Concerning [redacted]'s project, specifically his insurance
recovery claim contract with Colonial Remodeling, a number of items were not
performed and please see an attached revised final invoice.  All work...

has been completed is notated on the invoice attached and [redacted] still
has a balance of over $4000 with Colonial Remodeling.  To address [redacted]'s specific numbered concerns with the project, please see as follows:
#1.  Colonial will agree to fix any interior damage caused by
the roof installation and skylight trim will be addressed.  Will take only
1 day to complete this aspect.
#2.  The left side of siding was not replaced, and the credit
is issued on the invoice.  If [redacted] would now like it done,
we can add the charges back into the invoice.  [redacted] and Colonial
were in confusion over whether or not this specific work (ie Siding replacement
on the left elevation of the property) and it never got done, therefore a
credit has been issued.
#3.  Screen credit is notated on invoice, however if
homeowner would like it performed, we can provide this service and add the
charges back in to the invoice.
#4.  Air Conditioner unit service is also credited in current
invoice, and again we can do the work if they want, but charges will need to be
added back in.
I have met with [redacted] more than once, on the jobsite, and
we had success in the early stages of getting the work completed.  Once
there was confusion over the amount of siding work that was to be done, [redacted] verbally indicated to Tim and I that he would not be paying any more
money to Colonial Remodeling.  We obviously had an issue with a customer
not paying their contracted balance so the project has been on hold until now.
 Concerning the statements about Colonial Remodeling "using
Subcontractors", we have nothing to hide.  We are a General
Contractor and use sub Contractors occasionally and also use some of our own
crews.  
We would like [redacted] to review the attached invoice and let
us know what, if any, additional work he would like performed.  In the
event that [redacted] wants additional work performed, we are requesting
that the client mail in 1/2 of the balance currently owed (see attached
invoice) and have the final payment ready the day we finish up.
 Otherwise, we will place [redacted]'s account into a 3rd Party
Collections agency and pursue possible litigation if [redacted] refuses to
pay his balance owed.

Our firm represents Colonial Remodeling, LLC (“Colonial”) regarding the work performed for [redacted] (“[redacted]”).  [redacted] filed a complaint with the Revdex.com on March 28, 2017, case number [redacted]. This letter is to provide Colonial’s response to [redacted]’s claim....

Exhibits, supporting documentation, and emails are available upon request. Please direct all communication to me directly at the contact information listed below.Colonial and [redacted] executed a Contract on July 12, 2016 to perform repair work that was approved by [redacted]s’s insurance company, [redacted] (“[redacted]”), and at a rate acceptable to Colonial. After the Contract was executed, Colonial submitted the claim to [redacted] on [redacted]’s behalf, in accordance with the Contract. The initial amount that [redacted] approved in the letter dated September 1, 2016 was $10,367.41. [redacted] kept back $2,032.39 as Depreciation and the $1,000.00 deductible. [redacted] issued a check to Colonial for $7,568.19 on September 7, 2016. [redacted] also issued a check to Colonial for $800, which is the $1,000 deductible minus the $200 referral discount.In accordance with Page 2 of [redacted]’s letter dated September 1, 2016, hidden/additional damage was found by Colonial that resulted from the hail storm. Additionally, more work was required to meet code requirements. Therefore, Colonial contacted [redacted] to approve these additional items (“supplemental work”). [redacted] issued a revised scope with the supplemental work on September 12, 2016 raising the claim amount by $824.12, bringing the total amount of claim number 458941-GD to $11,191.53. Colonial believed that [redacted] should have approved more of the supplemental work than the $824.12. For example, [redacted] only approved approximately 60 linear feet of the gutters and not the entire amount that Colonial submitted. Colonial attempted to contact [redacted] so [redacted] could contact [redacted] about this additional unapproved work. According to [redacted]’s emails, [redacted] was out of the country and would not respond to Colonial’s calls and/or emails for several months. Therefore, Colonial was not able to get any further supplements approved by [redacted]. In addition, [redacted] stated in an email dated March 28, 2017 that “You [Colonial] all had nothing to do with any other claims after 7/12/2016.” However, [redacted] misses or refuses to acknowledge that under the Acknowledgement Section of the Contract it states “Any supplement approved by the customer(s) insurance provider for additional work or cost increases will become part of this agreement.” [redacted] initialed the Acknowledgement Section that he read and understood its contents. Therefore, the supplement that [redacted] approved on September 12, 2016 raised the total amount of the claim to $11,191.53. Colonial confirmed with [redacted] on two separate occasions that [redacted] released to [redacted] not only the Replacement Cost Value but also the Depreciation totaling $10,191.53. This amount should have been turned over to Colonial. Therefore, it is [redacted] who is in default under the Section titled “Default” of the Contract.In addition to the contract language claim, [redacted] make the argument that Colonial has failed to perform certain work. I am rejecting this response because:The message from the business is a lie. They cancelled the contract because insurance didn't approve their supplement request in full. After the complaint I was contacted by the business and accepted $150 (half) deposit refund and other half being charge for temporary plastic they had installed on the roof as temporary repair. The matter is now closed.  Regards,

