Complaint: [redacted] I am rejecting this response because: The Business sold the machines telling me, and so says the contract, that there were Locations that were accepted to have my machines in their places as soon as I approve themWhen I contact the locations that the business emailed me they said they were not INTERESTED in my machines, there is one location that even knew what I was talking aboutThe Contact in the Call Center the Business mention clearly told me they were not interested in any machinesAnd I have not contact the two locations The Business just emailed me because that was not the dealThey are selling Coffee Vending Machines with a Location to place it, they tell people that the locations already knows about the Coffee Machine that you are suppose to take there and THAT IS NOT TRUEThe Business told me that I was going to approve the locations they email me, NOT that I have to call the Locations and ask them whether they are or not interest in my machines Sincerely, [redacted] ***

Complaint: [redacted] I am rejecting this response because: The company letterhead I received had NO signature, NO person's name, and was obviously something he just threw together and emailed meThe person would NOT even tell me his nameI didn't even know his name until I saw it on here! This is to respond to Complaint ID# [redacted] To clarify Mr [redacted] complaint He has received two locations for his coffee machine Being that he was not satisfied with the first location he was then sent a hotel location which he is not stating in his complaint which does want the coffee machine and is great location Customer did receive a brand new machine and if there is any issues that is he having such as a dent on the machine he has the contact phone number to the factory that handles all these issues where he can call [redacted] all did receive a dvd and manual showing how to operate the machine He also has the technical departments phone number if he has any questions of learning how to operate the machine he can contact them directly and they will be more than happy to help [redacted] has received everything that is written on his contract which he signed and part of the contract clearly states once a customer receives his machines there are no refunds and he has nothing to be complaining about he has received locations that are wanting the machine

We have sent customer *** *** a company letter head letter on Friday 08/08/stating we would refund his full amount of $5,but will not paying for shipping back. Shipping charges are $to ship back the machine. The reason why we do not refund the customer without shipping the merchandise back is because we do not no if the machine has any damages nor do we no if the customer has tampered with the machine.

This is a response to complaint ID# ***. Our customer *** *** purchased coffee machines and locations *** did receive his machines which is exactly the machine that is advertised on our company website *** did receive locations. He is claiming that none
of these locations are wanting the machines. It is very strange because when he mentioned that each location was called back by the location company we use and and they were all verified that they do want the machines. There were even two locations that mentioned to the location company that *** never ever contacted them and were waiting for *** *** *** to call them This is the *** dealership. The general manager of the car dealership was given *** cell phone so that he can bring the machine there. Plus the call center and technology company stated that are ready for the machine *** *** has no reason to be complaining he is receiving everything that is written on his contract. Plus on another note it clearly states in his contract which he also claimed he never received which he have proof of that he did that there are no refunds once he receives his machines so at this point there are no refunds provided. We also have been in contact with *** *** stating that if he wasn't satisfied with any of the locations first being sent that the location company would be providing a new group of locations next week sometime. On ending note we are here to see *** *** succeed in his coffee business and we will work diligently to make that happen for him

