We signed a contract with Paul C from Buckeye Construction LLC and agreed on a design for a patio and a pergola. We gave him around $14,300 to start the process. Currently (6/9/20) the pergola has been built, but when the workers he hired to do the paver came to our house they told us that they could not do their work on the project because the pergola was not stable enough and thus it was unsafe. When we told Paul this, he claimed that the paver workers told him that they did not want to work with us because we are frustrating to work with and we keep changing the plans. Since the beginning of April he has been claiming that he will come and get work done, but nothing has happened yet. We then called the worker (who works for ***) and asked him why he had not come to work on the paver. He told us that he could not work on the project because the pergola was unstable and he told us that he did not want to work with Paul anymore because of all he has been through with him. He also verified that what Paul had said was not true. We found it quite troubling that Paul would speak to us the way he was and he made up this lie that made us sound like horrible people. We have been asking him to finish his job but he has yet to do so. He is now saying that if we continue, he is not going to work on the pergola without additional charge. This was shocking considering that the pergola was not initially built unsafely. It has been over three months since we first started working with him and we have made little progress on the patio. Every time he says he will start the job on a certain day, it does not happen.

We had a great experience with Buckeye. They came and fixed the toilet in our only bathroom the very first day we signed a contract . They stayed late until we had a functioning toilet and then came back 2 days later to start our bathroom redo. Brandon and Jeff worked hard and always made sure to leave our bathroom in a state that we could keep functioning. Brandon's wife and son cleaned much of our house as the project ended to remove the dust and general construction mess that can't be avoided. All told, we are very happy with the results and it only took 2 weeks.

On September 7th, 2018, we signed an agreement for $13,500 to construct a deck alongside and partially around our new above ground pool. It is now November 30th and the deck is not complete. The work that has been done to date is poor. The original posts holes were dug incorrectly. Another crew member tried to repair as much as possible. but it is clear that the posts are still skewed and the deck boards will not line up properly and many are not even flush to the edge of the cross beams. It looks terrible. The deck itself is not square to our home, therefore, the walkway we want constructed is at an angle and they tried to cut a sliver of wood to fill the gap. There was confusion galore over how to construct this walkway and I finally agreed to have it as a ramp and it took a third try to complete this task, albeit poorly. Since the outside posts don't line up, the railing looks like a snake across the length of the deck. It looks like we are on at least our third crew working out here. The main person with the original group walked off the job after not getting paid. He knocked on my door before he left warning me that shortcuts were taken and the deck was going to turn out poorly and that the organization has several complaints and possible criminal issues. He was definitely right on the deck as it is horrible. The gentleman also indicated that he was threatened with physical violence. I called the owner who indicated that this person was just a disgruntled employee who they fired because the deck was supposed to be done the week before. That was approximately over 20 days ago. The bottom line is that I am already in the hole for $9,000 and I am not paying this organization another dime. At this point, the deck cannot be straightened out and the workmanship has suffered accordingly. I am stuck with paying $9,000 on a deck that is poor. I will say that the Salesman, George was great to work with and I don't hold any of this against him. It appears that the company is overextended and I have suffered accordingly. For instance this week, I was told that the crews truck broke down from one party and told that the crew was sick by another party. The week before, they told me the deck was going to be completed on Friday of last week. Of course, no one showed up to work and the deck was not completed. I am very frustrated by the dishonesty, the delays and the poor product that I am overpaying for and am stuck with in perpetuity. I have photos to document all of the above. In addition, we were supposed to have a 4 ft wide staircase on the back. I don't believe that is the case. We were also supposed to have an area for storage that has not been completed and much of the skirting has already been installed.

I am writing to you, in response to a complaint filed by ***, for work done on his deck. Mr. states that the post holes were not dug correctly. Therefore, the posts were not correct. There was a permit for this job. And, inspections done by the city. The posts passed that inspection. Mr. also states that the framing was messed up. Again, there is a permit. And, an inspection was done. The framing past the city's inspection as well. The homeowner states that the handrails were not correct. He was informed that Buckeye Constructions was willing to fix that. But, they were told that no-one is to come on his property. Which makes correcting the handrails impossible. The owners of Buckeye Construction interviewed a sub-contractor. He showed photos of his work. The work was good. The sub-contractor was then hired to build this deck. The contractor was paid part of the total fee. The balance was to be paid, when the job was completed. He wanted more money, prior to finishing the job. When it was not given to him, he walked off the job. Before doing so, he made negative comments to the homeowner. One of the owners went to the site, and checked everything. He himself, reset all the framing. Another crew was brought in, to finish the job. This is not uncommon. As Mr. himself stated, "the owner asked for the opportunity to make corrections." It appears that instead of having the job completed, he would rather not pay the final $4,500.00. The total of which, is on the contract signed by ***.We are still willing to fix/complete the deck. But, expect to receive the final payment.Thank you,

