I have contracted a service from them and paid deposit for the work to be done, but was to be voided if I cannot sell my property to finance the go forward with work. I found my property's Hoa had legal litigation with construction since 2013. So even I had buyer , buyers bank won't approve the loan, so I went into the Ritz and explain, I can't sell and in financial bind if I could have my deposit back minus the time they spend, and when I could sell the property we could start again. They say no and they gave me a year to sell the property. They assured me that contract is void if I can't sell my condo, from begining to end.
signed two separate contracts with our company. The first contract she signed was on February 14th, 2017 when she hired our company to design her project and complete her building plans. This first contract had nothing to do with the second contract that she signed a month later on March 16th. *** signed the second contract with the intent of hiring our company to then build her project. Almost entirely, the paid amount in question by Miss *** was a stage payment made by her on her initial contract. Only $1000 of the amount in question was for the deposit on her second contract. This stage payment amount was due once she approved her project designs and her preliminary plans. Additionally, as a point of clarification, at no point did our company agree to “void” her second contract if she “failed to sell her condo”. As a general practice our company simply ensures every homeowner that if for whatever reason they cannot secure proper financing then we simply are not going to build their project and force them to pay money that they do not have. Any homeowner wishing to cancel a contract may do so as California law permits. In Miss ***’s case though, our company tried for months and months to communicate with her with no returned not so much as a courtesy return phone call or email. As a result, any opportunity that Miss *** may have had to terminate her second contract and have her deposit returned, lapsed. Currently, both of ***’s contracts are open and will remain so for up to 1 year from the time of inactivity. Until then we will be more than happy to continue working on either of her contracts should she request that we do so.