Thank you for sending the response to my complaint of Coffee Machines USA. My response contained below and my reasons for not accepting their comment is supported with corresponding evidence
I have taken each comment made by Coffee Machines USA in order of it’s appearance in their response to my complaint:
Contract
Ms***, *** *** ***, states that I received everything that is written in the contract. My first contact with *** *** occurred over the telephone in response to an inquiry I had made to the Coffee Machines USA advertisement on Franchise Opportunities website. When I first spoke with *** ***, I was not impressed with the numbers he presented, declined to move further with him and terminated the phone call. Within a short while, I received another call from *** *** and in this phone call, he had just what I was looking for:
One location for all machines (at a local hospital).
Each machines was expected to make a minimum of vends a day which totaled a minimum of $dollars a day per machine
My initial investment was anticipated to be recovered within the first month, per *** ***
Each location was guaranteed for years
Coffee Machines USA to pay for year warranty on each machine
Coffee Machines USA to pay for training
Coffee Machines USA to pay for all machines being placed at each location
Coffee Machines USA to pay for products for all machines for the first week of business
Coffee Machines USA to pay for T-Shirts with my logo and business name on them
*** told me to get my business up and running in preparation for Machines’ arrival and placement
Immediately following this phone call, *** *** sent me a Purchase Order detailing most of what is bulleted above
I Sent the check via electronic scanning to *** *** at Coffee Machines USA for the total sum of $18,500. After reviewing the Purchase Order I felt comfortable moving forward with this arrangement
Purchase Agreement dated 6/17/follows:
The contract below is, unfortunately, very hard to read. This is the condition it was received. I will take a minute to briefly describe each clause:
1) Delivery of product is Seller’s responsibility
2) Manufacturer guarantees to replace or repair defective products
3) The Purchase Order is intended by the parties as a complete and final expression of the agreement between the parties
4) Seller will provide buyer with the products as purchased
5) Buyer responsive for his/her own business costs
6) Buyer responsive for federal, state and local taxes as required by law

It is important to note that at no time has Coffee Machines USA provided me with the single location for all machines as stated in the Purchase Order
It is also important to note the machines were not delivered for approxweeks. At no time did *** *** state that there was a problem with the site where my machines were to be place. At no time did *** *** say he would not refund my money if Coffee Machines USA did not perform as stated verbally and in writing.
Please proceed beyond contracts and scanned checks for section of response
2) Locations: Ms*** writes that I have “received more than double amount of locations. I was not informed until I began speaking with *** *** during the month of September that the original location for which I had purchased the machines for was no longer available. Remember, I paid my money on June 18, *** *** did not become involved until after I sent an email to *** *** expressing my frustration and anger at his and Coffee Machine USA lack of performance in September. To date I had only received the machines, no location, no training, NOTHING!!
Below are the lists of the two separate locations Coffee Machines USA sent as a result of *** *** involvement. Please note the comment below which was written by ***. I had received nothing from *** *** during the month of July stating he was looking at different locations for me. This was the first time I was even aware that my original location was no longer available. (please remember, I terminated my previous conversation with *** *** because he could not provide me with what I wanted.)
At *** *** urging I contacted each of the sites listed below. Upon contacting each site below and introducing my self, not one was aware that I would be calling. When I further described that I was given their name by Coffee Machines USA they replied with a “Who?” They did not know who I was or who Coffee Machines USA was and they knew nothing about Coffee Vending Machines.

SECOND SET OF LOCATION
After getting such a dismal response from the first set, I called *** *** and reported the problem. A second set of locations was sent
Upon receiving this second set of locations, I called the first two locations, *** *** and *** ***. They both were aware of Coffee Machines USA, but had been told a contract would be forthcoming and they wanted to view it before meeting with me. They also stated they were told that if they chose to locate the machines on their property it was to be on a “trial” basis. NO THREE YEARS as stated on my Purchase Order.
It is also important to note that in all location cases on these two documents, I was informed that none of them were expected to provide more than vends a day. That is not anywhere near the vends a day promised by *** ***
Yet again, I reported the problem to *** ***. I was informed that there is NO contract! None of the locations wanted to see me without a contract. I did not contact the final two locations as by this time I had contacted out of locations and they were all BAD. I have not heard from Coffee Machines USA since this last phone call was made to *** ***