I appreciate the opportunity to respond. Let me walk through this again for the business owner.1. The deck is six inches off square. This was admitted by Paul, one of the owners, after he measured it with me as a witness along with George, the salesperson. You can see that it is not square with the naked eye. 2. The original contractor also stated that the deck was off square by 3 inches before he left the job and that he didn't work like that and the deck will not turn out properly.3. He also indicated that inspectors do not look for alignment as part of the inspection. So passing inspection is irrelevant. I brought this up and took the owner's word in good faith that all was well.4. The posts are not set correctly. The long rail along the back of the deck is uneven. This is a by product of the posts not being in alignment. Many of the decking boards do not even line up with the edge of the framing of the deck.5. The railing is pathetic and acknowledged by associates of the company saying it is the worst he's ever seen. It is also built six inches too short in height. This was also stated about the skirting which you will see in the photos.6. The owner also admitted that the boards hugging the pool are done improperly. Before leaving, the original contractor indicated that workers wanted to tie the deck into my pool. This would have ruined my pool.7. The final crew that was brought in was hired because he had done a fence for the owner. There is no indication that the owner had ever seen any of his deck work. The work of this crew makes it painfully obvious.8. The deck was to be made to match the deck I currently have on my home since they are to be connected. It;s not even close and this is admitted by the owner. No reputable deck contractor would ever build a deck like this.9. The walkway was adjusted 3 times and is clearly skewed at an angle to accommodate the fact that the deck is obviously not square to the home. It looks ridiculous.10. The owner is correct. The contract was signed on the front by my wife. What was not initialed and dated was the back of the document which speaks to additional terms and conditions. Nor was this document ever covered with my wife. The salesperson acknowledges as such and I made it clear to the owner that it was not covered or signed after he threatened to take me to court if we didn't pay him and allow remedy.11. I stated that I did not want any additional work done to the deck or anyone on my property in lieu of our go forward decision or without me being there. Keep in mind that I had to arrange my work schedule several times to accommodate workers. I have already memorialized the several situations where work was to be completed and nobody showed to do so. Also, I have been given no reason to trust this company with access to my property without my supervision or a guarantee of remedy.There are other credibility issues which I am holding while we consult with our attorney on next steps.The bottom line is that we were willing to pay a premium price (many I have talked to say we were willing to pay way too much) for the promise of a reasonably timed, acceptable product. We received neither and I am not willing to throw more money at a problem who's only remedy appears to be potentially starting nearly from scratch. This is much more than fixing a railing. It seems and was stated by the owner that his greatest concern was how much money he was going to "eat" for this job. The reality is that bad business practices including overextending available resources got the company into this situation and we as the consumer are suffering in return. If the owner is so concerned about eating money, he should be willing to seek subrogation against the sub-contractors he hired to do shoddy work.I will forward a large amount of photos to support everything I have previously written under separate copy.

Good afternoon, as I stated before we are welling to fix any issues will the project.We still have not been granted access to finish the project. It was informed to Mr, *** that we do not have a problem with fixing the parts of the project he is not happy with. The home owner signed the contract in agreement to the project. we are still welling to fix any issues with the project and complete the project. There was delays to starting the project due to having to adjust the deck and measurement to ensure the permit was approved. The home owner was kept in the loop and was in full agreement of the drawing once permit was approved as well as full agreement to any changes made during the project. Again, we would still like to finish the job but need permission to come onto the property. On the terms and conditions on the back of our contract;Item 1- such dates are estimates only and are therefore subject to changeItem 5- Delays- the customer agrees that the company is not liable for delays caused by acts of god, strikes, inherent defects in the premises, weather conditions, delays in obtaining materials, the company not gaining entrance to the premises or neighboring properties as necessary, changes to the products or services, or any other causes beyond the company control. Item 14- Access to job location- the customer grants the company permission to enter upon the premises as necessary to complete the installation of the products. Item 15- service- the customer shall not delay any payment or signing of necessary papers because of the inability of the company to obtain a minor part or to complete a minor service necessary to the proper functioning of the work completed under this agreement. Again we will fix any issues with the project and complete the project as under contract.Thank You, Paul

I appreciate the company's willingness to repair and complete the deck to our satisfaction. If this is intended to be done based upon what we have already paid ($9,000) and there is a plan in place to do what it takes to make sure the deck is square to the home, the deck is built to agreed upon specifications and quality, including matching the deck that is already on our home as requested, I am willing to discuss further. The monies paid should be more than enough to cover costs and it is my understanding that the labor will be conducted by the owner. It is my understanding that the original contractor was paid only $350.00 although I cannot verify except I may hold evidence that there was payout. I am assuming that only upfront money was paid to the finishing contractor, if they were paid for a finished outcome, that is the fault of the owner for paying for extremely poor output and he should be subrogating against the subcontractor. This is for the owner and the sub to workout. If he has not paid the finishing sub for the final product, then those monies are still held by the owner to handle any necessary materials and his personal sweat equity to complete the job.

I am perfectly willing to discuss further to get resolution. That said, every response I have seen has been cosmetic at best.

I do have a voicemail from Paul and it is much appreciated. Unfortunately I was back in Eastern Pennsylvania for the funeral services of a very close relative for the week and will return his call as soon as I am caught up post-my return here to Ohio.

As it pertains to "Terms and Conditions", we showed him an unsigned/initialed copy of this document and it was acknowledged that this was never covered and never initialed and dated by my wife or myself that we are aware of and we have advised our attorney accordingly.
