Case # [redacted]

                                          ... 05/01/2015
Dear [redacted],

[redacted] 2009 [redacted] with 153,535 miles did in fact have an extended warranty that refused to install the factory replacement assembly as we had suggested and offered to install a used transfer case which [redacted] agreed to.  [redacted] extended warranty only covers a portion of our warranty rate which is not uncommon with very high mileage vehicles. The extended stay was related to shipping delay for the used transfer case.  As far the heat shield separation this would be possible on any vehicle with this mileage. We did offer to look at the vehicle and determine the cause of the concern but were meet with belligerent language. I had to ask them to leave because of the scene they were making. With that said I would still look at the car again and offer to recheck our work at no charge.
As noted on [redacted] repair order are the following declined services or repairs :
# 1) Check Engine light is on – Has an aftermarket converter and wiring issues.
#2)  Oil Cooler seals are leaking oil.

An aftermarket converter maybe the root cause of the heat shield issue I will inspect at no charge.

Sincerely,
Gary F[redacted]

 Complaint: [redacted]
I am rejecting this response because:
I [redacted], did not buy the [redacted] from Chapman Nissan, my wife of 21
years [redacted] purchased the car. I believe she is entitled to use her
maiden name anytime she wants to.
On 7/08/2015,
I went up to Chapman Nissan and talked with Chris K[redacted] about what he had
promised to take care of on the car when we had tested driven the car. In which
was, why the doors were not locking and why the turn signals were not working properly.  I also told him the car would not start over the weekend  because of a bad battery cable on the car.  He told me to take the car down to Chapman
[redacted] and see a person name Jerry, but Jerry was out having surgery.  So, I call Chris, and he told me to talk to
tom.  I told tom about what was happen
with the car.  I told tom, the car doors
were not locking and the turn signals were not working properly and about a bad battery cable.  After the dealership found out the problem, I
get a call from tom, and he said you need turn signal switch, coil, and bracket
and also said I needed door actuators for the doors to lock, in which, cost
$2,000. I told tom to call Chris K[redacted] at Chapman Nissan. Tom called me [redacted] and said “Chris said he was not paying for anything”.  I truly felt like a fool standing there
because of a deceitful car sales man.  I
paid $446.85 for a diagnostic test and to have a battery cable installed. You
will see the Chapman [redacted] paper work dated 7/08/15.
On 7/25/20015,
the car would not turn on at all, so I had it towed to [redacted] Chevrolet. They
started working on the car 7/27/2015 as promised.  I won’t go into too many details, but they
had a hard time finding out what was wrong with the vehicle.  I became very frustrated, and call [redacted] Corporate
office and was assigned a Senior Adviser because of car dealership not finding
out what’s wrong with the car and keeping my car from 7/25/2015 to
8/07/15.  I had got many of the problems
on the car done for free because of the length of time the car was at the
dealership.  The car is in working
condition now. I paid a total of $447.12 The only thing that need to be done is
the door actuators and the turn signals .
The paper work for [redacted]’s is dated 8/07/15.
I like to
now talk to you about the documents that were sent to me.  There are three of the documents that we do
not know about or have seen at the time of the sale.  The first one is the document that says Stop
Please read the following.  We never saw  that document.
The other two documents dated 7/6/2015 were not present at the time of
sale. We were never there on 7/6/2015, all our documents were signed on
7/03/2015, the day of the sale.  Also,
the documents dated 7/6/2015 is not my wife’s signature.  It looks like someone forged  her name on those documents dated 7/6/2005. We
have another problem now.  Look this can
be solved if Chapman Nissan repaired the door actuators and the turn
signals.  That’s all I want done. Once
again, the documents dated 7/6/ 2015 is not my wife’s signature.  Hopefully, you will keep that in mind when
making your decision.
Regards,
[redacted]

8-10-2015In reference to the above listed complaint. On July 3, 2015, [redacted], not [redacted], purchased a 2009 [redacted] bearing VIN [redacted]. This vehicle was purchased "AS-IS" and [redacted] signed not one, but 4 documents stating that the vehicle was being sold...