3) Product Bonus: When asked, no one could tell me what a product bonus was. However, as Coffee Machines USA sent me a check for $I cashed it as it was at least $reducing the amount I need to recover to $18,000.
I believe they intended the product bonus to pay for the first weeks worth of product for each machine; however, this was never spelled out to me and I could be wrong
4) Tech: Ms*** writes that they even had a tech they were going to pay top provide me training and deliver the machines to their locations.
Below is the e-mail I sent *** *** re: the tech he said he was hiring.
It needs to be said at this time that *** *** stalled and evaded me for more than weeks stating that he was having difficulty getting in touch with the tech. After much frustration on my part, I finally got a phone number from *** ***. It turned out when I called the number he gave me that the person he was calling the “Tech” and the person who was supposed to train me and place the machines at their location was the importer who distributes the machines once they come in from China. He, *** from *** Shipping, does NOT train or place the machines
Finally, *** *** did contact a Tech, ***, and after much frustration AGAIN, I wrote the following email to him. A copy of the text is provided below due to the poor quality of the original

You have me scared!!! *** just called me to say he is unable to get the location of were the machines are due to goHe said he doesn’t have a location name, address or contact information He also said he has been unable to get the information on where to submit an invoice for training this Thursday and that if you don’t pay him, he’s going to bill me WHAT IS GOING ON!!!
Is this just more of the same delaying tactics???? I need a response from you I need to know you have provided location information to *** All along you have refused to give me this same information stating I would receive it from the tech upon my training I need to hear from you ASAP to know this is going to happen And, if training does not occur on Thursday, you need to refund my $18,immediately

5) Location Assistance:
Ms*** writes that all I need to do is contact these that I’ve previously contacted and they’ll be “happy to assist” me. While this sounds lovely, who is she kidding? Not me! If the location service could not provide me with viable locations the 2nd and 3rd time around, what would make a person think they can be depended upon for a 4th time. I say 2nd and 3rd time as *** ***’s location was the 1st location
Additionally, I do not have the contact numbers for *** *** and I never had the contact number for their location service

We even have a tech waiting to bring her two machines to her dedicated locations. *** first has to select the locations she has been sent that is her responsibilityShe entered into a coffee businessPlus the reason for the delay of the machines is all verifiable information where news even came out on *** and *** *** about what was going in ***. Plus we are attaching the contract the *** *** signed and you can clearly see in section where it states under no circumstances there are no refunds. *** *** is receiving everything she paid for so there shouldn't be a reason for her to upset. Good morning this is my rebuttal to my complaint ID # ***
The coffee machines shown on website and explained to me are not the machines I received. They are not all new machines. You can tell at least was used.
The manual found in one box shows a cup holder that should be attached on door of machine and connected to two wires seen in my machines. However,
The cup holder is not in any of machines. This would clearly indicate the machines are not functional without a place to put cups in and product when made
Also, neither manual nor DVD indicated what products I need to place in machine or how to place. I was told on numerous occasions someone is coming
To give me training. I was inconvenienced every week for months waiting and later finding out a new reason why they could not come
As per contract, I was to receive the first month refills for each machine. He e-mailed numerous times it was sent. I never received the products
As per contract, I was to receive a year warranty that included parts and labor. I never received the warranty
As per contract, I was to receive locations to place machines in. I asked numerous times to get these contacts. He never sent them or told me. We talked
About possible places but never gave me a number, name, or address
I have tried to contact this company of which I left voice messages on his phone and did not receive a reply to my last e-mails Since the last e-mail, I called the
toll free number and talked to *** when asked. He refused to give his last name. He stated if the call was urgent. I said it was. I have not received a call back
I would like to resolve this issue with this company. At this point, I gave $18,and I did not receive the products agreed and promised. The machines
Cannot operate for they are missing a vital piece. I would like to work a settlement with this company to avoid a possible negative mark and a loss of
future customers for them

Our customer *** *** signed a contract that clearly states one machine with one location *** *** has received his coffee machine and has received two locations for the coffee machines. Our customer has also been provided with a dvd and manual which clearly shows how to operate the machine. He has also been provided with the tech department contact information for further questions on how to operate the machine. The contract *** has signed also clearly states in Section that there are no refunds once he receives the machine *** contract has been fulfilled. If he is needing another location because for some reason he is not satasfied with what he has been provided then all he has to do is ask the location company and they will be more than happy to provide