Review: Colonial Remodeling, based in [redacted], VA, put an addition on our house between May and December 2012. The promised three-month project took more than six months. While most of the framing and large construction seems to have been done well, the entire project was marked by poor project management, poor communication, and substandard interior finishing work. We documented the problems in our punch list and withheld final payment pending satisfactory completion of all work. Between January and April 2013, they fixed some of the problems, attempted but failed to fix others, and ultimately never completed the punch list, leaving 15 items undone. Between May and October 2013 the only work performed was replacement of two mismatched windows. These replacements were handled by an insurance company retained by Colonial. Once the windows had been replaced Colonial requested final payment in mid-December 2013. After communicating by email, we responded in writing in mid-January 2014 and retained $8,186.00 to cover work which had already been redone or will have to be redone. We provided documentation (bills, receipts, payment checks, and written estimates) for all of these expenses, explained why we were retaining the funds, and said that we no longer trusted Colonial to complete the remaining work. With the exception of one item, worth $105, we had previously identified all of these were problems, and most of them were on the punch list. We made this partial payment on January 13th, and Colonial immediately cashed the check. Rather than address any of the problems they referred us to a collection agency for the retained. In order to avoid damage to our credit rating, we have paid the total bill.Desired Settlement: We would like Colonial to refund the $8.186.00 we have paid or will have to pay to finish and redo this work.

Response:

Work was completed per the executed client agreement with our company. We did not receive the final payment from the client so we had to refer the final invoice to our third party collections group. We were simply attempting to collect our fee for services rendered. We do have supporting documentation of satisfactory inspections done by both the construction lender and the local county entities. Review: We had a Hail Damage June of 2012. Colonial came out to offer an inspection and contact our insurance company if any damage was found. We had to sign a consent and give the $250 deposit for them to do this. Colonial found damage and gave of an estimate for repair and started to work with our insurance company. They provided a very high cost of repair which insurance did not accept, they then lowered the cost after meeting with the adjuster on several occasions. This has been going on since September. Work has not been started for one reason after another, meanwhile wanted us to sign rights over to them as well as a $10,000 deposit (against MD Home improvement law). Threatened to sue as on several occasions for breech of contract. Then after providing all paperwork to them would not provide us with documentation we had been asking for & needed for our Mortgage company. After all of this a year late & several ADDITIONAL STORMS We still don't have any of the work completed and Colonial will not return any of our phone calls or emails. WE HAVE DOCUMENTATION AND ATTORNEY LETTERS if you would like additional information.

Response:

The client called us to handle their insurance claim and negotiation and emergency repair. Colonial Remodeling accepted a $250 deposit and began by tarping the client's house to stop immediate leaking. Through negotiations with the insurance company and said client, our sales representative, [redacted], was able to get some, not all of the necessary repair work approved. The client was offered services that were in excess of even what was already approved and the client declined, asking for more additional services for free. At this point, we realized that we would not be able to perform the project and declined to offer any more services, as the client's requests were more than unreasonable.