"AS-IS" and that Chapman Nissan provides no warranty or guarantee. I have enclosed all related documents for your review. This vehicle was sold for $6,995 which is well below the Kelly Blue Book value of the car as it was priced as an "AS-IS" vehicle. We go above and beyond disclaiming that the vehicle is "AS-IS" when we sell these vehicles. As you can see [redacted] signed the following:•[redacted] Report•"AS - IS" Safety Inspection Repair Order•"AS - IS" Disclaimer•Chapman Nissan Disclaimer of Warranties•"AS - IS" Disclaimer #2 stating vehicle is sold "AS - IS" with just a basic safety inspectionAgain, we go through a complete explanation of what an "AS - IS" vehicle entails as well as have the customer sign 4 separate acknowledgements that the vehicle is "AS - IS" so as to avoid situations such as this.If you require any further explanation or documentation please let me know.[redacted] LOwner/ Operator

July 3, 2014
[redacted] brought her vehicle in to the dealership Service center with a complaint of noise” coming from rear brakes. At that time her rear brakes were disassembled and thoroughly cleaned. There was significant rust deposit built up on the brakes and this was removed and...

her rotors cleaned. After this repair there was still a noise issue and [redacted] returned to the dealership at which time the service department road tested the vehicle with the customer and could not duplicate the noise. Again, the brakes were cleaned. Shortly after [redacted] called complaining of the noise returning. At this time instructed our service department to replace the rotors at no charge to the customer. This repair was completed and again the customer is complaining of a noise but this time from the front.Chapman Nissan has gone above and beyond for this customer to the extent that the dealership replaced the customers rotors at no charge. This was done as good willby the dealership. At this point the dealership feels it has done all that it can do to resolve the customers initial concern of noise corning from the rear brakes,Please feel free to contact me with any questions.

Hello,
Chapman Nissan gave me the spare tire which was not given to me at the time I purchased my truck. Nissan's National Customer Care representative and Better Business'  assistance was the deciding factor in resolving this matter. Thank You for your help. Chapman Nissan ignored my calls for weeks until I sought outside assistance. Thanks Again.

Review: 11.4.13 engine diagnosis. Car towed in on a flat bed running. It was started by the tow truck operator. It was stated I needed a timing chain and tires which I did. I also was told the car should run like new. I did not have an issue with oil leaking and the oil light was not on.

11.8.13--Receive car and it cuts off after having it one hour -- another diagnosis I need a ignition coil and ignition valve. I got these repairs. No issue of oil leakage and not told anything either.

11.15.13 - After repairs the car present with an oil light on. I get an oil change. The car does not start. I get it to start the next day. I take it to the dealership. Request a rental car eventually got a rental that same day. From this diagnosis I am told I need 02 sensor and some other sensor. I get it. I am also told I may need an engine.

11.22.13- Pick up car stalls on the expressway. Now I am told I need an engine. Prices were given. on 11.26.13

Car still does not run. I have driven the car a total of approximately 5 hours.Desired Settlement: Refund my money and provide a used car which runs. Since my car is non operable now after the repairs.

Response:

12/05/2013Dear **. [redacted],In Response to [redacted]. [redacted] complaint. We did notify [redacted]. [redacted] on 07/22/13 when she complained of an engine noise reference [redacted] repair order [redacted] (attached) mileage 138,483 . We at no charge advised [redacted]. [redacted] that there was scoring inside the engine at that time and that we added 2 quarts of oil. 11/4 vehicle was towed in and required that the timing chains be replaced to get the vehicle running. She wanted to try to keep the car going and we did our best to help. Considering it was cheaper to get it running rather than Replace the vehicle. After we got the car running again there were other items including air fuel sensor and oxygen sensor that required replacement.4 Months and 5,139 mile elapsed since we added the 2 quarts of oil and informed [redacted]. [redacted] that there was scoring inside the engine. At this time the vehicle is in need of engine replacement. We informed the customer of the condition and did our best to keep her 143,622 mile 2005 [redacted] running. We provided her a discount on installing a new or used engine and are currently awaiting her response.

