At this point it is our understanding that she is fully satisfied with the resolution and plans to continue with her Debt Settlement program. In regards to the complaint filed by Ms. [redacted] we have been able to act swiftly and come to a resolution. Possible effects of participating in a debt settlement program can include ongoing collection efforts and possible legal action. One particular creditor listed on Ms. [redacted]’s program elected to...

file suit. Century was able to work out an arrangement with that particular creditor to resolve the account and to prevent Ms. [redacted] from needing to attend the court date. Our negotiators are currently pursuing settlement options for the other accounts listed in the program. Ms. [redacted] entered into a written Debt Resolution Agreement with Century Support Services on August 26, 2016, and enrolled two debts : 1) Discover Bank  and 2) SYNCB/TYDC (Toy R Us) (Exhibit A” – Schedule of Creditors). Based on her monthly income and her financial ability, a monthly payment...

was established, (Exhibit “E”, Financial Analysis), and a Program Length of 44 months was projected.  Both are clearly stated (Section 2.B) and Exhibit “E”, Financial Analysis, and were agreed to by Ms. [redacted] .  A copy of the applicable provisions of the signed Debt Resolution Agreement, with Exhibits, is attached for reference. Ms. [redacted] claims in her complaint that it was represented to her at enrollment that the debt resolution program would be concluded in three months.  Century was successful in settling the SYNCB/TYDC account, as stated in the complaint.  However, given the low monthly payment drafts, It would take significantly longer for Ms. [redacted] to build up additional settlement reserves with which to settle the much large Discover Bank account.  Ms. [redacted] was not misled about the projected length of her program, as evidenced by the 44 month Program Length in the Debt Resolution Agreement.  Further, the consequences of entering into a debt settlement program were fully disclosed in the Debt Resolution Agreement and acknowledged in writing by Ms. [redacted].                  Despite the contractual provisions of the Debt Resolution Agreement, and admitting no liability, we contacted Ms. [redacted] upon receipt of this Complaint for the purpose of attempting to better understand her concerns, in light of the signed Debt Resolution Agreement.  Ms. [redacted] asked if she could be referred back to the original sales affiliate where she enrolled in Century’s debt settlement program.  We have contacted that sales affiliate about Ms. [redacted]’s request that they handle her debt settlement program.  As of the date of this response, we have not spoken with the affiliate.  When we do hear from them, we will contact Ms. [redacted] and, if the affiliate is not going to assume debt settlement services for her, we will make an attempt to address Ms. [redacted]’s concerns and propose a resolution of this matter.  Thank you,Sameka G[redacted]Sr. Director of Client ServicesCentury Support Services

Up to this point, we have not been able to connect with Mr. [redacted] to discuss his complaint filed with the Revdex.com. It is our desire to further explore any concerns that he may have in regards to how his accounts were handled while enrolled with Century Support Services. In the original complaint, Mr....

[redacted] expressed concerns with the fact that all available monthly funds were being applied to one creditor rather than all enrolled creditors. Due to the nature of debt settlement it is typical for only one account to be placed into a settlement at a time. Unlike credit counseling we are seeking a reduction in the repayment amount rather than making payments towards balance in full. When Mr. [redacted] was asked to increase his monthly deposit amount it was for the specific purpose of placing him into a settlement for his largest debt enrolled in the program.  He provided a recorded authorization for us to make those specific payments to that particular creditor. As for the outstanding fees owed, Mr. [redacted] was advised at the time of cancellation that he owed fees for the settlement that CSS negotiated on his behalf. A letter informing him of the amount owed was mailed as well. Past that we did not nor do we intend to pursue collection of any remaining fees owed. We regret that Mr. [redacted] did not feel well informed during the process of entering into his first settlement with Century Support Services. We strive to provide excellent customer service and will continue to look for ways to improve our communication with each and every one of our clients. I spoke with Sameka from Century (another company within Settlement Services) on July 28th . After another long conversation of more inaccurate information from Settlement Services, Sameka gave me an offer to pay off my [redacted] account as well as refund me $419 in fees. I told her I needed that in writing before I agreed to anything, and proof of payment to my [redacted] account before I would request the negative rating with the Revdex.com removed. She told me I would have an email going over her offer that same day. As of today, August 1st, I haven't received an email or anything in writing going over her offer.  I don't trust that anything will be taken care of on their end to solve this situation.

this complaint to discuss the refund issue on her account. The original refund was mailed from the third party payment processor to the address that we have on file on September 14lh, 2015. Ms. [redacted] has since moved and the refund was never received. After discussing the options to get the refund re-issued Ms. [redacted] has opted to have the funds processed back to her via ACH. Century Negotiations will be covering the stop payment fee for the outstanding check. At this time all of her concerns have been addressed and it is my understanding that Ms. [redacted] is satisfied with the outcome.

