On 3-10-17 a wood destroying insect report for real estate settlement was performed.  The cost of this and what the customer paid is $125.  The additional $125 was for the water test performed.  The customer claims in his complaint that the cost was $250.The customer is getting a VA...

loan and all VA, HUD and other government loan programs require inspection to all structures on the property.  See attached Department of Veterans Affairs Bulletin 26-06-09 section b, as well as US Department of Housing and Urban Development reference guide section 2.  The customer claims otherwise in his complaint.The inspection report states that live termites were found in wood debris under the main house, termite damage (but not live termites at that time) in storage area and outbuilding and wood boring beetle activity signs (frass) in outbuilding.  Moisture was also found in the crawl space.A recommendation was made and proposals were given to treat these structures.  Guidelines from page 2 of the report were followed.  These are HUD approved guidelines pre-printed on the report.The inspector did not suggest whether or not the damage noted needs repair.  The inspector's training do not allow him to report on structural integrity.  See page 1 of the report stating "if any questions arise regarding damage indicated by this report, it is recommended that the buyer or any interested parties contact a qualified structural professional to determine the extend of damage and the need for repairs".The report is indicative of the conditions at the property at that time.  It is not unusual for homes to have these problems found during these inspections for settlement.  At any time Accurate Pest Control will return to show any party interested their findings.  Unfortunately, VA etc. loans have much more stringent requirements.  The customer is under no obligation to treat or fix any problems.  Some loans do require this only if the customer accepts the loan.If the customer still has not settled his loan, the report is no longer good.  Please see page 2 stating that the report is good for only 90 days.Because Accurate performed the inspection and provided all necessary reports a refund can not be given.  I can only suggest that the customer and company part ways permanently. [redacted]General Manager

[redacted]   This service specifically states that there will be no advance call.  The signed contract is attached.  The service is meant to be exterior preventative maintenance.  When this is done the customer is notified by mail.  Whenever the customer needs...

or wants an interior service they simply contact us and let us know when they are available to allow access.  There is no charge for this and it allows the maintenance to be kept on the exterior (where most bugs originate from).  When the customer needed this previously they contacted us and we returned at no additional charge.   As far as the customer stating what I said in the complaint, he is completely wrong.  I did not tell him it was a mistake.  I explained the same as the above paragraph.  Unfortunately a demand by a customer does not change the signed service agreement.   The customer cancelled service on 8-23-16 and did not want a free interior treatment at that time.  At this point I am not sure what can be done to come to a satisfactory compromise since it has been 2 months since the contract ended and any further service will be corrective and not preventative.        [redacted] General Manager Accurate Pest Control

The contract is clear. The customer is obligated to 6 services.  If they wish to continue the service will continue on a service to service basis afterwards. This is explained in the attached contract. This is a bold section of the contract directly next to customer's initials. I do not...

consider bold print to be obscure as the customer states.The reason for this is many problems may need continued maintenance or additional services. If we stopped every service after 6 months many more customers would be upset. Business must choose a method to satisfy most customers. Business cannot satisfy each individual wish of each individual customer.Accurate cannot refund any amounts. There a $295.78 past due balance from this customer for other services performed. Accurate is requesting all past due amounts be paid in full.

Accurate Pest Control has not ceased to represent the Sentricon System therefore the customer is not entitled to a refund. The customer notified us in writing that she wanted the system removed. We removed the system. The customers liberal discription of her feelings are out of our control. I simply do not see where the customer was violated. As we already offered Accurate can reinstall the system at no charge. The inspection was completed but can be re-inspected at no charge. The monitoring previously scheduled can be performed at no charge. If this option is chosen by the customer the service will not be available to renew in September 2018. At that time Accurate will choose to no longer provide service for the customer, the stations will be removed and the parties will not continue the relationship. If the customer chooses this it must be provided in writing. Simply put Accurate is offering to provide all services the customer paid for and to not charge additional fees for additional work such as reinstallarion of the system. [redacted]General ManagerAccurate Pest Control

Please see the attached contract.  In the center, in bold, at the point that the customer initialed it states that the service is to continue on a service to service basis following the original term of the contract and that either party may cancel in writing.  We never received a...

cancellation.  The service was provided as per our obligation.  We service thousands of customers this way, many for over 20 years.  This contract is not unlike other recurring service contracts in that there is an initial obligation and it continues after.  Phone, trash pickup, cable, lawn service, gas, etc.  The fee of $99 for the last service is due.  If the fee is not paid we will continue collection efforts including additional fees as per the contract [redacted]