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the response. If no reason is received your complaint will be closed Administratively Resolved] Review: [redacted]I am rejecting this response because:

Because although they reference stating my engine scored. They never said I needed an engine. My car was brought it on 11..4..13 for a diagnosis of the engine. At that time they did not say anything about 7.22.13 for which I came in for an oil change which was complimentary from one of their mailers. They said what it could be from information I shared and typed it in but said after the oil change everything was ok. Their were no recommendations on my paperwork as it is usually when something is needed. My car was running on this date because the tow truck driver started it and said to keep it running while on the flat bed. From the diagnosis of the engine, I was informed it needed a timing chain and should "run like new". My car was returned the very same day approximately two hours later after getting my tires put on per their recommendations. They told me I needed engine mounts not an engine. My car was brought back 2 more times only a day or less within the repairs being completed. The total cost for all repairs were around $3000 (the cost for an used engine replacement). The car I believe was never properly diagnosed. I have responded to them via email and phone messages which they have not been responded to.

At this time I do not want them to do any work for me and I would like a refund of my money. The car has ran only for approximately 4 hours total. I have never had the car for an entire day. And it was after I stalled on the expressway they said I could possibly need a new engine negating everything they said from 7.22.13 which was a complimentary oil change, no engine diagnosis, no recommendations. I still am in need of retrieving my personal belongings from the car. I have attached the written attempts via emails which I received no response and there were phone calls.

Review: On July 12th,2013, I went to Chapman Nissan @[redacted]. to keep an appointment to have my car wash, and wax, including cleaning the inside of my car. It took them 50 minutes to wash and wax my car. I also ask to have an oil change done. This was my first time at this car dealer. I was not please with the service. My mirrors , console, stirring wheel, back flappers, hood, cup holder, and various other things were dirty. I talk to the service manager [redacted] about the problem. We walk outside to see my car. He call the person that service my car, and I did not like his attitude. The service person told me that it was just a wash and wax. **. [redacted] show that I was not happy at all. He said that he would refund my money back 100% percent, and he also ask me how much was my bill. I told him that my bill was $72.04, and he said that I would get my refund back within 3 to 5 business days. Now, it is July 24th, and I have not receive any of my money back yet. I call and talk to **. [redacted], and she told me that they put my check in the mail on Friday, July 19th.Desired Settlement: First, I would like my full 100% refund back, and I decide to continue to deal with [redacted] Nissan on [redacted]. I would like to receive coupons, and deals. I am thinking about purchasing a new nissan.

I received a delivering from UPS on Friday, July 26, 2013. The check was in the amount of $53.95. I still feel as though **. [redacted] (Service Manager) did not keep his promise of my full refund of my bill. However, if Chapman Nissan give me a full detail job on my car, which includes inside cleaning, wash, wax, and buff, I will not have this complaint put on their website. I would consider this gesture as a sign of good faith.. If they decide not to do this, I will be waiting for the second part of my check, which is $18.09. I am hoping that Chapman Nissan would do this detail, and so me their good faith.

Review: About 3 weeks ago I took my 2009 Nissan [redacted] to [redacted] Nissan to have rear brakes replaced. The dealership charged me in excess of 313 dollars to do the repair. I picked up my vehicle and almost instantly I heard noises from the now alleged repaired brakes. I proceeded to take my car BACK TO THE DEALERSHIP ANOTHER 3 TIMES!! But my brakes are not repaired. I reached out to the general manager [redacted] and the CEO [redacted], but still no luck. the gm assured me that I was getting new rotors to replace the ones that the technician damaged, however the rotors were just ordered and have come in on Thursday but I have to wait till Monday to bring my car in! I feel that the moment those rotors came in I should have been first and not waiting. Especially, since the gm lied to me and said they were replacing my rotors the last time and it was not done.PLEASE HELP MEDesired Settlement: 1 A FULL REFUND2 MY BRAKES REPAIRED CORRECTLY3 A WRITTEN APOLOGYIF THESE THINGS ARE NOT DONE I WILL BE FORCED TO CONSULT AN ATTORNEY