This is the response of Century Support Services to [redacted]’s Complaint.  Ms. [redacted]s correctly states that she entered into a signed Debt Resolution Agreement, with ClearOne Advantage, on January 1, 2017.  A copy of that Agreement is attached for further reference.  On total...

enrolled debt of $32,939, and based on her financial information submitted with her application, a monthly payment to fund her settlement plan of $536 was agreed to, and a program length of 48 months was estimated for Ms. [redacted]s.  Century Support Services acquired Ms. [redacted]s debt resolution agreement for servicing shortly after her enrollment.   On March 23, Ms. [redacted]s requested that her monthly settlement plan drafts be lowered to $300.  On June 12, our company received from one of Ms. [redacted]’s creditors, Avante, an offer to settle her debt with that company for 46% of the original debt; but we were unable to settle the account for Ms. [redacted]s as she cancelled her debt settlement account later that day.  Century received no settlement fees at the time of cancellation.   Ms. [redacted]s had a balance of $1,046.30 in her dedicated settlement reserve account in her name with a third party processor, and those funds were refunded to her in full shortly after cancellation.   Century Support Services regrets that Ms. [redacted]s did not find her experience to be to her total satisfaction, despite our performing in accordance with the agreement.  However, there are some statements in the Complaint that are worth noting and responding to.  Among the debts that Ms. [redacted]s included in her debt resolution agreement with ClearOne was an $18,000 dollar account with One Main Financial.  According to the Debt Resolution Agreement, Section 3. B. (1) Unsecured Debt Only, Ms. [redacted]s should not have included that debt, which we later learned to have been secured by an automobile title, in her debt resolution program.  The removal of that account had no impact on the ability of Century to settle the remaining debts of Ms. [redacted]s; rather, it was her cancellation of the account that ended Century’s efforts on her behalf.   Ms. [redacted]s also states that she continued to receive calls from creditors after enrolling in her debt resolution program.  She was informed by our representatives that she could avail herself of a service provided to all clients, and that was a third party company that advocates on behalf of debtors who continue to be contacted by their creditors.  The forms were sent to Ms. [redacted]s to initiate that service, but she declined to return them.   Ms. [redacted]s mentions her disappointment in not being able to have other debts settled.  However, at the time of her cancellation there were neither sufficient funds nor time to be able to settle any additional accounts on her behalf.   Lastly, with respect to Ms. [redacted]’s statement concerning the impact of a debt resolution program, we refer to several sections of the Debt Resolution Agreement that disclose the potential consequences of the debt settlement process. At the same time, had she continued with the program she may have achieved the results that she desired upon enrollment, and that was the opportunity to settle her debts at a discount to the original balances of those debts.    We believe that in honoring Ms. [redacted]’s early cancellation of her program, and in seeing that she was refunded all monies in her reserve account with the third party processor, and in collecting no fees for its settlement services, our company has acted responsibly and consistent with the debt resolution agreement and addressed her desired outcome as stated in the Complaint.   Regards, Sameka G[redacted] Senior Director of Client Services Century Support Services

I received a response from Century services. I disagree with their response  first of all what they noted was false. They said that I signed a document in which I did and they have not held up their end of the bargain. They have also lied and when they call they do not have the correct information. I have been told for days that I will get a pay off amount I will receive an email and no one provides an email. I am not quite sure what type of company this is. I have taken more time and energy out of my Life to deal with these issues. Regarding the same incident from May to June with Calvary I have been lied to and then told the truth and then lied to again. I was even assigned a case manager Adrian who said she was going to provide a pay off amount for me and be my point of contact and I did not receive an email today. I was told I would receive an email with the pay off amount last week and no one ever got back to me. This company is for fraud and I do not recommend it to anyone.

