I am rejecting this response because:
I have also filed a claim with DCA and filing with small claims court for reimbursement for brakes repaired 6/17. Manager has reached out vi email and I have attempted to resolve, however it seems they do not feel as though they are responsible, so unless they are willing to reimburse my $259.00 for the repair work. I can also provide receipt for proof, which will be provided when they receive small claims summons.

The dealership received confirmation on Monday of the lien on the the title and a check is being sent out, in the amount of $293.00, $300.00 less $7.00 for the temp fee.

Subsequent to the purchase of his vehicle, Mr.[redacted] returned to the dealership and advised that he wanted certainwarranties and/or products canceled, which totaled $4,554.00.  At thattime Osvaldo R agreed the termination fee of $485.90 would be waived. However, the dealership needs a...

copy of the billing statement Kia sent to Mr.[redacted] charging him for the early termination fee before the credit can beprocessed, and they have not received same from Mr. [redacted].The $4,554.00 will be refunded in approximately six weeks which is how long itusually takes to process the paperwork and the monies are then forwarded to theCustomer's financing company to be applied towards his loan.Lastly, the General Sales Manager of the dealership, John P, advised thatthey have NEVER asked a customer to sign a blank contract nor would they expectanyone to do so.  We apologize for the delay in refunding the $4,554.00 to Mr. [redacted]'s loan.

The dealership had the customer bring the car in Free of Charge to inspect the brakes.  They pulled the tires and removed the brake pads from the vehicle to measure the inside and the outside brake pads, while the customer was present.  The brakes are within factory specifications of 5mm for the front brakes and 6mm for the rear brakes.  At this time the car does not need brakes and the customer was physically shown this.  Low brake fluid does not necessarily mean a vehicle needs brakes.  As the brake pads wear, the master cylinder does require more fluid because it needs more fluid to push the caliper out, which presses the brake pad into the brake rotor for stopping.  The only way to be sure if brake replacement is needed is to pull the tires and remove the brake pads for measurement.  The customer states on 05/21/16, after the dealership inspected her car, she brought it to an independent repair facility, one that does not repair brakes.  They did not physically inspect the brakes by pulling the tires off or the brake pads and measure them like the dealership did.  Therefore, the dealership is not sure why she is taking another shop’s opinion, a shop that doesn’t do brake repairs.  If the car needed brakes, the dealership would gladly install them.  The Director of Fixed Operations, Travis W, emailed the customer and also called and left his personal cell number so that he might discuss the matter with her directly.

I am rejecting this response because:the ac conditoning system was clearly working before the car was dropped off for repairs. After that the ac system was not performing after the initial repair.

Sales Manager Charlie C initially spoke to the Customer when she first came to the dealership and although he advised her to keep her current vehicle, she insisted on buying the new car.  He was able to lower her payments by $40 per month (and installed an XM radio and a spoiler on...

the car at no cost to the customer).  They also provided her with a rental vehicle so she would not be without a car.   Two weeks later the Customer called and said she felt the dealership took advantage of her.  Mr. C asked her to come into the dealership with her husband and son so he could go over the transaction with all of them, but she refused.

Sansone Kia stands by its position that the "Documentary Fees" were appropriately charged to the Customer.  These fees, like sales tax, are added to the negotiated purchase price so as to off-set certain transactional expenses incurred by the dealership, which is standard in the...

industry.  Notwithstanding that the Documentary Fee charge was appropriate, in the spirit of customer goodwill, we will, in this instance only, refund said fees in the amount of $399.00. Please advise if this is acceptable to the Customer. Lastly, my contact information is below.

While it is true the consumer could process the transfer of his plates and registration, the dealership would not have been able to release the vehicle to the customer until he returned to the dealership with a receipt from the State of New York indicating that the sales tax was...

paid and the vehicle was registered to him.  At that time the dealership would reimburse the consumer for all motor vehicle and sales tax collected.   The dealership did not “make an extra $185.00 dollars”.  I’m assuming the consumer is referring to the $185.00 charged for documentary service fees which is for the preparation and processing of documents related to the sale or lease of the motor vehicle, and does not include the actual motor vehicle fees charged by the State. The dealership refunded the Customer $233.00 from the estimated motor vehicle fees collected in the amount of $300.00.   All of this is clearly spelled out on the back of the Buyer’s Order.

The Service Manager for Sansone Toyota met with the Consumer and they resolved this matter to Ms. [redacted]'s satisfaction.

The customer returned to the dealership after his engine was repaired and stated that since he had the engine repairs done, the air conditioning no longer worked.  We advised the customer to bring his vehicle into Service at his convenience, so it could be diagnosed, at no charge to him, in...

order to determine what was wrong with the air conditioning system.  The customer returned to the dealership and we performed the diagnostics.   The diagnostics determined that the air conditioning compressor had an internal issue.  The compressor is a sealed unit, and an internal electrical issue could not have been caused by any repairs that were made to the engine.  The customer was told the vehicle needed a new air conditioning compressor due to an internal problem, and he was given an estimate at this time.  The customer declined to have any repairs performed.

This matter has been amicably resolved between the parties.

I have reviewed the response, No I don't agree with this. But it is what it is and I email the Vise President Mr. [redacted] of Sansone  and I have the email that he would follow through. Will never heard from him again after that. James the financial guy call me after I had email Mr. [redacted] again to follow up.  After reading Charles response, he has no clue what I owe on the car. He gave the wrong amount never look into this. I'll never use Sansone again nor will I recommend them to anyone.  They should never advertise that they help people with bad credit on there website.  Nothing but Lies.
