In regards to the above mentioned complaint, there is no request from the customer as to what they would like to happen from Accurate Pest Control.The report/inspection was ordered on 9-15-by Tracey Kelley, the buyer's realtor Ms [redacted] did not make the orderIt is clear to contact the seller's agent for access to the propertyThe seller's agent, [redacted] was contacted and he provided a lock box code to gain access to the propertyThe order form is attached.The inspection was done on 9-21-and forwarded to [redacted] 's office, the settlement attorney.The quotes in the customer's complaint are not correctThe customer had the report at settlement and used it to settle (the mention of it being removed from the settlement sheet by her).There were many calls between Accurate and Ms [redacted] to attempt to collect the debtShe was given a date to pay by or it would be sent to a collection agency for further attempts to collectWhen payment was not received.by one week past the date given to the custome r it was turned over to a collection agency with collection fees added.We received payment of $125, the original amount, on 2-26-Unfortunately once it is given to a collection agency their fees are added for their work attempting to collect the debt.At this time there is a balance of $for the collection fees Any further questions should be directed to First Collect at [redacted] Attached is the order and the inspection report

Accurate Pest Control does not agree with the customer’s claims and demands The money paid by the customer is not refundable The contract does not state so This is because most of the labor has been provided at this point and all of the materials have been paid for in an annual payment to Dow based on the size of the house, not how many stations are used for The section of the contract that the customer is referring to only applies if Accurate no longer represents the Sentricon system Not if the customer changes their mind See section C.3.a.iv To date the customer has written letters to us, emailed Dow times, letter to Department of Justice and one to Revdex.com These include unreasonable demands such as a demand to speak to the CEO of Dow The system can be re-installed and monitored on or about April to finalize all services If the customer chooses to do this the option to renew next year in September will not be available A refund can not be provided See attached letter, contract attachment and related documents in response to the Department of Justice inquiry This will allow more detail into the situation

Please see the attached contract In the center, in bold, at the point that the customer initialed it states that the service is to continue on a service to service basis following the original term of the contract and that either party may cancel in writing We never received a cancellation The service was provided as per our obligation We service thousands of customers this way, many for over years This contract is not unlike other recurring service contracts in that there is an initial obligation and it continues after Phone, trash pickup, cable, lawn service, gas, etc The fee of $for the last service is due If the fee is not paid we will continue collection efforts including additional fees as per the contract [redacted]

The contract states: "If Accurate Pest Control, for whatever reason, ceases to represent or to be authorized to represent the Sentricon System, Accurate Pest Control will: ivif the Customer elects to discontinue the relationship, refund to the Customer an amount equal to the fee paid for services not yet received.."
Accurate is being dishonest by claiming that Accurate has provided "most of the labor" at this pointThe annual inspection of my crawlspace was not completedWhen I called Mr*** on October to report the conduct of his technician, I told him that his technician, ***, who normally comes to my home is very professionalMr***, instead of sending *** to complete the inspection, sent the same technician the same day without notifying me; and he is now claiming that I didn't answer my door and my gates were lockedThe annual monitoring of my Sentricon system was not due until March 2018; and this is the majority of the labor related to the contract
My emails to Dow were appropriate because I could not reason with Mr***; and he was abusive to me on the phoneMy complaint, not letter, to the Consumer Protection Unit, Delaware DOJ was appropriate because Mr*** is not telling the complete storyMy three letters to Mr*** were sent to cancel my contract with Accurate and to attempt to arrange a date and timeframe that would work for both Accurate and me for Accurate to remove the termite stations from my property, according to the contractSeveral of my emails to Dow Agrosciences were sent to try to arrange for a representative from Dow to remove the stations so that I would not have to deal with Mr***
Mr*** ignored my letters and called late Thurs, Oct and left a message informing me that Accurate would be here on Fri, Oct to remove the stationsI immediate faxed one of my three letters because I had plans for FriInstead, Mr*** sent the same technician I had complained to him about to remove the stationsThe technician did not notify me that he was hereHe entered an area of my property with an open gate and placed cinder blocks on both sides of my locked gate so that he could climb over the gate to remove the stationsThis is disrespectful, abusive, and unprofessional on the part of AccurateI felt violated because the technician had to walk past a door with a doorbell that he did not ringHe did not call me to tell me that he was here and to ask that I unlock the gatesBeyond that, I told Mr*** that I did not want this individual to come back on my property after October
I did not make an unreasonable request to "speak to the CEO of Dow"I sent an appropriate email, after Mr*** sent his technician to my home with permission to enter my secured area by any means, to learn why Dow AgroSciences would condone this conductI asked for the contact information for Dow AgroSciencesDow's Technical Specialist, MrJeremy Adamson, called me on October He explained that he had been travelling and did not know that Accurate had removed the stations or how they were removedHe explained that Dow AgroSciences has nothing to do with the contract between Accurate and meAccurate's contract names Dow AgroSciences as though they are part of the contractAfter I explained how the stations were removed by Accurate, MrAdamson said that Mr*** was willing to reinstall the stations and to monitor them in March I told him that under no circumstances would I ever allow Accurate Termite to have access to my property; and I told him that Mr*** would now say that because I did not accept his offer, he would be entitled to keep money that I have already paid for services that he has not providedI was right!!
Since when did Delaware consider it acceptable for service companies to dictate dates and times without any consideration for the customer/homeowner's schedule? Since when did Delaware consider it acceptable for service companies to send technicians to a customer's property after the customer complained to the company about the technician's conduct and asked that another technician perform the service? Since when did Delaware allow service companies to have access to the customer's property by climbing over unlocked gates instead of ringing the customer's doorbell or calling the customer?

