That is all fine and well. However, I feel that given my circumstance, I should not be pursued any further and the account should be closed and the balance dissolved. I'm not OK with this getting sent to yet another collection company later.
1. I was never in ownership or possession of the vehicle, and obtained no benefit from its purchase.
2. The dealer (CarMax) acting as an agent of [redacted] (by means of pushing ONLY their loans) acted in bad faith during the contract process. They failed to adequately explain what my liability would be by co-signing on this loan. While I have since learned what that entails, if I had known the full possible ramifications at the time, I would not have signed the contract at all. I was wholly unaware that a vehicle I never possessed nor drove could appear on my credit report as a repossession or have collections agencies come after me.
3. The same dealer also failed to honor their own returns program. There were numerous mechanical defects with the vehicle. We were offered a 7-day warranty for major issues to be repaired by CarMax and/or the opportunity to return the vehicle. CarMax refused to honor their return provision (which would have nullified the loan), and intentionally delayed repairing the vehicle until after the warranty period expired to avoid repairing the vehicle.
4. [redacted] has acted in bad faith, and also refused to correct an error on our credit reports (myself and the primary). Here's the story. Based on information, the primary ceased payments due to job loss. Unfortunately, the primary didn't notify me that he was unable to make payment and I lived in a different city so we did not see each other frequently. My first notice that payment wasn't received was when I received a call from a repossession agent asking me where the vehicle was (and I didn't know the answer, either). [redacted] had my contact information but never once called me to request payment, notify me of a delinquency, or provide me the right to cure. As of when the repo agent called, it was too late to cure and when I called [redacted] myself, they were unwilling to cooperate. I called the primary and advised him of the call I received, and convinced him to surrender the vehicle voluntarily. He and I worked with [redacted]'s agents and they picked up the vehicle due to the voluntary surrender. [redacted] refused to update our credit reports with a "Voluntary Surrender" flag instead of a "Repossession" flag, and still refuses to do so to this date.
I will be more than happy to send this in a written letter to your firm if required. However, I request that given the bad faith acts by the original lender and their agents/dealers, that this debt should be dissolved. We tried to return the vehicle due to the mechanical problems, the primary tried to work with the lender regarding payment, and in my individual case neither the lender nor primary ever notified me of a delinquency.

CSC has requested the records from the St. Lucie Emergency Group and once received, they will be mailed to you at your attention. Dynamic Recovery Solutions has put all collections on hold until media can be provided.

CSC initiated an investigation as to the issues raised in this complaint.  The result of the investigation is as follows:
·         Cascade Capital, LLC purchased a portfolio of outstanding, charged off consumer accounts from ApolloMD Business Services, LLC. on July 17, 2017. Within this portfolio is an account from Carlisle Physician Services, LLC with an outstanding balance owed of $1,082.00 under the name [redacted]
·         The account was placed for collection with Phoenix Financial Solutions, LLC on August 8, 2017
·         The consumer contacted Cascade on August 25, 2017 to verify if Phoenix Financial is a legitimate agency and to request verification of the debt.
·          The consumer was informed that Cascade did indeed place the account with Phoenix and that Cascade would forward the verification to her through Phoenix.
·         Verification of the debt has been requested and the account is currently placed in a HOLD status until the verification is received and forwarded to the consumer.
·         Cascade has no knowledge of any payments made on this account prior to its sale. The file lists $0.00 as the payment amount and the balance sold is the same as the incident amount, $1082.00.
The consumer states in her complaint that the account has been paid off. Cascade is unaware of any payment(s) on this account. If the consumer will forward copies of any payment receipt(s) we can investigate further.

This account was placed with Dynamic Recovery Solutions (DRS) for collections. Back in November DRS received a dispute from you and requested the original documents be sent to you. On November 25 CSC was notified by the original creditor that they did not have any documents on file to validate the debt. At that time CSC recalled the account from DRS and closed the account. This account will not be sold or transferred to another agency.

Santander Consumer USA Inc account, listing the obligor as [redacted]. The account was purchased from Santander in July of 2014. The balance, at the time of purchase was $9,433.80.
You stated you received a letter from CSC. I am going to assume you received a letter from the agency that is collecting on the account. This Santander account was placed with Halsted Financial Solutions.
You also stated you have a receipt for paying this account. Would you mind providing either Cascade or Halsted with that receipt of payment?

This debt has been taken care of and I do have the receipt and also its past the 7 yrs and by law they cannot collect on a debt anyway.

All collection efforts are outsourced to licensed and bonded collection agencies. Since you have stated twice you have receipt of paying this account please send your receipt to agency handling collections. Halsted Financial. They can be reached at XXX-XXX-XXXX.
You also stated that since the account is over the 7 year statute of limitations it cannot be collected on by law. That is incorrect. The meaning of the statute of limitations is that an agency cannot report the account to your credit report and you may not be pursued through legal action.
