Revdex.com: I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Unfortunately, no offer was offered to resolve the problemAs expected the only thing thats being offered are more excuses as to why they won't hold up their part of the dealAs the consumer it is not my concern when or how they car dealership pays the warranty companyMy only concern is that I actually have a warranty and at this point I still don't and the BMW broke down on the road today yet again...again it will need to be towed the mechanic tomorrow for more unexpected expenses with no warranty Furthermore, I contacted the finance company Westlake Financial Services today and was told that they were unaware that the warranty on the BMW was inactive and were shocked that Cars Best has been uncooperative in this processThey are investigating the process and their transaction history with Cars Best because they don't wish to do business with a company thats participating in this type of practice as it makes their company look badWestlake Financial informed me that my account has not and will not be credited and that it is the responsibility of the car dealership to refund the money to me since Westlake has already paid Cars Best for the warranty They were unaware that Cars Best never paid the warranty companySo again, I am still in need of a refund of the warranty for $ [redacted] that was included with the finance of the BMW I'm not sure why the representative from Cars Best even mentioned the loaner carIt is customary procedure to allow your clients to drive a loaner car but not mandatoryAfter all they put me thru, this is the least they could have doneThey don't earn brownie points for practicing good customer service with the loaner...thats expected What they left out is that I was using the loaner car because it took them days to solidify the financing for BMW and prepare the carWhile they were doing that, I had another car that I considered trading in to them but after I saw how terrible they handled this transaction I decided to trade my other car at a different much more reputable dealership and have had zero problems with my other new carWhy would I even consider buying another car for themNo one should...they should be shut down Not to mention it took them over a month to send my hard tags to me and when I finally got them they were expiring within the same monthWho does business like this? Unfortunately as a used car dealership we sell dozens of warranties every month and do not pay for each one individuallyThey are processed twice a month and paid accordinglyUnfortunately for Ms.W [redacted] her warranty which was sold to her as part of her financing was not paid for prior to her having the car checked as with most warranty companies they do not go into effect until to days post sale and since the warranty company had a record of prior mechanical issues they denied the warranty and purchase of such.We tried to accommodate MsW [redacted] with another company but unfortunate they also denied her claim since she insisted on stating that it was an existing problem prior to purchase and since she is claiming it is a pre existing issue NO WARRANTY company will allow us to provide her with a warranty .Her daughter stated to us last week that she was on her way to pick up her refund and we told her we would be here We close at 7:pm and actually waited until and she never came in or returned our call or answered our calls for that matterOur warranty provider has issued us a refund for the purchase of the warranty and the lender has also been notified of such cancellationUnfortunately Ms W [redacted] did not pay cash for the warranty it was financed and any and all refunds would be issued to the lender and applied towards her principal balance Another point we would like to touch on is the fact and as Ms.W [redacted] stated as well the vehicle was sold as is and even though it was sold as is we have provided her with loaner vehicles and also performed repairs which as conditions of the sale we did not have to do but did anyway in good faith If we can be of any further assistance please contact us [redacted] *** or we can also be reached by email at [redacted] Thank You [redacted]

Unfortunately Miss *** was denied due to providing us and the banks with information (paystubs/bank statements) and considering we provided her with a vehicle for over a month and she could not provide us with the necessary documentation to support the documentation provided as well as
putting over 3k miles on said vehicle and failing to disclose her employment status until after the bank and us confronted her with information provided to us by her supposed employer (employer stated she was terminated in December of and she provided paystubs for the months of June and July

stating the vehicle was selling "AS-IS"The customer liked the car and said they felt the transmission was rough Still the customer decided to purchase the vehicle with some negotiationThe customer was offered a EXT WarrantyThe customer purchased the extended warranty on the vehicle. But still tried to call Cars4Best for repairs on the vehicle after it was made clear when selling the car that the warranty repairs were not to be requested by Cars4BestThe customer signed the Buyer's Order stating the customer is aware the vehicle .is selling "AS-IS" The customer also signed on the Buyer's Guide stating they are aware that the vehicle they are purchasing "AS - IS" with no warrantyCars Best is not responsible for any repairs if the vehicle if sold "As - Is"Cars Best will only follow paperwork and documentation

Hello, ** *** *** came to look at the vehicle on 4/20/He came in and test drove the vehicle, and liked the way the car was drivingHe was happy with the car and we got him approved through financing and he put $***down payment on the vehicleThe vehicle was sold from my
company and there was no EXT, warranty available for this vehicle with its mileage and yearAfter explaining to the customer why the vehicle is not eligible for an extended warranty the customer said he was still happy with the car and decided to purchase the car anyway with no warranty and I have his signature on my form.The finance company requires to have an interview with every finance deal customerCustomer mentioned to the finance company on 4/30/that he was satisfied with the vehicleAlso I do want to mention my company also took this vehicle to get Emission and inspectionMeaning the vehicle had nothing wrong with the car.My dealership is not responsible for any sort of issues with the vehicleWhen it was on my lot it was running smooth, why else would a customer purchase it with out a warrantyHowever if the vehicle does run into issues the customer which was driving the vehicle can manage to blow out a transmission by improperly driving the vehicleIf a customer drives rough and high revs the vehicle and does not check if there is even oil in the car on a timely matterHow can I be responsibleThe vehicle was purchased for the buyers son, who is a ** year old young manThat's why I do not doubt that the vehicle was most certainly driven roughly.I can provide all the documents you needI make sure to get all the paperwork I need before selling a carPlease dismiss this case as soon as you can because my company cannot be responsible for improper driving and lack of attention and maintenance on a vehicleAlso I want to mention the amount of Profit my company makes should not be of any interest or business to a customer.Best Regards,*** *** (Cars4Best CEO)