*** This dispute has been resolved between us and the customer. The contract stated a day cancellation notice in writing. We offered a courtesy credit and the customer paid the remaining balance on 10-9- I am worried that this said overdue

Attached is the contract that clearly states cancellation is to made in writing. We received this on 2-27-17. The letter is dated 2-25-and is attached. Email is also available for this. As of today there is no balance due and the service has been cancelled since
2-25-17. A refund for service provided is not available

[redacted]        The customer is factually incorrect.  The initial service was performed on 3-21-14.  The contract was for a service to be performed every three months for $99.  The next service was on 4-9-16.  This was the one and only time a non scheduled service was done as requested by the customer because they had a bug problem.  A return trip shortly after the first service is expected and is why we include no charge retreat service in between scheduled services.  The following 2 services (6-9-14 & 9-15-14) were the normally scheduled quarterly services at $99 each.  Attached is a full service history showing the one and only time a return trip was necessary.         For the following six months the customer did not inform us of an ant problem.  It is likely that after the service was performed on 9-15-14 and not paid for that an ant problem got continually worse since no further services were performed due to non-payment.        When I made attempts to collect the payments due the customer informed me he had lost his job and could not pay at this time.  He made two partial payments on 12-31-14 and 9-21-15 for a total of $56.97.  Because of this we waited 17 months before it was turned over to a collection agency.        I find it unusual that the customer's concerns changed from not being able to pay due to job loss to the service was not adequate.  This complaint came only after the account was turned over to a collection agency.        As I offered previously.  Accurate agrees to remove all interest fees and consider $203.65 as full payment.  It seems that the only satisfactory result from the customer is to completely eliminate the full amount.  This is not possible by Accurate.       [redacted] General Manager Accurate Pest Control

Accurate Pest Control provided an inferior service. The rep who serviced our house was in & out of our house within 5 minutes. On one occasion he became aggravated with me when I was asking him questions and stated he was in a hurry because he was late for his next appointment. That is not true that they had to come back out on one occasion. It was actually three occasions that their rep had to come back due to their inferior service, and even after that our bedroom bathroom and kitchen were still infested with ants and I had to treat the house myself with chemicals I purchased from Home Depot. Although I feel that my wife and I are due a partial refund, we would be willing to settle this if Accurate zeroes our account out. Their company provides inferior service and word of mouth in my area is to avoid them due to their incompetence and shady business practices.

account further service can not be provided until past due amounts are paid.  We did have to return once, two weeks after the initial treatment, to re-treat for ants.  This is normal especially at the beginning of a service.  There were no further retreat requests until 9-15-14.  Service was done and only a portion was paid for.  At that time the customer was going to pay the balance at a later time.  Full payment was not made.  After several phone calls and conversations with the customer about payment the account was turned over to a collection agency for the balance of the amount due, interest, final service of contract and collection fees that are owed to the collection company.  That amount is $227.41.    Accurate can agree to remove the finance charges of $23.76 and consider a payment of $203.65 as payment in full.   See attached account and payment summaries.       [redacted] General Manager Accurate Pest Control

unusual for a home to get bat bugs from bat infestation.  In fact bats can also carry bed bugs.  The only real difference between bat & beg bugs is the source of the problem.        The treatments done would have been necessary regardless of when the bat infestation was discovered.  They were necessary to treat the living areas and eliminate the bug infestation that had spread there prior to any of our services.        We recommended they contact someone to eliminate the bats.  This is a service that most pest control companies do not provide.  Once the bats were gone the attic was suggested to be treated at no additional cost to the homeowner.        If the bats are not eliminated the bug problem can not be solved because the source is continuous.        Our offer when the bats were discovered was to treat the attic area at no additional charge.        It seems the owners only wanted money back to pay for the bat elimination.  We can not be responsible because both the treatments we performed and bat elimination was necessary.     [redacted] General Manager Accurate Pest Control
