Mr [redacted] ,CMR inspects roofs daily and will often advise homeowners to file an insurance claim on their roof because we believe their home either has visible hail damage or their home is in the middle of a neighborhood where other homes have damage Often times, insurance companies will deny the claim if there is not enough significant damage to warrant a replacement This is what happened in your case however, I have never had the experience of being accused of deceptive trade or lying because of their roof being denied Most homeowners are happy that they don't have the headache of replacing their roof Continuing to try and fight for a roof that does not have damage at this point could be viewed as trying to commit insurance fraud.The facts are that [redacted] advised you to file an insurance claim on your roof because he believed that it had damage Further, when the insurance company denied the claim and it was realized that there wasn't significant damage, you assumed that [redacted] was intentionally misleading and lied to you in order to deceptively get your business While we can not change how you feel about this, we do apologize In order for you to become our customer, the insurance company would have to approve your claim for us to even get your businessWe did not have a contract or any agreement with you at the time of inspection or at any time for that matter.To address your other complaint, CMR does not provide written reports on roof inspections [redacted] has been extremely busy helping families with severe storm damage to their homes and will not have the availability to visit your home or write a report for you The visit from [redacted] confirmed that there was no damage to your roof and to further pursue a claim on your roof would be futile CMR still respectfully declines your demand to hire an engineer to inspect your roof

It's clear that CMR does not want to accept that the roof installed on our house in was an improper installation in spite of the clear pictures and report from Allstate showing showing the faulty installation or the multiple roof worker including their own that stated the same(He uses the term minor installation issues, but I am showing evidence here they did not follow at all the installation procedures)they do not want to send us the proper information to file the warranty documentation with Atlas (shigle manufacturer) because they have seen the installation and know that the warranty claims will never be accepted by Atlas and that I would have no other alternative than to do what I am currently doingaccept that the shingles coming off the roof (in the previous set of pictures) is due to faulty installationCMR does not remember that we have been in mostly a drought for quite some time and that heavy rains were non existant for quite some ime, particularly in McKinney since the installation of the roofEveryone who has been up on our roof including CMR workers have acknowledged the shoddy installation of the shingles The first set of CMR workers, who I had to supervise, asked me who installed the roof because it was such a bad installationThe particular shingles used on our roof, Atlas Stormmaster Slate, has very particular instructions for it's usage in oder to be installed properly and for the roof to function correctly and withstand the years it was intended to withstand On top of that, we had purchased the upgrades (see CMR billing document already provided) that should have provided the premium warranty which would have covered both materials and labor to repair the roof After several discussions with roofing contractors about this shingle, they all say the same thing, it is very particular and you must get the proper alignment throughout the roof for it to function correctly CMR did not do this So I will illiustrate.I am attaching the nailing pattern picture from the roofing shingle packet required showing the nails must be in from each side and exactly in from bottom of shingle when using the nail pattern or nail patternthe nailing pattern instructions from the roofing shingle packet that details item #several pictures of the different shingles that fell off our roof by the chimney area that illustrate the nailing pattern was incorrect thus null and voiding the warranty by AtlasSo, while we understood both through verbal discussion with CMR and via the billing documents by CMR, that we were getting a year roof, it was in actuality no better than a standard roof with improper installation I would submit more pictures, but it appears there is a file size limitation on the pictures.While we indeed did find that the chimney was also leaking, it was not the primary leak The primary leak was the roof as evidenced by the pictures already submitted showing the shingle failures in March A chimney leak leaking on the inside of the chimney wall cannot cause the damage to the roof deckingThe decking does not go into the chimney and thus the rot and the roof leaking cannot be caused by chimney leaks.I find it almost humorous that CMR now submits an article on foundation shifting causing roof damage They are now foundation experts? They have examined my home foundation and identified it as foundation shifting problems? This is just laughable at best This is the first time they have ever brought this up even after multiple trips to my home to work on the roof Shame on you CMR for your deplorable actions and your self serving justifications CMR should man up and pay for my deductible required for the interior damage repair and the expense of the other contractor CMR called out initially who failed to deliver a proper resolution while we were under the clear impression he worked for CMR until half way through the project Otherwise we would have sent him home when he arrived But when your roof is leaking and more rain is on the way and the contractor has already removed a large portion of the roof around the chimney, you make sure the project is completed.Lastly, with the recent winds that came through North Texas, I indeed lost more shingles on the South side of the house, far away from the chimney (North side) of the house Nail pattern problems all too evident.But I guess, CMR is too busy with making a TV star in Florida of one of their employees than to satisfy this simple expense request from a customer who this future CMR TV reality star initally worked with.Please note that the pictures of the shingles show the wear and tear of weathering These are the shingles that came off the roof and were originally saved to file a claim with Atlas

To my knowledge Ms [redacted] is in communication with a CMR representative and we are working with her to address her issues

Mr [redacted] is not a customer of CMR and we have no agreement with himWe respectfully decline his demand to hire an engineer to write a report on his roof

CMR aplogizes about Mr [redacted] incorrectly stating that he saw hail damage on Mr [redacted] home, he was wrong and this will be addressed Mr [redacted] insurance company denied that there was any damage to Mr [redacted] roof, and after [redacted] visited the property CMR agrees that there isn't significant damage We did not have a written agreement or contract with the Mr [redacted] CMR does not want to pursue a contract with Mr [redacted] any longer and does not agree with his request to hire an engineer to write a report If Mr [redacted] wants to hire an engineer to inspect his roof and write a written report, we encourage him to do so

