I am rejecting this response because:When we went to the dealership we specifically told the salesman that we were looking for payments around $500, he showed us a small doublewide and said the price was 54k and that we would have to put $500 in earnest money on it, which we did.  I remember this very clearly.  I am not so stupid as to not know that when you look at a home to buy the price reflects the general idea of the monthly payment!  (example 50k roughly $500ish per month versus 70K roughly $700ish per month).  When talking to the finance guy he said that the price of the trailer was 70k plus, I remember this clearly as it was such a huge jump in price.  I also told the finance man that we were looking for payments around $500, he came back with payments over $700, which I told him was unacceptable and that I was not comfortable with payments that high, to which his response was that the bank felt we could make payments that high.  This was again unacceptable and we walked away.  There was no contract pending, we had not even gotten through the financing progress so no earnest money should have been required.

First, I don't have a $54,000 double wide.  Secondly, we don't "jump up the prices", so I have no idea what the customer is talking about....and this happened last year???  I had my admin research the deposit.  The $500 was deposited on a home that we sell for $79,900....

 Therefore, the $54,000 price is unheard of.  The deposit was made in May, 2014.  The customer was approved on the home...even after they agreed to pay the asking price.  My question is..."Why give a deposit if you think we "jumped up the price?"  As far as terms being unacceptable....this is the first time I have heard anything about that.  We take deposits on homes when customers want to buy homes.  We don't take deposits, hold homes for a duration, and then give it back a year later because they changed their minds.  The same goes true for real estate transactions.  Homes are taken off the market at time of deposit....if the customer cannot secure financing, deposits are not returned.The $500 deposit will be good toward the purchase of a home at Byram Home Center at any time they are ready to purchase a home.

All the remaining issues are covered by factory warranty. All warranty items have been sent to [redacted] at Cappaert Housing. They prefer to do all their factory repairs. They do not allow their dealers to fix the factory related items. [redacted] has been notified, again, of the negligence.

I am rejecting this response because: We could not get a permit until we had a bill of sale - so it was not like we should have had it the day we bought the mobile home. They knew this when I was told it would take a week for delivery. They had plenty of time to deliver before the rain started and since it stopped.  They did not even have it ready to move as recent as last week. There have been plenty of days if they had made preparations to actually deliver.

I am rejecting this response because: it finally got here, but there is a problem.  It is the wrong one!! Sure, send me $250 and I will start counting now to see how many days it takes to get here. I still have a paid for house that has never been delivered.

The [redacted]'s told the Fire Marshal that they were happy with the repairs that were made to the home by Byram Home Center.  The installler answers to the fire marshal...they are subcontractors.  Per Mr. [redacted], MS Fire Marshal Officer, Byram Home Center has made all necessary repairs to...

the home that he required.  Byram Home Center does not provide or sell used AC units with used homes.  If there happens to be a unit with a used home (and we have no way to know if it works or not), then sometimes the movers will take the unit with the home.  Again, as-is because we do not know if it works or not.  The home that the [redacted]'s purchased had be unoccupied for quite some time before Byram Home Center even bought the home home to resale.  Also, the only way to determine if the AC was good or bad would be to rehook it to the home...Mr. [redacted] told the mover that he wasn't even going to try and hook up that old unit because it probably didn't work anyway.  I have done everything that the Fire Marshal has asked me to do.   Thanks!

I am rejecting this response because:After the horrible deceptive experience me and my husband had with this dealership we would not even entertain the notion of buying from them and it is insulting that they would even propose such a resolution.  The $500 "earnest money" as they called it then (not deposit) needs be returned to us.

The Fire Marshal deals directly with [redacted].  The anchors that are securing the home are suffice, and did not have to be changed, from what I was told.  This could have been eliminated a while back had the Fire Marshal tested the soil at inspection, along with Woods Mobile Home Movers.  However, the final inspections have been completed, that the Fire Marshal was requiring.  He is the only one that can put the sticker on the home.
