The business has responded. Please see below:
The letter that he got clearly states that it may require money down to stay at the same payment or the payment would be near his current...
payment. Each customer situation is different and we must treat it as so.
Revdex.com:
I have reviewed the response made by the business in reference to...
complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved. Please note I did not bring in a cancellation letter. I sent a letter to the CEO and Principal Executive Officer advising them of situation and telling them that if this wasn't resolved my next step would be to take them to small claims court in Yonkers. Only then was that I was contacted to go and collect my refund.
Sincerely,
[redacted]
We have already acknowledged the customer concerns regarding the deposit he spoke with the [redacted] and told him that he would just dispute the charge.
The deposit that was left by [redacted] was in 500$ cash it was then dropped into the safe as per store policy. So the money could not be returned until one of the owners was here to sign a check refunding the money.Which she received the very next day.

Review: Placed a down payment at Central Ave Nissan after being assured that my ordered vehicle would arrive within 3 weeks. 5 weeks later, there is still no vehicle and no ETA on its arrival. Salesman says he has "no idea where the vehicle is currently, but he thinks it went to Korea." Zero communication provided by the incredibly rude and incompetent sales staff. No action to proactively provide me a refund. When I requested the contact info of the dealership's management, I was literally told that he "does not have e-mail."Desired Settlement: This business NEEDS to provide me a refund, an explanation, and an apology. More importantly, this business NEEDS to correct its dishonest and truly incompetent sales practices; the sales staff is blatantly deceitful and provides misleading information to its consumers.

Response:
The business response is found below:
Customer left 100$ deposit and was informed that it would take roughly 3-5weeks to locate vehicle and that we would place an order with the factory. An order was also placed as a backup vehicle. Customer spoke to [redacted] and told him he wasnt't happy with the length of time it would take to receive his vehicle. He then proceeded to inform [redacted] that he would be putting a stop to his credit card.

Response:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
[Your Answer Here]
The merchant continues its dishonest practices by responding with a claim that the customer was informed it would take "roughly 3-5 weeks", which is a blatant lie. Customer disputed credit card charge as a last resort to the business failing to provide a refund. The merchant still has not explained why there was no communication to the customer regarding a possible delay with the ordered vehicle.

Response:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
[Your Answer Here]The business did absolutely ZERO in response to my complaint. Central Ave Nissan accepted my down payment for a vehicle, then failed to deliver the vehicle. Furthermore, the business never provided any communication about any delays or potential issues with delivering the vehicle. When I complained and requested a refund, no refund was provided. The business could have reversed the initial credit card charge or sent me a check, but instead did absolutely NOTHING. In order to get my money back, I had to deal with the additional inconvenience of disputing the charge through my credit card company. The business should have acknowledged fault and proactively provided me a refund. Without question, this business needs to be further investigated for its dishonest and incompetent consumer practices.

Review: Went here on the [redacted]to look at cars and decided I was interested in a 2013 Nissan Altima. Went back on Monday the 24th and signed a buyer's order, left a $500.00 deposit and signed one of the papers that authorizes them to run my credit report to see what can be offered for financing. I told them that based on financing options I would be back on Saturday to pick up the vehicle. On Tuesday I received a call from their financing department and was advised of the interest rate that I had qualified for. After careful thought, I decided that this was not a good rate for me and also felt that I wasn't interested in this vehicle anymore. On Wednesday I decided that this wasn't what I was looking for and messaged and called the Sales Consultant named [redacted] to tell him that I was no longer interested, that I wasn't confident in the deal and that I knew one of my friends had received a better deal and interest rate. He told me to wait and he would speak to the [redacted] whose name is [redacted] aka "[redacted]" and see what they could do. I went in that day and neither was [redacted] nor [redacted] there but I spoke to the person in charge who's name I don't recall but who also happens to be related to [redacted]. I told him about the situation and how I was not interested in the car anymore. His response was that if I was aware that I had signed a binding contract and that legally they would have to speak to their attorneys to see how to resolve the issue. I told him that I didn't understand how this was binding considering that I didn't agree with the interest rate and hadn't signed anything with the bank. He told me that I should call [redacted] tomorrow and try to resolve something with him. When he spoke to me his tone was a bit forceful and I definitely left intimidated especially after he threatened me with attorneys. I decided to go back on Saturday with my friend [redacted] (who just had bought a Nissan at Koeppel and had introduced me to her sales consultant) so I can cancel my contract. When we arrived [redacted] saw us and when we sat down he asked me how can he help me and I told him, "I am here because I would like to cancel the car". He told me to hold on and that he would speak to [redacted]. When he came back he brings back the buyer's order contract which had a huge "SOLD" written diagonally on it, he informs us that there is no way to cancel it and that the only way would be for me to either write a letter now or later and bring it in to them stating exactly why I did not want the car anymore and that this letter would be forwarded to their lawyers. I wasn't sure exactly why the letter was necessary. We asked [redacted] if we could speak to [redacted] and he said, "well if you want you ladies can go over to the main sales desk because there is no way I'm telling my boss to come over here for you." I was instantly displeased, not to mention that I already went in there with discomfort. My friend and I approached the desk. [redacted] asked, "How can I help you?". I responded by saying, "I'm sure you are very well aware of the situation at hand. I am not interested in getting the car anymore, I am uncomfortable." He told me, "Didn't you sign a contract?" I responded with a, "Yes, but nothing with the bank and this should not be considered final." He said, "Well it is!". Cindy, responded by saying, "What constitutes this as a final contract? I've had a situation in the past where a deposit was left and I was able to get my money back." [redacted] is raising his voice, "Oh well do you go around leaving deposits all over different dealerships??" [redacted] responded by saying, "No, I was just sharing an experience to clarify" He responded nastily by saying, "Well is your name on the contract? I don't even need to be speaking to you. If I am it's out of courtesy!" I proceeded to ask if he could explain then exactly what needed to be done. He repeated the same thing about it being a binding contract and me having to write a letter so that they can present it to their lawyer. [redacted] asked, "Ok I will consult with our lawyer to see if this is really necessary. Can you please tell us when Lissette will get her money back?" He said "maybe a week, two weeks, a month, who knows". He was extremely nasty with us, trying to explain what a contract is and isn't. After I carefully reviewed the deposit/contract receipt, It states as follows, "IF YOU AGREE TO ASSIST ME IN OBTAINING FINANCING FOR ANY PART OF THE PURCHASE PRICE, THIS ORDER SHALL NOT BE BINDING UPON YOU OR ME WITH REGULATION "Z" (TRUTH-IN-LENDING) AND ARE ACCEPTED BY ME. IF I DO NOT ACCEPT THE TERMS WHEN PRESENTED, I MAY CANCEL THIS ORDER AND MY DEPOSIT WILL BE REFUNDED." During the whole conversation he belittled us by yelling, not sure if it's because he didn't want to lose my business, we were females or Hispanic but truth is that I was completely disgusted. This is not the way to treat any customer and I now refuse to give them my business. I couldn't believe that as a [redacted] he had the nerve to talk to us the way he did and give us completely misleading information. Threatening me with lawyers, having a huge "SOLD" written on the buyers order and yelling at me and my friend in front of all his sales consultants and customers is completely out of character. I am unsure how someone so rude can be the person that represents their company.Desired Settlement: Have my money credited back to my account without me having to go to their business location.