This is in response to Ms. [redacted]’s response to Century’s response to her Complaint.  As we stated in our initial response, Century performed consistent with its obligations to Ms. [redacted]s under her debt resolution agreement.  In further response to the items Ms. [redacted]’s included in her reply to our response, Century provides the following response.  With respect to the allegation that Century represented to Ms. [redacted]s that our company had sent letters to her various creditors soon after her enrollment in the debt settlement program, that is simply not the case.  In fact, Ms. [redacted]s was informed that she would need to fund her settlement account in order for Century to approach her creditors with offers of settlement.  At a reduced draft amount of $300 (down from the $536 she agreed to at enrollment) at her request, the settlement account took some period of time to build.            Ms. [redacted]s states that Century was not to receive any fees for settling her debts until all debts were settled.  That is simply not the case.  The Debt Resolution Agreement (provided with our initial response to the Complaint) at Section 5. clearly states that our fee, once earned is charged in full, at the time the clients approves the settlement with that creditor and makes a payment toward that settlement payment plan.  Ms. [redacted]s claims that her credit score dropped during the period of time that she was in the debt settlement program.  Again, Section 3.B.(iv) clearly states the “Effects of Participation in a Debt Settlement Plan”, Century has no way of verifying Ms. [redacted]s credit scores at any time.  Further, as there are several factors that affect a person’s credit score, there could be other circumstances (besides participation in a debt settlement program) that may have affected her credit score. As to any accounts that Century attempted to settle for Ms. [redacted]s, those efforts ended when she cancelled her account.  At the time of cancellation, there were neither sufficient funds nor time to be settle any additional debts on her behalf. Ms. [redacted]s also states that certain creditors continued to contact her about her accounts while in the debt settlement program.  When we became aware of this, we referred her to UCAN (United Consumer Advocacy Network) a service that we make available to all of our clients at no cost.  Ms. [redacted]s declined to utilize UCAN’s services. In closing, Century has had thousands of satisfied clients over the years, and we are disappointed when any client does not complete their program.  In Ms. [redacted]’s case, we made every effort to assist her, and in conformity with her debt resolution agreement, and believe we have acted responsively and responsibly to her.  Regards,Sameka G[redacted]Senior Director of Client ServicesCentury Support Services

Upon review of Ms. [redacted]'s program it was determined that due to a technical error all of the scheduled payments owed on Ms. [redacted]'s [redacted] settlement were not remitted from the 3rd party bank. Century has since reached out to Ms. [redacted] to apologize for the error and frustration...

surrounding the issue.  The account has been renegotiated with [redacted] and Ms. [redacted] will be responsible for only the amount that would have been remaining owed from the original settlement.  Century will be covering the difference on the new settlement. It needs to be addressed that the main matter of my compaint was that this particular account was put in Collections and lowered my Credit score, which is the opposite of the goal in paying CNI to pay off these accounts. I do appreciate the acknowledgement of the mistake but need the entity of it to be addressed under the counter complaint.

Ms. [redacted] and I had a chance to speak on Thursday July 28th, 2016 and we agreed to a refund of $419.00 in settlement fees along with Century arranging and paying for a settlement on her [redacted] account. At that time, I explained that a refund release agreement would be emailed for her review and signature. The next day, I placed a call to Ms. [redacted] and left a message to advise her on a delay in the refund and release agreement. The reason it was not sent to her yet was because I was still waiting on a final settlement offer from [redacted] (the company currently collecting on the [redacted] account). Later that day, Ms. [redacted] spoke with another representative in our office, who conveyed the same message. It was our understanding that Ms. [redacted] understood the reason for the delay and did not have an issue waiting, in order for the complete details of the refund and settlement arrangement to be outlines on the release.In speaking with [redacted] today, August 2nd, we have been informed that they are no longer collecting the debt owed on the [redacted] account. A representative in their office indicated that the debt had previously been disputed by Ms. [redacted] and the decision was made to move the account to a non-collectable status and to purge it from their system. [redacted] will be updating the Credit Bureaus accordingly, as well as mailing a letter directly to Ms. [redacted].As such, I am attaching a copy of the refund and release agreement, showing that we have agreed to refund fees totaling $491.00.  Once this release has been signed and returned to our office, we will mail a check to Ms. [redacted] to fulfill the refund.  Thank you for your time and consideration in this matter. Sameka G[redacted]Senior Director of Client Services Century