I do not understand how our business practices are "Not Ethical"I believe it is VERY ethicalWe go by what is written in the Law and what is written in black and whiteThe fact is the vehicle was sold "AS-IS"If my company offered a warranty and the car was not sold "AS-IS" I would still stick to the Law and what is written in Black and WhiteBut that is not the case in this situationThe vehicle did not have transmission issues when the vehicle was purchased because a very smart customer like *** would not have purchased a vehicle with such issueI myself would have no interest in purchasing a vehicle with a bad transmissionThe issue was stated months after the vehicle was sold, the vehicle must've ran low on oil and the owner failed to maintain the vehicle and check the oil frequentlyIt is a used car, and even brand new cars develop issues if there is NO oil in the transmissionAs I stated I will stick to the law and what is written in black and white, and I will not be held accountable and responsible for someone else's mistake.Best Regards,-Cars4Best

For your reference, details of the offer I reviewed appear below I have attached a copy of a letter from the bank dated 01-31- They stated that they had been trying to reach me for over a month Obviously the statement the dealership made about the bank contacting me iso false They also did NOTHING offer an extended warranty and the third document they supplied is fake I have never seen that document before While an sensor and brakes are minor maintenance issues are minor issues, they are issues that should have been known about and should have been repaired before sale The timing chain is a major expense and again it should have been known about I still expect the dealership to pay for this repair, plus the rental car and tow. *** ***

Dear *** *** I have read the email the day it was sent, I was doing my own research to find out more about this transaction. Mr.*** came to see the *** *** ** on Sunday /01/, he took it for test drive on the same day ,asked us to hold the vehicle until he
could get his financing approved through his bank, & asked us to fix the door handle on the car & have it detailed, we fixed the door handle & detailed the vehicle, on 03/11/Mr.*** came back & before we did the transaction he took it for another test drive, & he than made his mind to purchased the vehicle as is without any warranty, & we have explained our no return policy to Mr.*** before he signed the documents. I send documents on 4/7/to this office in person about the Buyer Guide and what I pay to try to repair issues I had from day one on this carIt shows I pay $dollars for replace and shows $for more repairs that need to fix the abs brake system module and so shows the amount for the transmission that was stated in my papers on comments it was slipping and unsafe to drive before the transmission when badI just want a this dealer to refund or reimbursement on my $that I paid out of my pocket not the $check I paid with and include $for my tags that show I paid for on the buyer guideWith all the money I spend for the car I only was able to drive for one week at a cost of $repairs $cash and plus $check total cost for one week $for a car the I had problems with day oneThank you hope to hear back from someone soon

my lot for "months" it was relatively new and was only a couple weeks old. My company did minor repairs before selling the vehicle to make it as perfect as we could, we put 4 tires on the car and had gotten balancing done, we installed new brakes on the car as well, and did a few other minor repairs we felt the vehicle needed. of course we have the receipts and correct documentation for these specified items. When the vehicle was on my lot it showed no signs of any defects. It was running very smooth and was in great shape. From my company the vehicle was sold "AS-IS" with no warranty from my company, we did offer her an EXTENDED warranty that the customer decided on purchasing after reading through all of which the extended warranty covers. If the vehicle was sold "With Warranty" through my company of course I would follow what ever us written in black and white and take care of what ever is covered. However this is not the case, my company will follow only what the documents state, anything that is written and signed by any one of my representatives, we will follow those terms. My employee [redacted] that did not sell her the car, was being very helpful to [redacted] and also [redacted] mother when she had called. Terms were agreed to before sale, if my company were to go back on terms and change it after the sale, there would be no reason to have terms in the first place. If customer is requesting my company offers a warranty after the vehicles sold, that's like my company selling a vehicle "with warranty" and going back after the sale and changing terms to "As-Is". Which is very Unethical and also illegal. We did mention to the customer they have a ONE year extended warranty that they can use and the warranty company will assist them with repairs.

To [redacted] , #[redacted] The customer ([redacted]) came into Cars 4 Best on (12/26/2015) after seeing a vehicle online. The customer came in looking for a 2006 Cadillac SRX. Working with my salesman she was very satisfied with the cars condition and decided to take it for a spin....

Everything checks out, she was happy with the car. So my salesman brought her in to get the approval from my finance manager so she can take the car home. The customer was approved by [redacted]. The customer drove the car home, as soon as she left we faxed over the documentation to the lender to start the process. Only a couple days after the date of sale the customer received a phone call from the bank. The bank called the customer asking if they are satisfied with the vehicle and the customer stated she was happy with the car and there was no issues with the vehicle. When the paperwork was being signed the vehicle was selling “AS-IS”, we offered her an extended warranty for her own benefit but she refused. By law any documentation we have is the rules we must go by. If the car was sold with a warranty that would be honored, but unfortunately that is not the case. The car is sold “AS-IS” so my company cannot provide any additional assistance at all. When the vehicle was here on my lot we were not aware of any issues. The customer is stating issues being a 02-sensor, and brakes and rotors, which are very minimal issues mainly that would not be replaced even with a warranty.