Review: On July **,2014 I went to purchase a vehicle from Central Avenue Nissan. The Sales Representative [redacted] stated I need to give a $500.00 deposit to hold the vehicle while the paper work and check cleared. However after I gave the $500.00 deposit the deal couldn't close, therefore I asked for the return of my $500.00 deposit. Only 15-20 minutes had lapsed and the [redacted] stated my $500.00 deposit couldn't be returned to me at this time. Though the deal wasn't able to close and that I would have to come back tomorrow. Words were exchanged and the police were called at 12noon and [redacted] told the [redacted] and the Representative that the $500.00 should be returned. This is when the [redacted] from Central Avenue Nissan jumped into his vehicle and left the dealership. Another Representative gave me a copy of a check that only represented the dealerships intent to refund. However this is not a check its a copy of a check with my name and address and the $500.00 amount to be paid. The whole fiscal caused a delay in me going to another dealership to make a purchase.Desired Settlement: I want my $500.00 deposit refunded and an investigation into Central Avenue Nissan business practices. I believe that the $500.00 should have been refunded immediately there was only 15-20 minutes between my $500.00 deposit and the discovery that the deal couldn't close. I would also appreciate a response from Revdex.com with appropriate Car Dealership practices, in addition to the outcome of this complaint posted for other consumers.

I DO NOT WISH TO DO BUSINESS WITH CENTRAL AVE NISSAN ANY LONGER.

Response:
At this time, I have been contacted directly by Central Ave Nissan regarding complaint ID [redacted], however my complaint has NOT been resolved because:I wrote to central Avenue Nissan to please credit my account for $500 that I left as a deposit. I had changed my mind after I spoke about the deal offered to me with my family. They felt that this deal was not a good deal since I went to the dealership to test drive a 2016 Altima with free maintenance and ended up with a 2015 and had to pay for maintenance. When I wrote to my salesperson the next day after giving them my credit card he said I was disturbing him and needed to contact the General Manager. I wrote to the General Manager and asked for a refund. I'm still waiting for my refund. I do not want what they offered since it was not a good deal on a high price item. I later found out about all the complaints against this dealership. I didn't want to deal anymore with their bad customer service. Thanks for your help in this matter.

