealerships may have miss informed Mr*** on the actual value of his *** and coverage's still in force by the manufacturerJust because this vehicle originally came from Canada, does not reflect the value of the vehicle when it has all the same coverage's, the same vehicle as Mr***'s would have if it was originally from the United StatesPlease note that the *** Value guide, that all dealers use and all banks use, to value a vehicle for trade-in, resale, and how much of a loan a bank will give on a vehicle, does not differentiate weather the vehicle was originally a Canadian vehicle or a United States vehicleMileage, Condition of vehicle and remaining Manufactures warranty are what make the determination of a vehicles valueI am sure once Mr*** and Billy Caprara are able to set down together, that they will be able to work out a agreement that will resolve this complaintRespectfully - Ron L- F.XCaprara Corporate

originally been a Canadian vehicle, we had installed a new U.S. instrument cluster which was defective creating the issues Ms. [redacted] was having with her [redacted]. We reordered another U.S. instrument cluster along with a new control module and once we got the replacement cluster we installed it and thoroughly checked to make sure that the cluster was working correctly, which resolved all of Ms. [redacted]'s other problems. She picked back up her [redacted] the week of 6/20/2016. All the time we had Ms. [redacted]'s [redacted], she was provided courtesy transportation from F.X. Caprara. I am writing in response to complaint ID [redacted], [redacted]'s 2012 [redacted]. I have reviewed the correspondence sent to your office and the request from the vehicle owner for assistance with the cost of repairs. [redacted] purchased this 5 year old vehicle on 03-26-2016 with...

30,487 miles from our dealership. On 02-08-2017 she brought her vehicle to another dealership ([redacted]) for a concern of her horn not working. While the vehicle was at [redacted] she was upsold maintenance repairs (battery service, battery cable, radiator, water pump, shocks, and air filters). Mrs. [redacted] contacted me in regard to the upselling from [redacted] and demanded that we cover the cost of the repairs/maintenance explaining that the estimate was around $2000.00. I explained to Mrs. [redacted] that she was well outside the Used Vehicle Warranty but we (FX Caprara Chevrolet Buick LLC) would be more than happy to look at her vehicle to verify the upsell from [redacted]. I further explained that if the vehicle was in need of such maintenance repairs I would work on better pricing in an effort to save her money. She was not happy with the response/offer and decided on her own account to have the repairs/maintenance completed at [redacted]. Mrs. [redacted] has owned the vehicle for 11 months and put 12,541 miles on the vehicle when she brought it to [redacted]. Well outside the implied used vehicle warranty. This complaint is arbitrary and subjective. As the selling dealer we invited her to bring her vehicle here for us to verify the upsell from [redacted] and then see what we could offer her to minimize the cost to her. She denied our offer by having the work completed at [redacted] on her own account. In closing, general maintenance and vehicle upkeep, is not a selling dealer responsibility. Respectfully, Alex N.