This Cleveland, OH area customer requested we investigate a leak in March Upon inspection, it was determined that leak was due to ice damming Ice damming is not covered under our warranty as it is generally caused by factors unrelated to the installation of the roof CMR's warranty tech performed the non-warranty repairs per the terms of the service agreement and the customer was contacted by CMR staff to advise of the issue, the solution, and the cost Customer has refused to pay the bill, but CMR has not pursued collections at this point See attached photos, invoice and service agreement

[redacted] believed that there was damage to the roof, when there was none That is what I was referring to when I said he was "wrong"He will receive additional training so that he can more accurately identify hail damage I'm not sure who "everyone" is that agrees there is damage to your roof but perhaps you could call for a reinspect from your insurance company (that also did not see damage) and the "everyone" you are referring to would be able to show them the damages that we did not see

Insurance adjustor and "individual contracted" (i.ethe person they called out and did not identify that he did not work for CMR until the job was half way done) have all noted it as the roof was improperly installed Insurance adjuster report (included) show the pictures of the roof Insurance identified the main source of the leak was the roof, not the chimney The Chimney is indeed leaking but it is not as CMR is indicating as the main cause of the leak Internal chimney leaking will not cause the massive slump in roof decking, not will it cause shingles themselves to start sliding down the roof (Attached image of Before Repair).Of course CMR tried to fix the roof damage In the first case, they sent out a crew without a supervisor and I had to supervise the crew myself Then after the leak continued on Thanksgiving night with my house full of guests, CMR sent out a crew again after they leak tested (only the roof, not the chimney) and identified that their work was still deficient on the roof (roof was still leaking) as well as the chimney needed repairs I keep asking for a bill from them for the chimney repairs they effected, but I have not gotten that However, the chimney still leaks and we are getting another company to fix it (but this has become off topic).I did receive a call from a CMR representative yesterday who essentially blamed me for my roof leaking saying that I had nail patterned the shingle wrong and that's why I had the roof leak Sounds awfully odd that the company that installed the roof would blame the owner for the nail pattern used by the said installing company This person was not at all involved in any of the months of dealings nor with the original contract but yet he talked as if he was the expert on the entire situation This person is not about making it right for the customer or actually resolving this complaint, but trying to strong arm me from backing out of my complaint.The problem is still that I am out for my deductible for the resulting water damage to the inside of my home and the money paid to BSD (invoice attached) because as the insurance adjuster report states "Poorly installed roofing/ inconsistent shingle exposure"I have asked and still not received the necessary information to file a warranty application with Atlas roof - the makers of the shingles The reason is very clear Atlas will not honor the warranty due to improper installation CMR knows this and will not give out the proper documentation CMR contract attached to show the "upgrade" provided but none of the actual documentation I need to register for the Premium Protection Warranty from Atlas (brochure attached).My claim is still the original claim: Reimbursement of the BDS costs (invoice attached): $1,625Reimbursement of the my deductible: $2,

Complaint: ***A CMR rep has contacted me and has taken info about all of my issuesThe first time he came was about three weeks agoPromising me he would be back soon to measure, etcHe made a couple of appointments with me and was a no show each timeFinally last Saturday, Oct he came out and said someone would be out to look at my gutters sometime this weekGutters are just one of my issuesI'm currently out of town until Oct I will let you know if anything has been doneI didn't want to wait to answer this request since you gave me such a short time to answerSo far this complaint needs to stay open

CMR has responded to several calls from the customer We believe we have addressed each issue as it has been presented, including the basement leak that was shown to be due to a deficiency with the basement wall We will investigate these recent claims and take appropriate action

I was contacted by *** *** of CMR Construction, ###-###-####, on 3/11/@ 4:pmI explained the situation to him about the leakHe stated that it sounded like it could be from ice damming, however, he would go ahead and have it repaired under warrantyHe said *** from AAY Roofing would be contacting me to schedule a time for the repair*** *** of AAY Roofing, ###-###-####, contacted me on 3/18/@ 7:pmI discussed the issue with him and scheduled him to come to my house on 3/19/@ 8:amI stayed home from work the morning of 3/19/and nobody showed up to repair the roofI had no further contact from CMR Construction, or AAY Roofing, aside from receiving an invoice a week later for $for non-warranty work due to ice dammingNobody from CMR or AAY contacted me regarding issue, resolution, or costIf anyone from CMR or AAY did contact me, please provide dates, times, and phone number called from as I'm able to verify from phone recordsUpon my inspection of the roof, there is no indication of any repair work being doneI contacted *** *** on 3/30/@ 11:am to discuss invoiceLeft message, no replyContacted *** *** again on 9/23/@ 1:pm to discuss invoiceAgain, left message, no replyContacted CMR Construction on 11/9/@ 2:pm to find out if *** *** still worked at the company because none of my calls have been returnedSpoke with answering service and told them I would like someone to contact me regarding the issue because *** *** had not returned any callsAgain, no replyFinally fed up with the process, filed Revdex.com complaint on 12/9.I'm not able to see any attachments (photos, invoice, service agreement) from the company responsePlease send to ***@yahoo.comNonetheless, the roof looks the same as it did when I originally called about the issueThe shingles are still lifted in the area where it was leakingThere is no indication that any repair work was done

I am rejecting this response because: I still have hail damaged siding that was never replacedIn fact one of the CMR employees offered to give me money back instead of fixing the damage I told him, I wanted the siding fixed, not the money for it A ceiling in my kitchen that had water damage from the roofing that was not installed correctly Roof has never been fixed where the leak came from in the first place Gutters that were never finished that just end on top of my roof Water spills off of the roof.Concrete patio damage from the standing water due to poor installation of new gutters This was verified by one of CMR's employees He brought it to my attention before I said a word about it to him CMR has ignored all attempts I have made for these problems to be corrected