Review: I received a letter addressed to me from the dealership that I leased my 2012 Nissan Rogue from. In the letter it states that I have an opportunity to replace my 2012 Nissan Rogue with a new Rogue with the same lease payment with "little to no money down". I brought the letter to the dealership and the salesman [redacted] informed me that I would have to come up with $4500 in order to receive the new car. I showed him the letter which clearly stated otherwise. He brought over his manager [redacted] who said it was the marketing company and that I should not have received the letter. I told him that his company is responsible for what they put out and to whom. He asked me to give him two days to speak with the higher ups. I had to call him after four days only to be told that there is nothing they can do. I have the letter. PLEASE ACT BEFORE THE APRIL [redacted] DEADLINE.Desired Settlement: Exactly what they offered

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
I have the original letter addressed to me. I will quote verbatim the wording of the key paragraph. "Because you currently have a 2012 Rogue Nissan, Central Avenue Nissan will reward you with an extremely high trade value making it possible for you to exchange your vehicile for a Brand New or Pre-Owned Nissan with little or no out-of-pocket expense while keeping your monthly payments at, near or below what you are paying now. This program is for current Nissan lessee's or those who have financed any Nissan vehicle.":They telling me that I would have to put $4500 down is not little or no out-of-pocket to me. If you want me to fax this letter please provide a fax number.

Review: In June of 2011, went to [redacted] Nissan to see if they could give me a better deal for a 2011 Maxima than a competing dealership in [redacted]. The requirements were that I needed to fully loaded car for a lease with 15k miles per year and Less that 4k down. The sales person that helped me was a fellow named Charles White who it seems does not work there any longer. The sale person was aggressive in trying to give me the deal I was looking for not only my saying he would give me this deal but also that he would beat the competitor. He stated that he could process the deal in one afternoon and have me in the car before end of day. The whole process seemed rushed and what has happened is 3 years later I find that the contract was presented to me was very misleading to a novice and that the line that said 1583 in a box called mileage was not the yearly mileage allowed but in fact was a line item from another box. So in the end I signed a contract for 12k miles a year though reading 1583 in a box named mileage which is very misleading. The sales person no longer works there and there is no one that will corroborate my story except for this fact that, my previous lease with another Nissan dealership was for 15k miles a year. My commute to work requires 16k miles per year so I would never agree to go into a lease that would put me 4k miles per year in deficit. The sales person knew what I was looking for but made the numbers work to what I was looking for but not listing the mileage allowed clearly on the contract for me to recognize. I will never do business with [redacted] Nissan again and this treatment has put me off from doing any business with Nissan moving forward. This 2011 Maxima was my second consecutive Nissan but they have lost me as customer going forward. I have the contract that to me is very misleading and will provide it if necessary.Desired Settlement: I would like for the mileage repayment for excess mileage to reflect 15k miles allowed per year instead of 12k miles per year which would give reimburse me $1500.
Review: on September ** 2013 my wife and I were looking to buy a car for her self we went to this dealer Central Ave Nissan in Yonkers NY. [redacted]. We saw a potential car for her, we spoke to the sales rep and he said if we wanted the car we had to leave a deposit on the car. We say no we'll come back the next day and he insisted , he gave us a price we were not sure about the price we thought it was high. and he said to leave the deposit and if we would change our mind they ware going to give us the money back, we signed a document were we agreed to leave just the deposit at that time this document was not a binding contract we told him we would come back the next day, when we got home after we left the dealer, we search online for the same car and we found a newer and much better cars for a lot lower price. We change our mind we decided no to buy the car because it was over price. The next day I call the dealer and told them we were not going to buy the car anymore and they said it was to late because they had approved me for the credit they had run my credit and approved me without my presence I never agreed to any terms and conditions of credit loan they never faxed me or show me any documents because I was not there. Now they refused to give my 500 hundred dollars back because I was approved but they did it without my presence the document clearly say this ordered shall not be binding upon you or me until all of the credit terms are presented to me in accordance with regulation 'z' truth in lending and are accepted by me if I do not accept the term when presented I may cancel this ordered and my deposit will be refunded please help me get my money back I did not accepted any credit terms or conditions neither they presented me any documents because I was not there they did everything with out my presence approval therefore the document I sing is invalid because they violated my consumers rights I have spoken to them several times and they still refusing to give my money back.Desired Settlement: get my money back because they did everything without my presence never signed a real contract never agreed to any credit terms or conditions I gave them permission to run my credit not to approved me for it, thank you.

We spoke to them the next day told them the depost could be transferd to a used Rouge they said fine and they would be in to pick one out. We also have a signed credit application and buyers order that has our refund policy on it witch say no REFUNDS ON APPROVED DEALS. I can provied both upon request.

Sincerely,
Review: I have put a $500 deposit down towards leasing a 2013 Nissan Rogue demo car. After further research I have decided not to go forward with the deal - the trade in value for my current car was never disclosed to me : not verbally and not on the deposit contract. I have contacted the dealer to request the deposit back and encountered rude, condescending and bullying response from [redacted], the general manager. I was told that his copy has a $4000 trade in value written on it so I requested to see the copy. Upon receipt of the dealer's copy via email I have discovered that several things have been written on it after we signed it on 6/**/13. My copy is clearly very different than theirs and does not have the trade in value on it.Desired Settlement: I would like to have my deposit returned to my credit card.

Response:
As per customer request the depoist will be returned today 7/**/2013.
Somehow I got on their mailing list. I never bought a car from them. I went to a competitor because the salesman was not particularly nice.
they send me mail every week.
When I called them to complain and to take me off their list... they stated sending me two copies of all their mail.
So I called again. Now it's just one copy.
They were calling my house as well.
Nonstop harassment if you ask me.
I will never shop there.
